On Thursday, September 30, 2021, at approximately 00:16 hours I observed a gold Toyota Camry in the parking lot if 175 Second Street Winder, Georgia 30680 (Victor Lord Park). The park closes at sunset. I got out with the vehicle because it was after sunset.
When I approached the vehicle I made contact with four adult males in the vehicle. When I approached the vehicle I saw smoke coming from inside the vehicle and smelt the odor of marijuana coming from inside the vehicle. I asked the four individuals for their Identification. All four individuals handed me their identification. I explained to them that the park closes after sunset. They asked if there was a sign, I replied with yes. I asked the individuals if they had been smoking tonight and one of them advised me no.
I advised the individuals to wait in the car while I returned to my marked patrol vehicle, where I ran the four individuals and identified them as Mr. Evan Abbott, Mr. [WITNESS #1], Mr. [WITNESS #2], and Mr. [WITNESS #3]. All four subjects came back on GCIC. I returned to the car and asked each person out of the vehicle one at a time.
I spoke with each one individually. I told them all as I was speaking to them that I smelled marijuana and saw smoke coming out of the vehicle when I first walked up. I then asked each one individually if they had been smoking tonight. They all replied with yes that they smoked tonight. I asked all of them together if there was anything else in the car. They stated that there was no other drugs in the car. Mr. Abbott stated that he did have a grinder in his book bag in the front passenger seat of the vehicle.
I then did a probable cause search of the vehicle. I searched through the vehicle, I did not locate any other drugs. I did locate the grinder, a pack of Juicy Jay’s rolling paper, and a zip-loc bag with marihuana shake in it. These items were located in the book bag that Mr. Abbott said they were in.
I then placed Mr. Abbot under arrest for drug related objects. I placed Mr. Abbott in properly fitted double locked handcuffs behind the back. I then placed Mr. Abbott in the back seat of my patrol car.
I then asked Mr. [WITNESS #1], Mr. [WITNESS #2], and Mr. [WITNESS #3] how they planned on getting home tonight since the had smoked marijuana. They stated they would call their parents. They all called their parents, I explained to their parents what the situation was as they showed up.
I then got Mr. Abbott out of my patrol car and searched him for any weapons or contraband. None was found. I then placed Mr. Abbott back in the back seat and belted him in with a lap and shoulder belt.
I transported Mr. Abbott to Barrow County Detention Center where he was turned over to jail staff. I completed a WPD Property receipt (A-23502) for the zip-loc bag, grinder and rolling paper. I entered these items into LERMS. The evidence was placed into Winder PD Evidence Locker # 008.
Mr. Abbott was issued a citation for possession of drug related materials. (Citation# WC27900)
The backseat of my patrol car was checked before and after transport for contraband. None was found. Pictures were taken. I was wearing body camera 142.
