Officer’s Narrative:

[NARRATIVE #1]

On November 5, 2021 at 0016 hours I was searching the area of Highway 211 for a gold Dodge Caravan that had just ran from a Winder Police Traffic stop. I was then advised that Lt. Hansen was attempting to catch up to the suspect vehicle at Highway 211 and Dee Kennedy Road. I activated my emergency lights and made may way to the area. As I was only a mile or two behind the now county vehicle pursuit I was listing to Lt. Hansen’s radio traffic.

Lt. Hansen advised that the suspect vehicle was approaching the new round about located at covered bridge and Highway 211 and a few seconds later advised that the vehicle was unable to navigate the turns and had wrecked out. He then stated that the driver, described as a black male had ran on foot. I advised that I was a few moments out and I needed other responding units to set up a perimeter, as I pulled up to the scene.

I retrieved K9 Dax from the vehicle and placed him in the tracking harness, I then removed him from the patrol car and gave him the command to search. He pulled down a large muddy hill and then to a wood line. As we arrived at the wood line K9 Dax entered and started to pull right. He located a black shoe and then continued into the woods. As we made are way deeper into the woods I observed that K9 Dax lifted his head and began to air sent and use his eyes, just then I heard a male voice say “I’m right here.” As K9 Dax swung his body towards the sound I observed a black male concealing himself behind a tree approximately twenty feet in front of my position. Using K9 Dax as overwatch the male was ordered onto his stomach and then ordered to keep his hands flat on the ground. K9 Dax provided this over watch till Sgt. Jordan arrived to assist Lt. Hansen in handcuffing and removing the suspect from the woods. K9 Dax was praised and returned to the patrol vehicle. I then assisted in searching the vehicle and other duties on scene until the scene was closed.

[NARRATIVE #2]

On 5 November 2021 at approximately 0016 hours, I was in the area of Highway 211 NW and Rockwell Church Road NW Winder Barrow GA. I was looking for a gold Dodge Caravan displaying GA temp tag ([REDACTED]) which had fled west on Atlanta Highway NW from Winder Police Department at approximately 0007 hours.

I observed what appeared to be a minivan approaching the intersection on Highway 211 NW coming from the direction of Winder. After the vehicle proceeded north through the intersection, I confirmed it was a minivan. As I caught up with the vehicle, I noticed it had a paper temporary tag flapping and while negotiating a curve the passenger side brake light was out. The vehicle was a gold Dodge Caravan.

I notified Dispatch I was behind the BOLO vehicle. I requested the channel as the driver had already initiated a pursuit (which was called off by Winder PD). I provided Dispatch of the direction of travel and 80 mph. Just after passing Dee Kennedy Road, I activated my emergency lights and siren signaling for the driver to pull over. The driver failed to yield and instead sped up. I notified Dispatch of the pursuit.

The Caravan continued to travel north on Highway 211 NW. I requested Dispatch notify Braselton PD as it appeared the pursuit was heading their direction. Dispatch was provided speed updates and location updates. As the pursuit passed Station 5 off Highway 211 NW the speed was over 100 mph in a posted 55 mph zone. No traffic was present northbound on Highway 211 NW, however there were multiple vehicles passed traveling southbound.

Approaching the new round-a-bout at Highway 211 NW/Covered Bridge Road and Old Hog Mountain Road, the driver failed to maintain his lane of travel by driving right of the white fog line. The Caravan went down an embankment and then traveled back up the other side of the embankment striking (2) two roadside signs and going airborne. The Caravan landed on the Covered Bridge Road side of the round-a-bout, where it became disabled from the impact. The vehicle continued slowly north along the sidewalk and guardrail before coming to a stop.

A black male wearing black jeans, a black jacket and dreads exited the driver’s side of the Caravan. No other occupants were observed. The male ran around the front of the Caravan, stepped over the guardrail, traveled down an embankment and into the woods.

I exited my patrol vehicle requesting responding units establish a perimeter. K9 Dep. Stephens arrived on scene and deployed his K9 partner Dax. K9 Dax tracked down the embankment and into the woods. Paralleling Covered Bridge Road, K9 Dax tracked the male through the woods. A black male was located hiding behind a tree. He was wearing black jeans, a black jacket, had dread locks in his hair and no shoes. He was given commands to lay on his stomach and show his hands. The male complied.

I moved in and handcuffed the subject behind his back. I then began to search his person incident to arrest. Inside his right front pants pocket, I located a clear plastic bag with a green leafy substance, due to multiple encounters on patrol I suspected of being marijuana. In an inner jacket pocket, a billfold was located along with an ID.

The male driver was identified as Damarann Washington. Looking at his ID card, I observed an address of 300 Patrol Road in Forsyth. Knowing this is a prison address, I asked Damarann how long he had been out and was advised (3) three months. Damarann was asked if he had any injuries and he advised no. Damarann was assisted to his feet and then escorted out of the woods.

A search of the vehicle revealed no other illegal narcotics. Georgia State Patrol was contacted and responded to work the crash (GSP#C000794256). Per GSP’s request next list wrecker, All Around towing responded and took possession of the vehicle.

A GCIC/NCIC check of Damarann showed he had a suspended license for failure to appear. Damarann was searched again and seated in the rear seat of Dep. Breazzano’s patrol vehicle. Winder PD was contacted and Off. Bazinet responded. He confirmed the vehicle was indeed the one he attempted to stop. Off. Bazinet was provided with Damarann’s information and subsequently issued (3) three traffic citations.

Dep. Breazzano transported Damarann to the Barrow County Detention Center for processing. The suspected marijuana weighed bag/contents approximately 3.7g and was secured into an evidence locker.

I secured warrants on Damarann for the following:

Brake light requirements O.C.G.A. 40-8-26(a)(1); for his operating the 2005 gold Dodge Caravan GA temp tag ([REDACTED]) when the passenger side rear brake light did not function.

Fleeing attempting to Elude O.C.G.A. 40-6-395(b)(5)(A); for his operating the gold 2005 Dodge Caravan GA temp tag ([REDACTED]) on the highways/roadways of this State and willfully failing to bring said vehicle to a stop when given an audible or visual signal to do so while traveling at double the posted speed limit.

Speeding O.C.G.A. 40-6-181; for his operating the gold 2005 Dodge Caravan GA temp tag ([REDACTED]) at 105 mph in a posted 55 mph zone

Failure to Maintain Lane O.C.G.A. 40-6-48; for his failing to keep the gold 2005 Dodge Caravan GA temp tag ([REDACTED]) nearly as practical in one lane, being the northbound lane of travel on Highway 211 NW when he drove it right of the solid white fog line.

Striking a Fixed Object O.C.G.A. 40-6-272; for his striking the (2) State owned signs located at Highway 211 NW and Covered Bridge Road Hoschton Barrow Georgia and not taking the necessary steps in notifying the owner of such damage.

Driving While License Suspended O.C.G.A. 40-5-121; for his being in actual physical control of a motor vehicle, a gold 2005 Dodge Caravan GA temp tag ([REDACTED]) on the roadways/highways of this State knowingly when his privilege to do so was suspended for Failure to Appear with a violation date of 7/27/2016 and suspension date 4/28/2017

Possession of Marijuana (misd.) O.C.G.A. 16-13-30(J); for his being in possession of the green leafy substance located in a plastic bag in his right front pants pocket and bag/contents weighing approximately 3.7g.
