Officer’s Narrative:

On November 6, 2021 at approximately 1713 hours, I was dispatched to a domestic dispute at [200 BLOCK] W Oak St. Winder, GA. APT [REDACTED]. I responded code 1 and arrived at approximately 1720 hours.
Upon arrival, I made contact with the victim/complainant, [REDACTED BY AGENCY]. [REDACTED BY AGENCY] was crying and visibly upset. [REDACTED BY AGENCY] advised she and her boyfriend/suspect, Austin Casper had a verbal altercation. As I was speaking with [REDACTED BY AGENCY], Cpl. Thomas was speaking with Austin. [REDACTED BY AGENCY] stated Austin was upset with her about her possibly cheating on him and lying to him. [REDACTED BY AGENCY] said Austin began taking her things and aggressively throwing them outside. [REDACTED BY AGENCY] explained that Austin had gotten so angry that he punched a hole in a door in the apartment. [REDACTED BY AGENCY] stated she and Austin had also been in an argument about items for her daughter that he would not let her have. [REDACTED BY AGENCY] stated nothing physical had occurred between the two. She also advised he had not threatened her in any way. When asked if [REDACTED BY AGENCY] was scared that Austin would hurt her during the altercation, she began crying and said she was scared that he would hurt her when he punched the door. I asked [VICTIM #1] if she had been living at the residence. She advised she had slept there every night for the past 4 months. I asked [REDACTED BY AGENCY] if she would be willing to write a statement about what occurred. [REDACTED BY AGENCY] agreed and said she would.
As I was going to retrieve a witness statement form from my vehicle, I spoke with Cpl. Thomas about what Austin was saying. Cpl. Thomas advised that Austin said he was yelling and punched the door. I advised Cpl. Thomas that [REDACTED BY AGENCY] and Austin’s stories appeared to be matching. I approached Austin and asked him to tell me his side of the incident. Austin advised he was unhappy with [REDACTED BY AGENCY] due to her lying and possibly cheating on him. He advised he had continuously tried to talk to her about not lying to him. Austin also stated that [REDACTED BY AGENCY] was not a resident. I asked Austin if she had been sleeping there. He admitted she had been sleeping at the residence for the past 4 months, but that she did not receive mail there. Austin was informed on the fact that [REDACTED BY AGENCY] was a resident at that location. Austin advised when he punched the door, it was not directed at her. He advised he would not hurt her. Austin stated he punched the door after she had walked past it into the bedroom. I asked Austin if he would write a statement for me and he said that he would do so.
As Austin was writing his statement, I returned to [REDACTED BY AGENCY] in order to provide her with some domestic violence resources. [REDACTED BY AGENCY] was advised as to who she could contact if she needed help in a domestic violence situation. I asked [REDACTED BY AGENCY] if I could step back inside the residence and photograph the door that Austin punched. She said that I could. The door had a fist sized hole and was damaged. After taking pictures, I made contact with Austin again. I asked Austin if he would walk up to my car with me. As we arrived at my car, I asked Austin to set his phone on the hood of my patrol car. I advised Austin he was under arrest for Simple Assault (FV) as well as other charges and to place his hands behind his back. The handcuffs were checked for proper fit and double locked.
Prior to search incident to arrest, I asked Austin if he had anything on him that was going to hurt me, etcetera. As I was saying this, Austin spontaneously uttered that he had a “felony” charge. I was confused by his statement and asked what he meant by it. Austin stated he had a Dab pen in his front pocket with THC oil inside of it. The dab pen was seized for evidence at this time. Austin advised that the THC was initially [REDACTED BY AGENCY] but that he took it from her. I advised Austin that due to it being in his possession upon arrest, the charge would fall on him. Austin was compliant and understood. Ofc. Wolf and I placed Austin in the backseat of my patrol car and seat belted him in for his safety.
I walked back up to the house and advised [REDACTED BY AGENCY] that Austin would be going to jail. [REDACTED BY AGENCY] was upset and stated she did not want Austin to go to jail. [REDACTED BY AGENCY] was provided with a business card and a case number. [REDACTED BY AGENCY] advised she would be staying at the address listed on her license for the evening. Austin and I arrived at the jail without incident. The backseat of my patrol car was checked prior to and after transport.
Warrants for Simple Assault (FV), Criminal Trespass (FV), and Possession of THC Oil will be secured.
Evidence seized was logged on property receipt A-23547, entered onto LERMS, entered into GBI DOFS evidence submission, and stored in locker 11.
