On April 18, 2026 at approximately 1540 hours I observed a gray Polaris Sportsman four-wheeler being operated by a white male on Wall Road near Amalie Drive. There was another white male who I could tell was a juvenile on the back of the four-wheeler. I activated my emergency lights to conduct a traffic stop and the driver pulled the four-wheeler onto the shoulder of the road and came to a stop.
I introduced myself and informed both males I stopped them because it was not legal in Georgia to operate a four-wheeler on a public roadway. I asked the driver for his license and he informed me he did not have them on him. He also claimed he did not know it was not legal to operate his four-wheeler on a public road. I asked him his name, and he identified himself as Christopher Hallmark. I asked the male on the back how old he was and he informed me he was 11 years old. Christopher informed me this male was his nephew.
As Christopher spoke to me giving me his name and birthday I could smell the odor of an alcoholic beverage. I asked him how much he had drunk and he claimed he had one beer.
I went to my patrol vehicle and ran Christopher’s information through GCIC. His driver’s license was valid and he did not have any warrants. I returned to the four-wheeler and informed him everything checked out fine, but that I wanted to make sure he was not under the influence of alcohol to the point where it was affecting his ability to drive. I asked him to step off the four-wheeler and he complied. When he did this, I noticed he used the four-wheeler to push himself upright and then hold himself up. I next asked him to kicked off the slides he was wearing and simply walk straight toward me. He did this and I noticed he was unsteady on his feet. I informed him I wanted to administer Standardized Field Sobriety Test on him and he agreed.
I informed Christopher I was going to check his eyes. I could see he was not wearing glasses, and he informed me he was not wearing contacts. I angled him away from my patrol vehicle so that my emergency lights were not in his field of vision. I informed him I needed him to follow the tip of my finger with his eyes, and I instructed him not to move his head. I first checked for equal tracking and equal pupil size, making two passes each way. I observed equal tracking and equal pupil size. I next checked for a lack of smooth pursuit, making two passes each way. I observed a lack of smooth pursuit in both eyes. I next checked for distinct and sustained nystagmus at maximum deviation, making two passes each way. I observed distinct and sustained nystagmus at maximum deviation in each eye. I next checked for the onset of nystagmus prior to 45 degrees, making two passes each way. I did not observed the onset of nystagmus prior to 45 degrees. I did not check for vertical nystagmus because by this time, Christopher was having trouble following my fingertip with his eyes and he seemed to be getting uncomfortable standing there. I informed him he could relax and he stated his shoulder were tense from landscape work. During the test I observed 4 out of 6 clues.
I next administered the Walk and Turn. The surface was flat and there was partially a fog line for him to walk on. He chose to remove the slides he was wearing. I asked him to imagine the fog line in front of us extended to us and then past us. I asked him to place his left foot on that imaginary line and to place his right heel against his left toes. He complied and I asked him to stay in that position without doing anything whatsoever until I asked him to do so. He claimed he understood. I next gave him clear, precise instructions about how to complete the test. I demonstrated everything I wanted him to do after I gave the instructions. Before I completed the instructions and demonstration Christopher began walking.
I had to tell him to stop and wait until being told to start. He stopped and stood with his feet together, not in the position I had told him to stay in until being told to start. After I finished the instructions and demonstration, I asked Christopher if he understood everything. He claimed he did so I told him he could begin. While he did the test I observed that he, in addition to having started too soon and not being able to stay in the proper position during the instruction phase, missed heel to toe on multiple steps, stepped off the line, and turned improperly (instead of doing as I demonstrated he stopped completely, turned his body to the right, and then took the position needed). I observed 5 out of 8 clues. I also observed he did not count all steps out loud as I had instructed him.
I next administered the One Leg Stand. I gave clear, precise instructions and demonstrated everything he needed to do. He stated he understood the instructions and did not have any questions. I asked him to begin and observed he swayed, used his arms to balance, hopped, and put his foot down multiple times. He was never able to raise his foot long enough to even start counting. I observed 4 out of 4 clues.
I next asked Christopher if he would be willing to provide a breath sample for portable alcosensor. He stated he would. He provided the sample and the machine showed positive for the presence of alcohol.
I this time I informed Christopher he was under arrest for Driving under the influence. I handcuffed him behind his back, checked the handcuffs for proper fit, and double-locked the handcuffs. I searched his clothing and person incident to arrest.
I read Christopher Georgia’s Implied Consent Notice for Drivers over 21 from my green card and asked for a breath sample. He agreed to provide a sample. I allowed him to call family that was close by and they responded to take possession of the four-wheeler and custody of the juvenile.
I transported Christopher to the Barrow County Detention Center. After being searched, Deputy Bond used the “Intox” machine to obtain breath samples from Christopher. The samples he provided were all so far apart that the machine would not recognize either test (we tried twice) as a valid test. For this reason I read Christopher his implied consent notice again and asked for a blood sample. He stated he would provide a sample.
I transported Christopher to Northeast Georgia Medical Center Barrow and at 1750 hours Phlebotomist [REDACTED] took a blood sample. She then sealed the package and turned it back over to me. I have since placed it in a secure evidence locker.
I transported Christopher back to the Barrow County Detention Center and released him to detention staff without incident. I issued him citations for DUI, DUI endangering a child, and Operating unregistered vehicle. Prior to and after transport I searched my patrol vehicle.
