Officer’s Narrative:

On November 13, 2021, at approximately 0927 hours, I responded non-emergency to [600 BLOCK] Chicken Lyle Rd. in reference to a 911 hang-up. Dispatch stated they tried to call the complainant back however it went to voicemail.

Upon Deputy Wolf and I arriving at approximately 0929 hours, I saw a white male who I recognized as Austin Evans walking on the shoulder of the roadway just past said resident.

As I exited my patrol vehicle to speak to Austin, Deputy Wolf went to see if everything was ok. As I asked Austin was everything ok and he appeared sweaty and a little upset. He explained that he and his girlfriend [VICTIM #1] got into an argument over his cellphone. He said he has been staying on property for several months and has been going back and foward with [VICTIM #1]. He said around 0900 hours this date [VICTIM #1] went thru his cell phone and then she started banging her head against the wall. I asked him why she would do that, and he said she is crazy. He kept saying he did not touch her, and she attacked him early this month

Deputy Wolf met with [VICTIM #1] and [WITNESS #1] at the front door. [VICTIM #1] hesitated to talk about what happened. [VICTIM #1] said she and Austin used to date. He asked her what happen to her left eye, and she said Austin headbutted in her face while they were arguing in the room causing her left eye to bruise. She went on saying Austin has been placing his hands on her, following her, and would not leave her alone, since she had been out of jail.

I asked her would she like to write a witness statement of what took place and she said yes. I provided her with a statement form.

I asked [WITNESS #1] the owner of the property who stays here between [VICTIM #1] and Austin and he stated [VICTIM #1] stays here. He explained Austin wanted to stay here but he told him numerous times to leave but he come back. I asked [WITNESS #1] if he would like to write a witness statement and he said yes. I provided him with a statement form.

After completing my investigation, I have established probable cause to place Austin Evans under arrest for Battery Family Violence. There have been several histories of a domestic dispute occurring at this location (See Case numbers 2021-00062019 and 2021-00053212. There is a Temporary Protection Order against [VICTIM #1] where she cannot be around Austin.

Deputy Wolf provided [VICTIM #1] with a case card and explain the Family Violence pamphlet.

I told Austin he was under arrest for Battery Family Violence and to turn around and place his hands behind his back. I placed him in a double-locked handcuff checking for fit. As I began to search his pockets of any weapons or contraband, Austin admitted to having a small amount of white powdery substance in his right pocket. Inside of his right pocket, I pulled a black pouch that open to a blue container which had two small baggies of white powdery substance suspected to be Meth I also recovered a black metal hand knuckle from his pocket that was not in plain view. I then secured him in the back of my patrol vehicle.

I transported Austin to the Detention Center where he was turned over to the Detention staff without incident. A victim notification form was also completed.

The following warrants to be taken:

To Wit: Austin Evans did intentionally headbutted [VICTIM #1] in the face while they were arguing causing her left eye to be swollen black and blue.

To Wit: Austin Evans did admit while searching his pockets for weapons or contraband, he had a small amount of white powdery substance in his right pocket. Inside of his right pocket, I recovered a blue container that had two small baggies of white powdery substance suspected to be Meth.

To Wit: Austin Evans did knowingly have and carry about his person a black metal hand knuckle, which is a weapon designed for the purpose of offense and defense. Said black hand knuckle was concealed in his pants pocket which was not in an open manner and fully exposed to view.
