[NARRATIVE #1 on May 01, 2026]
On May 1st, 2026, at approximately 1:43 AM, I, Ofc. Pierce responded to [100 BLOCK] Horton St, Winder, GA 30680, regarding an accident with no injuries. I responded to the scene CODE 3 in marked patrol unit 441 to meet with the caller, Ms. [REDACTED].
Upon arriving at the scene, I located Ms. [REDACTED] as well as Ms. [VICTIM #1], in the roadway, in front of this address. [REDACTED]’s mother, [VICTIM #1], stated that they were inside the residence of [100 BLOCK] Horton St, attempting to turn in for the night, when Mr. Jonathan Tucker’s 2011 Red Ford Focus bearing GA plates [REDACTED] pulled into the driveway. I then asked if either [VICTIM #1] or [REDACTED] knew Mr. Tucker, to which [VICTIM #1] stated that she knew Mr. Tucker, but stated that it had been a long time since he had been over to the house, indicating that he had not been invited over this night.
[VICTIM #1] then stated that she had come out of the home to see what was going on, when Mr. Tucker had said some explicit things that she did not wish to repeat in front of her grandson, and stated that Mr. Tucker then pulled down his pants and did not have any “drawers” on. [VICTIM #1] then stated that Mr. Tucker had gotten back into his vehicle and was noted to be clearly intoxicated at the time. [VICTIM #1] stated that Mr. Tucker had placed his vehicle in drive and was dragging the rear two wheels down the gravel driveway because the parking brake was left on, as evidenced by the long skid marks. [VICTIM #1] then stated that Mr. Tucker’s vehicle was swaying back and forth down the driveway and even ran up on an embankment in the driveway, causing the vehicle to almost roll over.
[VICTIM #1] then noted that Mr. Tucker’s vehicle came close to another home at the end of the driveway but never made contact. [VICTIM #1] stated that Mr. Tucker drove down the driveway of [100 BLOCK] Horton St, before realizing that is not where he needed to go, and backed up over a stone ledge by the mailbox, damaging the rear bumper of the vehicle, before taking off down Horton St, towards W May St. [VICTIM #1] noted that Mr. Tuckers vehicle was running into the ditches on the sides of the road as he was driving down Horton St. [VICTIM #1] stated that Mr. Tuckers vehicle had struck multiple trees however, I was unable to find any evidence of this on nearby trees.
This information was then turned over to Ofc. Harris to aid in his investigation of this incident.

[NARRATIVE #2 on May 02, 2026]
On 5/2/2026 at approximately 0143 hours, Sgt. N. Wolfe W160, Ofc. G. Pierce W153, Ofc. P. Melniciuc W151 and I, Ofc. B. Harris W152 was dispatched to [100 BLOCK] Horton St, Winder, GA 30680, regarding an intoxicated driver who was reportedly hitting fixed objects in a burgundy Ford car and driving all over the road. I responded CODE 3 (lights and sirens activated) in marked patrol vehicle #400.
Dispatch advised that the caller, [REDACTED], stated the vehicle was traveling on Horton St away from S Broad St, so I traveled down Lily Dr and turned left onto Horton St, where I observed the suspect vehicle traveling towards me in the opposite lane with no headlights on. I already had my lights and sirens activated, so I spun around, got behind the suspect vehicle, and observed the vehicle failing to maintain its lane. The driver, later identified as Johnathan Tucker, turned left onto Marion Lay St and came to a stop in front of [10 BLOCK] Marion Lay St, Winder, GA 30680.
As I was exiting my patrol vehicle, Mr. Tucker began to exit the vehicle with his pants pulled down below his butt. As I was telling Mr. Tucker to get back in the vehicle (as I didn’t tell him to exit), I observed that he was unable to stand up straight without wobbling or keeping his balance. Mr. Tucker finally got back in the vehicle, and as I approached the vehicle, I could smell a strong odor of an alcoholic beverage emitting from the vehicle. As I got to the driver’s side door, Mr. Tucker again exited the vehicle. At this time, Sgt. N. Wolfe and Ofc. P Melniciuc arrived on scene. Mr. Tucker began yelling incoherently at a random passerby in the neighborhood. At this time, I observed the strong odor of an alcoholic beverage emanating from Mr. Tucker’s breath, along with slurred speech when he turned to speak to us.
