Officer’s Narrative:

On 1/11/2022 at 0111 hours, I was on patrol on University Pkwy at the intersection of Jackson Trail Rd when I observed an eastbound vehicle traveling at a speed that I visually estimated to be 90 MPH in the 55 MPH construction zone. I turned on my MPH Bee III speed detection radar device and measured the speed at 93 MPH in the 55 MPH zone. I turned on my blue lights and the vehicle, a Ford Mustang displaying Georgia tag number [REDACTED], only slowed as he was blocked by slower eastbound traffic.

As I neared, he weaved between other eastbound traffic in a possible attempt to evade me. I approached the rear of the Mustang and it pulled to the side of the roadway after passing the intersection of Hog Mountain Rd.

I approached the driver, identified as Anthony Bowen, and he immediately told me that he did not know I was coming after him. I told him that he took off after I turned the blue lights on and he stated that he had slowed down. I told him that I observed him weaving through traffic and he stated that he did not know it was me. I told him that he did not do it until after my blue lights were already turned on. He apologized. I detected the strong odor of an alcoholic beverage.

I asked him how much he had to drink and he stated none. I told him to exit the Mustang and walk to the rear which he did.

I asked him why he was driving so fast and he stated that he was just trying to go have some fun with his buddies. I still detected the strong odor of an alcoholic beverage. I told him that I could still smell the alcohol and asked how much he had to drink and he stated one beer. He stated that he had the Coors beer with his father two hours earlier.

I told Bowen that since he was speeding, driving recklessly and had been drinking, I wanted to perform some evaluations to assess his ability to drive and asked if that was okay. Bowen agreed to participate. His speech was slurred. I requested another unit.

I asked Bowen if he took any drugs or had any medical conditions and he stated that he took Adderall twice a day and had a pin in one leg. I asked Bowen if he had any condition that would prevent his from standing, walking, or turning. Bowen stated that he might have a problem because of the pin.

I told Bowen to stand with his feet together and his hands at his sides. I asked Bowen to look forward and not move his head. I told Bowen to follow my light with his eyes only. I asked Bowen if he understood and he stated that he did.

I checked for equal pupil size and detected it. I checked for resting nystagmus, but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it in both eyes. I checked for angle of onset of nystagmus and detected it at 40 degrees in both eyes. I checked for vertical nystagmus and did not detect it. Bowen’s eyes were bloodshot and watery. He had a sway. I detected six clues.

I told Bowen to stay in that position and told him that I was going to circle his face with my light, I told Bowen to follow the light with both eyes. I told Bowen that I would bring it towards his nose and he was to follow it with both eyes. I told Bowen that if he needed to cross his eyes that was okay. I asked Bowen if he understood and he stated that he did.

I checked for lack of convergence and observed it. His left eye would not come to center.

I told Bowen to stay in that position with his feet together and his hands at his sides. I told Bowen to stay in that position while I explained what he needed to do. I told Bowen that when instructed he was to lean his head back and close his eyes. I told Bowen that when I told him to begin, he was to tell me when he thought 30 seconds had elapsed. I told Bowen that when he thought 30 seconds had elapsed, he was to open his eyes and say stop. I asked Bowen if he understood and he stated that he did. I told Bowen to lean his head back and close his eyes. I told him to begin.

Bowen estimated 30 seconds in 26 actual seconds. he had a forward sway.

I showed Bowen a straight line and to place his left foot on it. I told Bowen to place his right foot in front of it, heel-to-toe. I told Bowen keep his hands at his sides and demonstrated. I told Bowen to stand in that position while I demonstrated the nine step walk and turn evaluation and not to begin until told to do so. He told me that he could not do this because of the pin in his leg.

I told Bowen to stand with his feet together and his hands at his sides and he complied. I told Bowen I was going to demonstrate the one leg stand evaluation. I told Bowen not to begin until told to do so. I asked if understood and he stated that he did.

