On 09/02/2025 at 2114 hours, Ofc. Dutcher and Ofc. Gibbs were dispatched to [300 BLOCK] Mobile Drive, Winder, GA, on a suspicious activity call. The caller advised dispatch that a Hispanic male came up to him cussing at him, appeared to be intoxicated, and left on foot, walking toward the front of the neighborhood.
Ofc. Gibbs arrived on scene and advised that the male was bald, with tattoos, wearing black shorts and no shirt. I arrived in the area and, as I turned from Fairview Ave onto Sanders Circle, I observed a male matching that description walking southbound across Sanders Circle. I used my spotlight to illuminate the male, and the male instantly started running away. I activated my emergency lights and exited my patrol car, telling the male to “Stop” and “Police”.
The male, later identified as Jose Chavez, ignored my commands and continued running southbound in between the trailers toward Mobile Drive. I advised dispatch of the foot pursuit and direction of travel. I gave him another command to stop, and I advised him that he was going to get tased. I drew my department-issued taser and began pointing it at him. The male then stopped at Mobile Drive and turned around, telling me to tase him.
I began giving him loud verbal commands to get on the ground. Mr. Chavez obeyed my commands and got down on his stomach with his hands out. Ofc. Melniciuc, who was right behind me, came and handcuffed Mr. Chavez behind his back. The handcuffs were double-locked and checked for proper spacing. Mr. Chavez had extremely slurred speech and a strong odor of an alcoholic beverage emitting from his person.
Mr. Chavez was taken by Ofc. Melniciuc and Ofc. Gibbs, who searched him incident to arrest for weapons, contraband, and means of escape. Nothing was located. Mr. Chavez was placed into the back seat of Ofc. Gibbs’ patrol car.
I then walked back to secure my patrol car when a female came out of [300 BLOCK] Sanders Cir and asked what was going on with her husband. I advised her that her husband was drunk and ran from the police, so he is going to jail. Mr. Chavez’s wife confirmed that he had been over at a friend’s house drinking.
I returned and was advised that Mr. Chavez told officers that all he wanted to do was drink the beer he had. An open beer that was still cold to the touch was located near where Mr. Chavez got on the ground on Mobile Drive.
I went and spoke with the caller, [VICTIM #1], who stated he had just returned home from a date and was on the phone laughing. He stated Mr. Chavez was at the stop sign on Mobile Drive and Fairview. He stated Mr. Chavez asked him what the fu*k he was laughing at asked him why he was talking all that sh*t. He stated that Mr. Chavez told him he was going to kill him and that he was yelling at him. Mr. Chavez claimed other neighbors observed the incident but had already gone inside and to bed.
Mr. Chavez was then placed into the back seat of my patrol car and seat-belted in. I observed a strong odor of an alcoholic beverage inside my patrol car during transport. During transport, Mr. Chavez continued to apologize for running and kept stating he should have just gone home.
I transported him to the Barrow County Jail without incident, where he was issued the following citations:

#WC002072 disorderly conduct
#WC002073 obstruction
#WC002074 open container
The back seat of my patrol car was checked before and after Mr. Chavez was placed inside.
