On September 24, 2026, at approximately 2340 hours, I was conducting routine patrol in the area of Star Street and Christmas Avenue in Bethlehem, Georgia. While patrolling, I observed a vehicle parked in the parking lot of the Town of Bethlehem Park, directly adjacent to the playground. Because the park closes at sunset and vehicle traffic there is unusual at this hour, I initiated an investigation. I parked my patrol vehicle behind the suspect vehicle, deactivated my headlights, and approached on foot.
Upon reaching the vehicle, I observed two individuals in the backseat moving around under a blanket. When I illuminated the occupants with my flashlight, I saw it was a male and a female, it appeared they were engaged in sexual intercourse. I identified myself by announcing “Sheriff’s Office,” and instructed the occupants to exit the vehicle and provide identification. The occupants complied, providing Georgia driver’s licenses that identified them as Hannah Filyaw and Liam King. Both individual stated they were 20 years of age.
When Ms. Filyaw exited the vehicle, I observed she was wearing only a shirt. I instructed her to put on pant. I then instructed Mr. King to exit the vehicle. I observed that Mr. King was also wearing only a shirt, was completely exposed from the waist down, and had a prophylactic (condom) still on his p*nis. I instructed him to dress and step out of the vehicle. During a plain-view visual inspection of the vehicle’s interior, I observed the following: An open, empty prophylactic wrapper in the front seat area and female underwear resting on the rear floorboard.
I questioned both subjects regarding their conduct in the public park. Both stated they chose the location because their parents were at their respective residences and would not allow or condone the behavior. Deputy Simmons arrived on scene to assist. I returned to my patrol vehicle and conducted a GCIC inquiry on both individuals, which returned clear.
Based on my observations, I determined there was probable cause to arrest both individuals for Public Indecency (O.C.G.A. § 16-6-8) because of the following compounding factors:
Public Place: The acts occurred within a designated public town park directly adjacent to a children’s playground.
Open Visibility: The parking lot was completely open, and the vehicle had no window tinting.
Unobstructed View: The vehicle was fully visible from surrounding public roadways (Angel Street, Shepheard Street, and Star Street) as well as several adjacent residential properties.
Both subjects were placed under arrest. They were secured in handcuffs, double-locked, and checked for proper fit. A search incident to arrest was conducted for weapons and contraband with negative results. Per the driver’s request, the vehicle was secured and legally left parked in the lot. Both suspects were transported to the Detention Center without incident and turned over to jail staff for processing. I subsequently obtained one arrest warrant for Public Indecency for each individual.
