On Wednesday November 1, 2023, at approximately 1233 hours, I was dispatched to a 28 East May Street (Zaxbys) Winder, GA 30680, in reference to a road rage incident Barrow County Deputies got out with initially. I responded to the scene CODE 1.

I arrived on scene making contact with Sheriff Judd Smith. Sheriff Smith stated he was flagged down on East May Street for this road rage incident. Sheriff Smith stated he had seen something happening and initially thought there was an accident that happened. Sheriff Smith stated he did see 2 male subject get back into there vehicle, a red Ford Mustang GA Tag [REDACTED]. Sheriff Smith then stated when he got to the incident location, the subject who flagged him down had a fresh hand print mark on the left side of his face. Sheriff Smith also stated both parties were yelling and arguing with each other, but the only thing he saw was the 2 male subject get back into their vehicle.

I then went to make contact with the victim. The victim was identified as Mr. [VICTIM #1]. Mr. [VICTIM #1] had a noticeable mark on the left side of his face. The mark did look like a hand print on the left side of his face. Mr. [VICTIM #1] stated he had pulled out of Winder Square parking lot and got into the central turn lane on East May Street to travel westbound. Mr. [VICTIM #1] then stated he merged into traffic in front of the red mustang. Mr. [VICTIM #1] then stated the driver of the red mustang started honking and yelling.

Mr. [VICTIM #1] then stated the red mustang used the turning lane to go into Zaxbys to get back in front of Mr. [VICTIM #1]. Once the red mustang was back in front of him, 2 male subjects got out of the vehicle cussing at him and yelling. Mr. [VICTIM #1] stated once the 2 male subject approached his vehicle one of the subject slapped him in the face through his driver side window. Mr. [VICTIM #1] stated he then remembered seeing a patrol vehicle in the drive through of Taco Bell and began to flag down an officer.

I then went to the red mustang with 3 occupants. The occupants were identified as: driver Mr. Christopher Borum, passenger Mr. [WITNESS #1], back seat passenger Ms. [REDACTED]. Mr. Borum and Mr. [WITNESS #1] stated Mr. [VICTIM #1] had come pulling into traffic and almost struck their vehicle. Both subject then stated Mr. [VICTIM #1] started to yell and cuss at them so they started to cuss back. Mr. Borum then stated when he got out of the vehicle and approached Mr. [VICTIM #1], Mr. [VICTIM #1] attempted to get out of the vehicle and he kept the door closed so he did get out.

Mr. Borum and Mr. [WITNESS #1] stated it was just an argument that occurred and nothing physical ever happened. Mr. [WITNESS #1] did say Mr. [VICTIM #1] had put his hands on their vehicle and was hitting the hood of the vehicle. No dents or scratches were on the hood of their vehicle. I then asked both Mr. Borum and Mr. [WITNESS #1] who struck Mr. [VICTIM #1] in the face. Both Mr. Borum and Mr. [WITNESS #1] stated neither one of them touch Mr. [VICTIM #1].

I then went back over to Mr. [VICTIM #1]. Mr. [VICTIM #1] stated if he could see both the men then he would be able to positively identify who struck him in the face. Mr. Borum and Mr. [WITNESS #1] were brought outside of the vehicle. Mr. [VICTIM #1] positively identified Mr. Borum, by his clothing, that he was the individual who struck him in the face.

Mr. Borum was placed under arrest for battery and disorderly conduct. Mr. Borum was placed into 2 pair of handcuffs behind his back, double locked, and checked for proper fit. Mr. Borum was then searched incident to on site arrest for any drugs, weapons, contraband, or means of escape, none were found. Mr. Borum was then read Miranda Warning at approximately 1259 hours. Mr. Borum agreed to Miranda Warning. Mr. Borum was stating he did not stick Mr. [VICTIM #1], but was not going to say who struck him.

Mr. Borum was placed into the searched and cleared back seat of my marked patrol vehicle 406. Mr. Borum was seat belted in for safety. Mr. Borum was then transported to Barrow County Detention Center. Mr. Borum was turned over to Barrow County Jail Deputies.

Warrants taken on Mr. Borum.

2023-4099MW Misdemeanor Battery 16-5-23.1 Mr. Borum is charged with battery against Mr. [VICTIM #1] for striking Mr. [VICTIM #1] on the left side of his face leaving a visible mark on Mr. [VICTIM #1]. Mr. [VICTIM #1] positively identified Mr. Borum as the person who struck him in the face during a road rage incident.

2023-4098MW Misdemeanor Disorderly Conduct 16-11-39 Mr. Borum is charged with disorderly conduct for getting out of his vehicle and approaching another vehicle while cussing and screaming at the driver. Mr. Borum did strike the driver of the vehicle in the face. This occurred in the middle of traffic on East May Street.

Pictures of the victims face were taken and attached to this report. Back seat of marked patrol vehicle 406 was searched and cleared, before and after, transportation of Mr. Borum.