I demonstrated how Bowen was to lift a foot of his choice approximately six inches off the ground and pointed out. I explained that he was to keep both legs straight and keep his hands at his sides. I told Bowen he was to look at the raised foot and count aloud in the following manner, 1001, 1002, 1003, etc. until told to stop. I asked Bowen if he understood and he stated that he did. I told Bowen to begin.

Bowen raised his arms by more than six inches and swayed. he hopped to attempt to maintain balance. He did not count until prompted and did not keep a proper count once he started.

I retrieved my portable breath tester and Bowen stated that his mom and dad don’t want him to do that. He stated that his dad is a cop and told him never to blow. He asked if he could call his parents and I told him not at this time.

I told him that this was voluntary and if he did not want to cooperate, we would move on. He asked if I could give him both sides of the decision. He asked if I could tell him what would happen if he refused. I told him that I could not and it was his decision. He provided a breath sample that was positive for the presence of alcohol (BAC.111).

Bowen told me that he was going to play baseball for UGA next year.

I told Bowen that I knew he had drunk more than one beer. He stated that he had drunk two beers in the last two hours. I told him that I knew he had more than that and asked how much he had all day and he said six. I told Bowen that he was DUI.

He asked if the passenger, identified as Chloe Morris could drive the Mustang. I asked if she had been drinking and he stated that she had not. Bowen cried that his life was ruined. I asked why he did not have her drive in the first place and he stated that she asked him to drive.

I placed Bowen under arrest. I read Bowen the Implied Consent notice for individuals under age 21 years and asked if he would take the state administered blood test. Bowen refused to provide a blood sample at the hospital. He asked questions about the blood draw and I explained that it would be taken at the hospital and sent to the GBI for analysis.

He stated that he did not understand, so I read Implied Consent to him one paragraph at a time and asked if he understood and he stated that he did. I asked if he would take the state administered blood test and he agreed

I handcuffed Bowen, checked for fit and double-locked them. I searched Bowen for contraband and found none. I placed Bowen in the rear seat of my patrol car.

I went to Morris and asked if she had been drinking and she stated that she had not. I still smelled alcohol She asked if she had to blow to drive the Mustang and I told her yes. She agreed to provide a breath sample.

She exited the Mustang and walked my patrol car. I retrieved my portable breath tester and she asked if she was positive would she get into trouble. I told her that she had told me that she had drunk nothing and she agreed. I told her that she was not driving, so would not be charged with DUI. She asked if she could be charged with anything and I asked how old she was. She stated that she was 18, so I told her that she was not supposed to be drinking at all. She told me that she had a BUI in July on a jet ski and was nervous. I told her that she had nothing to worry about if she had not been drinking.

Morris told me that she drank a beer at 9 pm. I explained that her admission was enough for me to prosecute her for underage consumption. She told me that Bowen’s dad had given her a drink and told her that he was a cop and she was allowed to have a drink. Morris provided a breath sample that was positive for the presence of alcohol (BAC.044).

I placed her under arrest and she was transported to the Barrow County detention center by Deputy Catapano. Morris had no one local to come for the Mustang, so I requested next list wrecker. Mike’s Towing arrived and took possession of the Mustang.

I transported Bowen to NE Ga.-Barrow hospital where Bowen provided a blood sample that was drawn by lab tech [REDACTED]. [REDACTED] sealed the GBI DUI blood kit.

I transported Bowen to the Barrow County detention center where I cited his for DUI (OCGA 40-6-391), reckless driving (OCGA 40-6-390), speeding in a construction zone (OCGA 40-6-188) and underage consumption of alcohol (OCGA 3-3-23).

I cited Chloe Morris with underage consumption of alcohol (OCGA 3-2-23).

I placed a temporary 180 day driving permit sticker on the back of Bowen’s DUI citation and explained it to him.

Prior to leaving, I checked my rear seat for contraband and found none.

I placed the GBI DUI blood kit into evidence.
