[NARRATIVE #1]

On 12/01/2021 at approximately 0248 hours, I was conducting a neighborhood check of Roxeywood Park. As I drove by the recreational area with the pool and basketball court located on Roxeywood Drive just past Maxey Lane, I observed a vehicle parked in the parking lot. The vehicle was a gold Honda Accord, tag of [REDACTED]. I saw the windows were fogged up, leading me to believe someone was inside. I called out with the vehicle to Dispatch and shined my headlights into the vehicle and turned on my running blue lights. I saw movement inside the vehicle. I approached with my flashlight shining inside the vehicle. I saw two people, a male and a female, both who appeared young in age.

They were both in the backseat of the vehicle with their clothes on. The female opened the door and stepped out. I had the male step out and sit on the curb. First, I asked their ages, they both stated 17 years old. A few minutes later after getting their dates of birth, the female stated she was actually 16 years old, and her parents did not know she was out at this location. The male said he did not have a license or ID and provided his name as Brian Miranda. He stated the vehicle belonged to his mother in Dacula and she did not know he took it out tonight. I asked what they were doing out here and they both replied, “hanging out” and “chillin.”

The 16 year old female said she lived in the neighborhood and that her parents were home. Sgt. Bradley arrived and I asked him to take her home and make contact with her parents. He left with the juvenile. I continued interviewing Brian. I looked inside the vehicle and saw a condom on the rear floorboard, and I also saw rolling papers. I asked him again what they were doing here, and he responded with “what is the age for sexual consent here?” I told him I saw the used condom in the backseat where they had been sitting. He admitted they had sexual intercourse at one point while parked here. He said they had been here about an hour, and he had picked her up from her house. I asked if there was anything illegal in the car like marijuana. He said yes, that he had marijuana in the vehicle. I asked for him to go get it. Brian then pulled out two separate clear baggies from the center console, both containing a dried green leafy substance that appeared to be marijuana.

Brian attempted multiple times to get his mother on the phone but she could not answer. I asked Dispatch to send Gwinnett County to the residence in Dacula. Sgt. Bradley called me after speaking with the juvenile’s parents. I informed him of what I had learned occurred. He informed her parents of the incident that had taken place. He said when asked if they wanted to press charges against Brian for interfering with the custody and contributing to the delinquency of a minor, they stated yes. At that point, I placed Brian in handcuffs behind his back, checked them for proper fit and searched him for contraband. Nothing was located. I spoke with a Gwinnett County police officer and informed her of the incident. I asked her if she could make contact with Brian’s mother, [REDACTED], and let her know what where her vehicle was and what was going on. I informed her he may have taken the vehicle without permission.

I locked the vehicle with the keys Brian had in his possession. Brian admitted the suspected marijuana was his and gave me the OK to dump it out and destroy it on scene rather than take it for evidence. I took photos of the baggies. Each bag was dumped out and disposed of, they only contained a small amount of “shake” in each. I met with Sgt. Bradley and collected the juvenile’s information as well as her parents’ information. I transported Brian to the detention center where he was released to the staff present. My backseat was searched before and after transport, nothing was located. Warrants were taken on Brian Miranda for contributing to the delinquency of a minor and for interference with custody.

[NARRATIVE #2]

On December 1, 2021, at approximately 0252 hours, I responded “Code 2” to the pool area near Roxeywood Drive and Maxey Lane in reference to assisting Lt. Guest. Lt. Guest advised via radio that he was out with an occupied suspicious vehicle.

Upon arriving, I saw a vehicle with the windows fogged up. I also saw a male, later identified as Brian Miranda, and a female, later identified as [16 YEAR OLD FEMALE]. Lt. Guest asked that I transport [16 YEAR OLD FEMALE] to her residence at [1900 BLOCK] Roxey Lane. He advised that she was a juvenile and needed to be turned over to a parent. While enroute, Lt. Guest advised that Brian and [16 YEAR OLD FEMALE] had intercourse.

I made contact with [16 YEAR OLD FEMALE]’s father, identified as [REDACTED], at [1900 BLOCK] Roxey Lane. I asked [REDACTED] where [16 YEAR OLD FEMALE] was. He advised that she was in her bed. I told him that she was not and that she was in the backseat of my patrol vehicle.

Lt. Guest asked that I call him once I made contact with a parent. I called Lt. Guest who advised that Brian and [16 YEAR OLD FEMALE] had intercourse and smoked marijuana. He asked if I would ask [REDACTED] if he wanted to press charges against Brian for contributing to the delinquency of a minor.

I spoke to [REDACTED] and explained that [16 YEAR OLD FEMALE] and Brian smoked marijuana and had intercourse. I asked if he wanted to press charges against Brian for contributing to the delinquency of a minor. [REDACTED] advised he did. I notified Lt. Guest.

I asked [16 YEAR OLD FEMALE] what time she snuck out. She advised around 0000 hours. She admitted to smoking marijuana and having intercourse.

I released [16 YEAR OLD FEMALE] to [REDACTED].

I provided [REDACTED] with a case card and told him how to get a copy of the report.
