Officer’s Narrative:

On 12/05/2025 at approximately 1901 Hours, I Ofc. Dutcher, J #141 was dispatched to 305 N Broad St. Winder, GA. 30680 in reference to a Dispute. I traveled code 1 in my marked patrol vehicle #402.

Upon my arrival, I met with [WITNESS #1], who stated that he witnessed the dispute. [WITNESS #1] stated that he was at the front desk waiting for his food, and Mr. Darrell Armstrong was standing behind him waiting for his table. [WITNESS #1] then stated that while they were waiting, the restaurant became very busy, and a lot of people were attempting to enter the building and wait for a table.

While they were waiting, a Juvenile [REDACTED BY AGENCY]-year-old [REDACTED BY AGENCY]) had entered the store and began waiting as well. While they were waiting, [WITNESS #2] and her two juvenile children attempted to enter the building. While they were entering, [REDACTED BY AGENCY] attempted to step to the side to allow them to enter, and while doing so, he accidentally stepped too close to Darrell’s friend, Ms. [WITNESS #3], who was sitting down, which placed [REDACTED BY AGENCY] butt close to her face. Darrell then immediately stood up and began screaming at [REDACTED BY AGENCY], telling him to move and get out of the way, overall being very irate.

[REDACTED BY AGENCY] then told him he didn’t mean to, but there was no need for Darrell to speak to him like which caused Darrell to become even more agitated and scream at him even more. [REDACTED BY AGENCY] then stepped to the side in an attempt to resolve the situation, which led to Darrell sitting down. At this time [REDACTED BY AGENCY] mother, Ms. [VICTIM #1], entered the building to see what the dispute was about. Darrell then stood up and approached [VICTIM #1], and began yelling and screaming at [VICTIM #1], blaming her son and overall being very aggressive towards the two of them. [WITNESS #1] then told me that he heard Darrell yell at [VICTIM #1], stating, “I have 16 reasons why I’m not worried about you,” which [WITNESS #1] believed that Darrell was referencing him having a firearm.

I then went and spoke with Ms. [WITNESS #2] about the incident to ask what she had seen. [WITNESS #2] then verified everything that [WITNESS #1] told me, stating that she and her two kids were entering the restaurant when Darrell began yelling at [REDACTED BY AGENCY] and his mother and causing a scene inside the establishment. She stated she was simply trying to enter the building, and [REDACTED BY AGENCY] was being polite, trying to let them in, when Darrell became very agitated and began yelling and cursing.

Sgt. Yarbrough, Ofc. Perry and I then entered the restaurant and located Darrell sitting at a booth with [WITNESS #3]. We asked Darrell to step outside and speak with us, to which he obliged. Before walking towards the door, Darrell informed us that he did, in fact, have a pistol in a holster on his side, to which we told him not to touch it or reach for it. Once outside, I asked Darrell to tell me what happened, and he told me that while they were waiting for a table, [REDACTED BY AGENCY] moved too close to [WITNESS #3] and put his butt in her face, which led to him yelling at [REDACTED BY AGENCY] and commanding him to move. Darrell then demonstrated how he yelled by yelling at me. Darrell then stated that after the situation was done, [REDACTED BY AGENCY] mother, [VICTIM #1], entered the building and told him not to speak to her child like that, to which Darrell stated that led to [VICTIM #1] and him arguing again at the front desk.

While we were standing out front speaking with Darrell, I observed Darrell swaying back and forth and being unsteady on his feet, and also observed an odor of alcoholic beverages emanating from his person. I then asked him if he had been drinking tonight, and he told me that he had had one margarita that he was drinking inside the restaurant. I then asked him to tell me about the comment he made to [VICTIM #1] about “having 16 reasons,” and he told me that he was not going to speak about that, but he did not deny it.

I then went inside and spoke with one of the managers on duty, and asked her if she had seen anything. She stated that she saw the end of the altercation but missed most of it. She then told me that she has security footage that she would be willing to provide upon request.

I then went and spoke with [WITNESS #3] about the incident, and she confirmed everything that happened and even attempted to apologize to [VICTIM #1] on Darrell’s behalf for his behavior. I asked her if they had been drinking before they got there, and she stated that they were drinking earlier in the day, and then Darrell took a nap. [WITNESS #3] then stated that after Darrell woke up, she also observed Darrell still stumbling and appearing to be intoxicated.

I then proceeded back outside to speak with Darrell again. Due to Darrell’s actions and behavior, I decided that I had probable cause to place Darrell under arrest for disorderly conduct and Public intoxication. Darrell was then placed in handcuffs, double locked, and checked for proper fit. Darrell was then searched for any weapons, contraband, or means of escape, where a black handgun (HK VP9 9MM) was located and removed from his person. The handgun was then run through GCIC in search of any wants with negative results. The back seat of my patrol vehicle was also cleared of any weapons, contraband, or means of escape with negative findings. Darrell was then placed in the rear passenger side seat of my marked patrol vehicle, with the seatbelt being placed over him and buckled in for safety.

Darrell then allowed [WITNESS #3] to retrieve his debit card in order to pay for their meal, with the debit card being promptly returned to him.

I then provided Central Dispatch with my starting mileage before proceeding to the Barrow County Detention Center. Upon arrival at BCDC, I relinquished custody of Darrell and his property to Barrow County Sheriff’s Office Correctional Officers. I then cleared the backseat of patrol vehicle #402 of any weapons, contraband, or means of escape with negative findings.

[VICTIM #1] was also provided with a business card and a case number and explained how to obtain a copy of the report if she wished.

Darrell’s black handgun (HK VP9 9MM), Black magazine, and all 16 bullets have been entered into LERMS and evidence for safekeeping, along with Property receipt # A-31115

[VICTIM #1] and [REDACTED BY AGENCY] completed witness statement forms, which are also attached to this report.

A video retrieval request form for the incident has been completed and submitted to Winder PD’s evidence technician.