Sgt. N. Wolfe and Ofc. P. Melniciuc told Mr. Tucker to turn around and place his hands behind his back, all the while he was yelling incoherently. Mr. Tucker was placed in properly spaced, double-locked handcuffs behind his back and was advised he was under arrest for Driving Under the Influence. Sgt. N. Wolfe and Ofc. P. Melniciuc then walked Mr. Tucker to the front of my patrol vehicle and searched Mr. Tucker’s person for weapons, contraband, and means of escape with negative findings. Mr. Tucker was then placed in the rear-passenger compartment of my patrol vehicle and secured using a lap-and-shoulder harness for his protection.
At this time, I observed an open container of Jack Daniel’s Whiskey with approximately 20% of whiskey left inside the bottle on the passenger floorboard. Ofc. P. Melniciuc and I began a probable cause search of the vehicle with negative findings. Barrow County Dispatch was requested to have a tow truck en route to tow the vehicle.
I notified Barrow County Dispatch that I was about to read implied consent. I asked Mr. Tucker multiple times what his age is, and all he would continuously state was “I do not submit” and “I do not submit unless I hear from the Chief.” Mr. Tucker stated that he wanted to speak to my supervisor, and that’s when Sgt. N. Wolfe identified himself again, and Mr. Tucker stated, “I do not submit to no supervisor.” I asked Mr. Tucker one more time to provide me with his age, and he stated, “I got no questions.”
I began to read the implied consent for persons over 21 to Mr. Tucker, as I had reason to believe he was over the age of 21. The whole time I was reading implied consent, Mr. Tucker said multiple times loudly, “I do not consent to any questions y’all are asking me.” As I continued to read implied consent, Mr. Tucker stated loudly, “I refuse,” but then immediately stated, “I would love to submit,” and repeated that multiple times. Mr. Tucker then stated multiple times, “I would love to submit as long as my lawyer is present.” I explained to Mr. Tucker that that’s not how this works and that I need a yes or a no for consent to a breath test. Mr. Tucker then would not give me an answer.
I then read the implied consent for persons over 21 to Mr. Tucker again, this time for blood. While reading implied consent, Mr. Tucker repeatedly stated: “I would love to submit to a hospital test.” Mr. Tucker gave me a yes when asked if he would consent to a blood test. Mr. Tucker kept saying that his wallet was in his back pocket, when in fact, it was not in his back pocket nor in the vehicle. Mr. Tucker then stated that he wanted to go to the Braselton hospital. When Sgt. N. Wolfe and I explained to Mr. Tucker that we won’t be going to Braselton, Mr. Tucker stated, “Fu*k you.”
Ofc. G. Pierce advised me that [VICTIM #1], who lives at [100 BLOCK] Horton St, witnessed Mr. Tucker with his pants down, exposing himself in the driveway of the home. Ofc. G. Pierce also advised me of the trees and other objects that Mr. Tucker hit with the vehicle. Please see Ofc. G. Pierce’s supplemental report for further information. As I took pictures of Mr. Tucker’s vehicle, I observed large paint chips and scratches on the front bumper as well as down the passenger side of the vehicle. I also observed that the passenger side front tire was covered in wet mud. There were also mud spots down the passenger side of the vehicle. I then conducted an inventory check of the vehicle.
