On March 22, 2026, at approximately 1536 hours, I responded to [1900 BLOCK] Roxey Ln in reference to a domestic dispute.

While on the way to the location, dispatch advised that it had been physical and that a male inside the residence possibly had a gun. Upon arriving on scene, I grabbed my county-issued rifle and went to try to make contact at the front door. When I knocked on the front door, I heard a female inside the garage tell me that she was in there. I then went to the garage and made contact with [WITNESS #1]. [WITNESS #1] told me that her 17-year-old son and her husband had been in a physical altercation.

I then opened the interior garage door and started to give commands for anybody inside to come outside. As soon as I did, the 17-year-old came outside to the garage. I told him and [WITNESS #1] to go and stand behind my patrol car. [WITNESS #1] told me that her husband’s name was Alveto Rivera. She also told me that her four-year-old daughter was in the master bedroom. I continued giving loud verbal commands for Alveto to exit the residence, with no response.

While standing there giving the commands, I could hear footsteps upstairs. Once multiple other Deputies arrived on scene, [WITNESS #1] gave consent for us to enter the residence to make contact with Alveto and the young Juvenile that was still inside the residence. When we made entry and started clearing towards the stairs, Alveto verbally acknowledged that he was inside the house. Deputy Aycock started giving him commands to come down stairs and speak with us, but he refused multiple times.

While Deputy Aycock was speaking with him, I went to the bottom of the staircase and saw Alverto standing in the master bedroom door. I started giving him loud verbal commands to keep his hands up and walk towards me. When I first started giving these commands, he did not comply. He then listened to my commands and came down the stairs, where he was placed in a pair of double-locked handcuffs and detained.

Alveto was then escorted out of the residence, and I went upstairs to check on the young Juvenile. I made contact with her in the master bedroom. She then walked downstairs with me were she was turned over to her mom. I then spoke with the son and asked him what happened. He told me that he heard his mom and her husband arguing upstairs and heard him making threats to her. He stated that when he heard this, he went upstairs to protect his mom and tell Alveto to not to speak to her that way.

The Juvenile then said that when he got into the bedroom, Alveto came out of the bathroom, yelling at him, and walked up on him. The juvenile told me Multiple times that he felt threatened, so he hit Alveto. They then both went to the ground and continued fighting until his mom got on top of Alveto and told the Juvenile to leave the room. The juvenile stated that he then went downstairs to his room, but before he went into his room, he grabbed a kitchen knife off the counter.

He told me that Alveto then came downstairs, still trying to argue and threaten him. The juvenile told me that he was in his room, standing on the bed with the knife in case Alveto came to try to attack him. He said that while he was standing there, Alveto started hitting his bedroom door and broke it. [WITNESS #1] then shut the door and separated the two of them.

I then spoke with [WITNESS #1], who stated that she and Alveto were upstairs arguing over the car. Alveto then started to threaten to damage her car and that she was going to be late for work. [WITNESS #1] said that her son then came upstairs, and that is when Alveto walked towards him, and they just started fighting. [WITNESS #1] told me that she was able to get them separated, and her son went downstairs.

She then said that Alveto also went downstairs, and her son was in his bedroom. They were still actively arguing, so [WITNESS #1] was finally able to get them separated, and that is when she went into the garage to smoke a cigarette. She told me that her son had just recently moved back into the house, and he had to leave originally because he and Alveto did not get along, and Alveto was aggressive with him. She told me that this is not the first time it has become physical between the two of them, and also stated that Alveto is the more aggressive one who usually starts the arguments.

I then spoke with Alveto. He told me that he and [WITNESS #1] were having an argument, and that is when her son came upstairs. He stated that a “boy” should stay in his place and not get involved in the argument. He then admitted that they got into an altercation but would not really go into details about what happened. I then explained to him that he would be charged with the following.

OCGA 16-5-70(b) Cruelty to children 1st degree Due to Alvero Rivera getting into a physical altercation with his seventeen-year-old stepson, [REDACTED BY AGENCY]. Alvero left multiple marks and cuts on [REDACTED BY AGENCY] body during the altercation between the two of them.

OCGA 16-5-70(d)(2) Cruelty to children 3rd degree Due to Alvero Rivera committing the offense of Battery Family Violence in front of his four-year-old daughter.

OCGA 16-5-23.1 Battery Family Violence Due to Alvero Rivera leaving multiple marks and cuts on his stepson, [REDACTED BY AGENCY], during a physical altercation with him.

OCGA 16-7-21(a) Criminal Trespass Family Violence Due to Alvero Rivera kicking and punching his stepson’s bedroom door during a domestic dispute with him and damaging the door.

OCGA 16-10-24 Willful obstruction of Law Enforcement-Misd. Due to Alvero Rivera’s ignoring multiple lawful commands to exit the residence he was inside during a domestic dispute. He also ignored multiple commands to come downstairs when we finally made contact with him inside the residence.

Alveto was then searched with no contraband being found. He was then transported to the Barrow County Detention Center and turned over to Jail staff without issue. My backseat was checked both before and after transport.

[WITNESS #1] was given a family violence pamphlet and had it explained to her.
