On November 25th, 2021, at approximately 2313 hours, I responded code one to [1200 BLOCK] Autumn Avenue in reference to a domestic dispute.

Upon arrival, I met with Deputy Bauer S183. Deputy Bauer was talking to a female identified as Jessica Sheller. I made entry into the residence at [1200 BLOCK] Autumn Avenue to talk to the other half of the dispute.

I met with [VICTIM #1] inside the residence. [VICTIM #1] told me he had been dating Jessica for over a year now and they were living together. [VICTIM #1] told me they were about to drive back to their house from a family dinner when Jessica began to argue with him. [VICTIM #1] told me he was telling Jessica to throw her open beer away before they began to drive. [VICTIM #1] told me Jessica became mad with him. [VICTIM #1] said they stopped at the Shell gas station on North Broad Street. [VICTIM #1] said Jessica continued to argue with him inside the store. [VICTIM #1] said Jessica began to punch his arm.

[VICTIM #1] went on to tell me that as they arrived at their house, he attempted to separate himself from Jessica by locking the house door before she entered. [VICTIM #1] said Jessica got the spare key from in the backyard and entered the house. [VICTIM #1] told me Jessica began to push him. [VICTIM #1] said he then pushed Jessica off of him and tried to pack his belongings so he could leave. [VICTIM #1] told me they both were drinking prior to the incident occurring. I asked [VICTIM #1] if he was willing to cooperate with prosecution of Jessica. [VICTIM #1] told me he did not. I explained Georgia’s Family Violence Act to [VICTIM #1]. [VICTIM #1] provided a written statement that will be turned into the Barrow County Sheriff’s Office’s Criminal Investigation Division. In [VICTIM #1]’s written statement he wrote, Jessica pushed and punched him several times before he pushed her away.

While talking to [VICTIM #1], I asked him if he had any visible marks on his body from the altercation. I noticed [VICTIM #1]’s right eye was swollen. [VICTIM #1] removed his shirt and I noticed red marks on his chest. [VICTIM #1] had an open wound on his lower back and a large scratch across his lower back. Pictures of [VICTIM #1]’s torso and back were placed into evidence at the Barrow County Sheriff’s Office.

I then met with Jessica. I asked Jessica to explain what occurred. Jessica told me they were coming home from her parent’s house when [VICTIM #1] began to argue with her because she wanted to stay at her parent’s house. Jessica said [VICTIM #1] kept saying she loves to play the victim. Jessica told me they stopped at the Shell gas station on North Broad Street to get a vape pen. Jessica said once they got home, [VICTIM #1] locked her out of the house. Jessica told me she got the spare key from the back yard and entered the house. Jessica then said she attempted to have a conversation with [VICTIM #1]. Jessica told me [VICTIM #1] then pushed her to the ground and held her down by her throat. Jessica said [VICTIM #1] threw her out of the house and she called 911.

There were no visible marks on Jessica’s person.

I went back into the residence to talk with [VICTIM #1] again. I asked [VICTIM #1] if he put his hands around Jessica’s throat at any point in the altercation. [VICTIM #1] told me as he was pushing Jessica away, his hand was on her throat, but once she was off of him, he removed his hand from her throat.

Due to the visible marks on [VICTIM #1]’s person, I placed Jessica in handcuffs behind her back, checked for correct fit, and double locked them. I informed Jessica she was under arrest for Battery Family Violence. I conducted a search incident to arrest of Jessica’s person. No contraband was located. I placed Jessica in the backseat of my patrol car where I placed a seatbelt on her for her safety.

Jessica was transported to the Barrow County Detention Center where she was turned over to detention staff without incident. The back seat of my patrol car was searched before and after transporting Jessica. No contraband was located. [VICTIM #1] was given a family violence packet, informed of services available to him, and a case number.

Probable cause supported the following charge for Jessica.

OCGA 16-5-23.1: The visible red marks and open cut on [VICTIM #1]’s chest and back support the charge of Battery Family Violence.
