On 4/29/2026 at 1632 hours, I was dispatched to a suspicious vehicle call on University Pkwy near the intersection of Christmas Ave. I responded code 1.

On arrival, I was met by Deputy Couch who stated that the suspicious vehicle was a Freightliner tractor-trailer displaying tractor Georgia tag number [REDACTED] and trailer number from Maine [REDACTED] pulled off near the eastbound on ramp of Christmas Ave.

Couch stated that the owner of the vehicle, identified as [VICTIM #1], stated that the truck driver had only worked for him for one day. He stated that [VICTIM #1] told him that the truck driver, identified as Javier Landeros, was supposed to go to Doraville to pick up a load but went to Gainesville. [VICTIM #1] told him that he tracked the truck on a GPS device to this location. [VICTIM #1] told him that he found the driver in the cab sleeper intoxicated and beer cans in the truck. I asked Couch if he knew how long the truck had been here and he did not. He stated that there was a language barrier.

I went to the tractor trailer with a placard of Yellow Side Transportation LLC and US DOT # [REDACTED]. Couch came back and stated that [VICTIM #1] had told him that the truck had only been stopped for 15 minutes. I asked how he knew and he stated he could see it with the GPS device.

I climbed into the cab and found Landeros lying on the sleeper, but awake. I told him to come out of the cab with me. he stood and I noticed that he was wearing no shoes. I asked if he wanted to put some on. He asked me if he should and I told him that I would. He started putting on his shoes.

I detected slurred speech and the strong odor of an alcoholic beverage. I asked how long he had been here and he stated 24 hours. I knew this was not true as I had been down this stretch of road several times. I asked 24 hours and he said, “Yes, I think”. I asked what day it was and he correctly stated Wednesday. I asked where he came from and he stated Lithonia. I asked what he was doing there. He stated that he was trying to get a load. I asked if he worked for somebody and he stated that he did. I asked why he was trying to get a load if he works for somebody. I asked why his employer was not getting him the load and he said yeah. I observed one empty 20 oz Bud Light can rolling on the floorboard.

He climbed out of the cab and I told him to walk to the back of the tuck. He staggers and swayed as he walked. I had him sit on the push bumper of Couch’s patrol car.

I asked him again if he was coming from Lithonia and he stated that he was. I asked why he stopped here and he told me that he was trying to get a load. I asked again why his boss did not get him a load. He raised both hands to signify that he did not know.

I asked how much he had to drink and he stated about a six pack. I asked where he had purchased the six-pack and he stated at I-285. I asked if they were large cans and he stated that they were. He admitted that he had purchased the beers and had drunk the beers on the way here. I asked if he had done that today and he said that he had. I pointed out that he had last told me 24 hours. I told him that his employer stated that he had been here 20 minutes. Javier said, “Yeah, 20 minutes”.

He told me that he had only had a six pack today. He stated that he took no prescription drugs or illegal drugs. I asked if he had any physical problems and he stated that he did not. I asked Javier if he had any conditions that would prevent his from standing, walking, or turning. Javier stated that he did not. He told me that he wore contacts.

I asked again if he was coming from Lithonia and had bought a six-pack and agreed. I asked if he had drunk them all and he said, “Yes, pretty much.”

I told Javier I wanted to check him out to assess his ability to drive and asked if that was okay. Javier agreed to participate saying yeah.

I told Javier to stand with his feet together and his hands at his sides. I asked Javier to look forward and not move his head. I told Javier to follow my light with his eyes only. I asked Javier if he understood, and he stated that he did. Javier had difficulty following the light so I swapped it to a finger and he still had problems.

I checked for equal pupil size and detected it. I checked for resting nystagmus, but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it in both eyes. I checked for angle of onset of nystagmus and detected it at 35 degrees in both eyes. I checked for vertical nystagmus and did not detect it. I detected the strong odor of an alcoholic beverage. His eyes were bloodshot and watery. He swayed. I detected six clues.

I showed Javier a straight line and to place his left foot on it. I told Javier to place his right foot in front of it, heel-to-toe. I told Javier keep his hands at his sides and demonstrated. I told Javier to stand in that position while I demonstrated the nine step walk and turn evaluation and not to begin until told to do so. I asked if he understood, and he stated that he did. Javier had great difficulty determining his left foot from his right foot. He also had problems with lining his feet up on the line.

Javier lost balance and stepped offline and began walking before being told to begin.

I demonstrated how Javier was to take nine heel-to-toe steps remaining on the line. I explained that on the ninth step Javier was to keep his front on the line and turn around with a series of small steps with the rear foot. I explained that Javier was then to return nine heel-to-toe steps. I explained that he was to look at his feet, count his steps aloud and keep his hands at his sides. I explained that once Javier began, he was not to stop until complete. I asked Javier if he understood, and he stated that he did. I told Javier to begin.

On the first nine steps, Javier missed all heel-to-toe steps by more than one half inch and raised his arms by more than six inches. He stepped offline on steps 4. 8. 9. 10. And 11. He took a total of 12 steps. He stopped and then turned by lifting both feet. Not as demonstrated. On the second nine steps, Javier missed all heel-to-toe steps by more than one half inch and raised his arms by more than six inches. he stepped offline on steps 2, 4, 5, 11, 13, 16, 17, and 18. He took a total of 21 steps.

Javier counted no steps aloud. I asked him how many steps he took and he stated 9 or 10.

I observed two clues in the instructional stage and six clues in the walking stage.

I told Javier to stand with his feet together and his hands at his sides and he complied. I told Javier I was going to demonstrate the one leg stand evaluation. I told Javier not to begin until told to do so. I asked if understood and he stated that he did.

I demonstrated how Javier was to lift a foot of his choice approximately six inches off the ground and pointed out. I explained that he was to keep both legs straight and keep his hands at his sides. I told Javier he was to look at the raised foot and count aloud in the following manner, 1001, 1002, 1003, etc. until told to stop. I asked Javier if he understood, and he stated that he did. I told Javier to begin.

Javier put his foot down several times, raised his arms by more than six inches and swayed. He counted no steps aloud. I observed three clues in the counting and balance stage.

Deputy Arango retrieved my portable breath tester and Javier provided a breath sample that was positive for the presence of alcohol (BAC.359).

I asked Javier if he understood that he could not drink and drive. He stated that he did. I asked why he did it and he said, “I don’t know.”

I placed Javier under arrest. I read Javier the Implied Consent notice for Commercial Motor Vehicle Drivers and asked if he would take the state administered breath test. Javier refused to provide a breath sample at the detention center saying no. I reread Javier the Implied Consent notice for Commercial Motor Vehicle Drivers and asked if he would take the state administered blood test. Javier agreed to provide a blood sample at the hospital saying yeah.

I placed Javier in handcuffs, checked for fit and double-locked them. I searched Javier for contraband and found none. I placed Javier in the rear seat of my patrol car.

I spoke to [VICTIM #1] who told me that he had lost visual contact with Javier near Dacula and tracked him with the aid of a GPS device and his cellphone. He stated that he did not know that he was intoxicated. He stated that he saw the truck stop at this location on his phone at 1618 hours. He stated that when he arrived at this location and found him intoxicated he called 911 at 1632 hours. [VICTIM #1] completed a written statement that was attached to this report.

[VICTIM #1] had another driver enroute to take possession of the tractor trailer.

I transported Javier to the Barrow County detention center where I cited him for DUI (OCGA 40-6-391) and open container (OCGA 40-6-253).

I placed a 180-day temporary driving permit sticker on the back of his DUI citation.

Before shift, before placing Javier in the rear seat and prior to leaving, I checked my rear seat for contraband and found none.
