On June 13th, 2026, at approximately 11:23 PM, I, Ofc. Pierce responded to [100 BLOCK] Duke St, Winder, GA 30680 in reference to a dispute. I responded to the scene CODE 1 in marked patrol unit 441 to meet with the caller, Ms. [WITNESS #1].
Upon arriving at the scene, I located the suspect, later identified as Mr. Gary Milsap, in the backyard of the residence. Gary appeared to be heavily intoxicated as he could be audibly heard slurring his words, as well as his inability to stand up without stumbling. Other WPD officers on the scene began to order Mr. Milsap from the backyard and subsequently detained Mr. Milsap, while I spoke with the caller.
Ms. [WITNESS #1] stated that her uncle, Mr. Milsap, has been intoxicated at the residence all day, and she and Gary’s sister, Ms. [WITNESS#2], have been trying to get him to leave all day. Ms. [WITNESS #1] stated that Gary finally left the residence prior to calling 911; however, Gary walked up the street a little way before brandishing a knife and stating, “try me” before walking back to the residence and stabbing a nearby bush in the front yard of the residence, while Ms. [WITNESS #1] and Ms. [WITNESS #2] were outside. Ms. [WITNESS #1] then stated that Gary jumped the fence into the back yard and began hugging and playing with the dogs after being asked to leave the residence for approximately 30 minutes. Ms. [WITNESS #1] stated that she knows Gary had consumed alcohol, but is not sure what else “he is on” and has never seen him act this way.
At this point, I found sufficient probable cause to charge Mr. Milsap with the following citations:
-WC92081 Disorderly Conduct
-WC92082 Refusal to leave
The rear seat of my patrol unit was searched for weapons, contraband, or means of escape, with none having been located. Mr. Milsap was then advised he was being placed under arrest and transferred to my marked patrol unit, where he was seat belted in for Transportation. (Mr. Milsap had already been placed into properly fitted and double locked handcuffs behind his back and was searched for weapons, contraband, or means of escape by Ofc. Melniciuc, with none having been found). During this time, I detected the odor of an alcoholic beverage emanating from Mr. Milsap’s person.
Mr. Milsap was then transported to the BCDC, where he was turned over to the BCDC staff without incident. Copies of Mr. Milsap’s citations were also turned over to the BCDC staff to be placed into Mr. Milsap’s jail property.
Prior to leaving the BCDC, I completed all required booking paperwork as well as an arrest booking report. The rear seat of my patrol unit was also searched for weapons, contraband, or means of escape, with none having been located.
I was wearing my department-issued body-worn camera for the investigation of this incident. My in-car camera was also activated for the transportation of Mr. Milsap to the BCDC.
