Officer’s Narrative:

On May 9, 2026, at approximately 1328 hours, I, Officer Gibbs, was dispatched to an accident located at 456 Jefferson Hwy, Winder, GA 30680. Central dispatch advised that a white female in a white BMW pulled into the parking lot and struck a vehicle. Central dispatch then advised that people were checking on the female. Central dispatch then advised that the female left the scene and went into the Villas at Winder neighborhood. I traveled CODE 1 to the above location in marked patrol vehicle 428.

Upon arrival, I met with a group of individuals. One male named [WITNESS #1] advised that the female had left the scene. He then showed me a picture of the vehicle. I asked him if he or anyone around was the vehicle owner of the red Chevrolet. They stated they did not know who the owner was. The vehicle owner, Ms. [VICTIM #1], then came out, and I advised that I would be looking for the individual who struck her vehicle. I advised that I would come back to get further information from her.

I then relocated to the Villas at Winder and began looking for the vehicle description. While at Ideal Place, I saw a vehicle matching the description. I notified Central Dispatch that the vehicle was located at [800 BLOCK] Ideal Place. I then exited my patrol unit and made contact with the driver. I observed damage consistent with the damage to the red Chevrolet. I observed a white female, later identified as Heather Jackson, in the driver’s seat, slumped over. I knocked on the driver’s window to get her attention. She then jumped and looked at me as she tried to open the window. I then told her that the vehicle was turned off and she could not open the window. She then opened the door and asked what I wanted. I introduced myself and explained that I was investigating a hit-and-run.

Ms. Jackson’s speech was slurred, and she would not sit up straight. She did not want to speak to me. She advised that I needed to leave her alone and had no business talking to her. She then attempted to close the driver’s side door. I advised her that I was investigating an accident and I would not be leaving. I then observed the odor of an alcoholic beverage coming from Ms. Jackson’s breath. I then observed an open wine bottle in a brown plastic bag in the passenger seat. Ms. Jackson again attempted to close the driver’s door. I then smelled the odor of an alcoholic beverage coming from inside the vehicle. Ms. Jackson declined to answer any questions I asked.

I requested Corporal Cureington to be en route CODE 3. I then asked Ms. Jackson to step out of the vehicle, but she declined. When Corporal Cureington arrived on scene, I asked Ms. Jackson to exit the vehicle, but she declined. Corporal Cureington and I then pulled Ms. Jackson out of the vehicle and placed handcuffs on her wrists, ensuring they were double-locked and checked for proper fit. I then conducted a search incident to arrest for weapons, contraband, and means of escape, with negative results. Ms. Jackson went limp and would not walk on her own. Corporal Cureington and I then walked Ms. Jackson to my patrol vehicle. I then placed a seatbelt on her for safety. She continued to yell and stated that we had no business putting handcuffs on her.

Due to the open container in plain view, Corporal Cureington and I conducted a probable cause search. While searching the vehicle, we heard banging. Corporal Cureington and I went to check on Ms. Jackson. When Corporal Cureington opened the door, Ms. Jackson was no longer in her seatbelt and had slipped one hand out of the handcuffs. Corporal Cureington pulled Ms. Jackson out of the vehicle, and while doing so, she went limp. Corporal Cureington then placed her on the ground. While on the ground, Ms. Jackson began squirming and hit her face on the ground, causing her lip to be injured. I then assisted Corporal Cureington in placing the handcuffs back on Ms. Jackson. I then assisted her back into the back seat of my patrol vehicle. Ms. Jackson began screaming loudly. Ms. Jackson hit her face on the pavement when she fell. A medical unit was called to the scene, but later canceled. Officer Flores then arrived on scene and stood by with Ms. Jackson.

I then transported Ms. Jackson to Northeast Medical Center, Barrow, to receive medical treatment. I took pictures of her injuries. I then read the Implied Consent Notice for suspects 21 years of age and older. Ms. Jackson advised that she would not take a blood test. Over the course of the investigation, Ms. Jackson did not want to answer any questions, nor did she comply with verbal commands. She initially refused any medical treatment; however, she then decided that she would let medical staff treat her.

I then transported Mrs. Jackson to the Barrow County Detention Center. Upon arrival at BCDC, Ms. Jackson and her property were relinquished to the custody of the intake deputies without incident. I then cleared the backseat of patrol vehicle 428 of any weapons, contraband, or means of escape with negative findings.

A Georgia Department of Driver Services 1205 form was completed. Ms. Jackson signed the form. The yellow copy was left with her property.

I then issued the following citations:

Pictures were later attached to the report. An accident report was completed for this incident.
