On 11/5/2021 while conducting an area check of 416 Exchange Blvd Winder GA 30680 I, Officer T. Good W130, located a suspicious vehicle behind the AMC Movie Theater.
The suspicious vehicle was a 2014 Nissan Altima bearing Georgia Registration [REDACTED]. The vehicle was occupied by a male and female. The male was in the rear driver side seat, and the female was in the front passenger seat. I spoke with both parties and was able to identify the male as [WITNESS #1], and the female as Ms. DeRyah Smith. I ran both parties through GCIC/NCIC and [WITNESS #1] had a license suspension with a limited permit, and Ms. DeRyah Smith was wanted out of Barrow County and Walton County.
Officer H. Petree arrived on scene and we directed both individuals out of the vehicle. I directed Ms. Smith to the front of my patrol car and advised her that she had a warrant. She advised that she needed to call her mother, Ms. Darshell Smith, to come and gather her belongings. I allowed Ms. Smith to call her mother as Ms. Darshell Smith was also known to be wanted out of Barrow County and Walton County. Dispatch was advised to confirm the warrants on Ms. DeRyah Smith.
I spoke with [WITNESS #1] and advised him that his Drivers License is suspended and that through his permit, he is only allowed to drive for work, school, or medical purposes. I advised him that he needed to call a licensed driver to move his vehicle, and get a ride from the location. [WITNESS #1] called [REDACTED] to pick him up and move his vehicle.
Barrow County Dispatch advised that both Barrow County and Walton County wanted to place a hold on Ms. DeRyah Smith. I advised Ms. DeRyah Smith to turn around and face my patrol vehicle. I handcuffed Ms. DeRyah Smith behind the back while double locking and checking for fit. I advised Ms. DeRyah Smith she was under arrest for her warrants.
Officer A. Hill searched Ms. DeRyah Smith incident to arrest for weapons, contraband, or means of escape. The search yielded negative results. Ms. DeRyah Smith was secured with a locked seatbelt in the rear passenger seat of patrol unit 383.
At this time, [REDACTED] arrived on scene and moved [WITNESS #1]’s vehicle to a proper parking spot. [WITNESS #1] left the scene with [REDACTED].
During this time, Ms. Darshell Smith arrived on scene and did not want contact with Law Enforcement. Officer A. Hill requested dispatch confirm the warrants on Ms. Darshell Smith. She advised that she has kids at her apartment, and all she wanted was Ms. DeRyah Smith’s purse so she could get home. Ms. Darshell Smith would not put her vehicle in park when directed, and attempted to drive away. Officer H. Petree then activated his emergency lights and siren on his patrol vehicle and prevented any forward movement of Ms. Darshell Smith’s vehicle. Ms. Darshell Smith was directed out of her vehicle and promptly detained.
Officer B. Bazinet and Officer A. Hill held Ms. Darshell Smith while I handcuffed her behind the back while double locking and checking for fit. Barrow County Dispatch advised that both Barrow County and Walton County wished to place a hold. Ms. Darshell Smith was advised she was under arrest for her warrants.
Ms. Darshell Smith contacted her [REDACTED] year-old daughter at the apartment and told her to go upstairs to a neighbors apartment. Officer H. Petree was able to make contact with an upstairs neighbor [REDACTED] at [800 BLOCK] Exchange Cir Apt. [REDACTED] Bethlehem GA 30620. [REDACTED] agreed to remove Ms. Darshell Smith’s vehicle from the parking lot, and watch the children at Ms. Darshell Smith’s apartment until the father of the children could arrive at home.
Officer A. Hill searched Ms. Darshell Smith incident to arrest for weapons, contraband, or means of escape. The search yielded negative results.
I then searched Ms. DeRyah Smith’s purse for weapons, contraband, or means of escape. The search yielded negative results. Ms. DeRyah Smith had unbuckled herself and transitioned to the rear driver side of patrol unit 383, so we secured her on that side with a locked seatbelt. We then secured Ms. Darshell Smith with a locked seatbelt on the rear passenger side of patrol unit 383.
Officer H. Petree transported [REDACTED] to our location, removed Ms. Darshell Smith’s vehicle from the scene, and left the scene to stay with Smith’s children per Smith’s request.
I transported Ms. DeRyah Smith and Ms. Darshell Smith to the Barrow County Detention Center, turned them both over to Detention Staff, and completed all necessary booking paperwork.
I conducted a back seat check of patrol unit 383 for weapons, contraband, or means of escape both prior to and after transport. The search yielded negative results.