As I began working on the impound report in my patrol vehicle, Mr. Tucker stated, “I hope you get used to me before we get to the Barrow County Jail, before the cuffs come off.” Mr. Tucker then stated, “I hope you like fu*kin’ that bit*h you just called on your personal phone. We will be checkin’ your personal phone.” I, in fact, hadn’t made a call on my personal phone. Mr. Tucker began asking repeatedly what he was under arrest for again. I attempted to explain the charges, but Mr. Tucker kept talking over me. I asked Mr. Tucker if he was going to let me talk, and he stated, “No, sir.”
I began to read implied consent for blood again to confirm, as Mr. Tucker would not agree to implied consent, then would agree, then would not agree, then would agree again. As I was reading implied consent, Mr. Tucker kept yelling, “I would love to go to the Winder hospital,” and also stated, “I hope you like fu*kin’ em, the same bit*h that called you and fu*ked on me.” When asked if he would consent to the chemical test of his blood, Mr. Tucker stated multiple times, “At the hospital.” I continued working on the impound report, and I asked Mr. Tucker what a good phone number was for him, and he stated, “I ain’t got sh*t for you, cuh.” I told Mr. Tucker that I found a phone number of his, and he stated, “I bet you do, all you’re gonna do is take me to jail, so fu*k you.” Mr. Tucker continued yelling incoherently in the back seat.
Myles Wrecker service arrived on scene and towed the suspect vehicle away. The tow driver received a copy of the vehicle impound sheet. Myles Wrecker service left with no further incident. At approximately 0225 hours, I transported Mr. Tucker to Northeast Georgia Medical Center Barrow, to complete the blood test process. Mr. Tucker continued yelling incoherently the whole ride to the hospital, which in turn caused my vehicle to smell like the odor of an alcoholic beverage.
At approximately 0231 hours, all units arrived at NEGMC Barrow. Once in the laboratory, the handcuffs were removed from Mr. Tucker as other officers stood by with him. I filled out the necessary paperwork for the nurse to draw Mr. Tucker’s blood. When it came time for me to explain the hospital blood draw consent form, Mr. Tucker was uncooperative. Sgt. N. Wolfe and I tried to explain to Mr. Tucker that we needed him to sign the form since he had agreed to implied consent. Mr. Tucker then stated, “I didn’t agree to nothin’.” Mr. Tucker then stated, “If you tell me the nurse’s name, then I would belove to provide her with my blood, alcohol, whatever she wants.” We explained to Mr. Tucker that the nurse doesn’t have to provide her name, nor do we. Mr. Tucker continuously stated that he would only give his blood if he knew the nurse’s name.
Again, I asked Mr. Tucker to sign the form, and he stated, “I’m not signin’ nothin’.” Sgt. N. Wolfe then placed Mr. Tucker in properly spaced, double-locked handcuffs behind his back and walked out to my patrol vehicle, where Mr. Tucker was secured using a lap-and-shoulder harness for his safety in the rear-passenger compartment.
I then transported Mr. Tucker to the Barrow County Detention Center. Mr. Tucker continued yelling incoherently during the drive to the Barrow County Detention Center. Upon arrival at the Barrow County Detention Center, Mr. Tucker was released from my custody to the detention center staff without further incident. The booking paperwork was completed while at the Detention Center. The 1205 form was also completed at the Detention Center. I walked back inside to attempt to have Mr. Tucker sign the 1205 form. Upon reaching the cell where Mr. Tucker was being held, I observed Mr. Tucker sitting on the floor, yelling. I attempted to explain the 1205 form to Mr. Tucker, but he continuously shouted over me. I asked Mr. Tucker to give me 2 minutes to explain the form, but he declined.
After spending approximately 3 mins attempting to explain the 1205 form and trying to get Mr. Tucker to sign, Mr. Tucker would not cooperate and refused to sign. A check of my Patrol vehicle #400 for weapons, contraband, and means of escape was completed before placing Mr. Tucker in my patrol car and after releasing him to the detention center staff, with negative findings.

Copies of all citations and of the 1205 form were left with Mr. Tucker’s property at the Detention Center. I was unable to take the Mr. Tucker’s physical license as he did not have his wallet on his person or in the car.
