Knowingly Driving a Motor Vehicle on Suspended, Canceled, Revoked Registration

On 29 October 2021 at approximately 2339 hours, I was traveling south on Carl-Cedar Hill Road approaching its intersection with Pierce Road in Winder Barrow Georgia. I was traveling behind a silver Nissan Frontier displaying GA tag [REDACTED]. A GCIC/NCIC check of the displayed GA tag alerted me that the vehicle had no valid insurance and suspended registration. GCIC/NCIC also alerted me to the registered owner, Joshua Adams, having something wrong with his license.
The vehicle signaled a left turn and turned onto Pierce Road. Approaching 231 Pierce Road (Church at Pierce Rd), I activated my emergency lights and siren, signaling the driver to pull over. The final stop location was 231 Pierce Road.
Contact was made with the male driver. I identified myself and requested his license. As the driver began looking for his license, I also requested vehicle paperwork and proof of insurance. The driver handed me his Georgia license, identifying him as Joshua Alexander Adams, the registered owner. Joshua advised he had no valid insurance on the vehicle. I inquired as to if he knew the vehicle’s registration was suspended as well and he advised he was aware. I then asked what was wrong with his license and Joshua advised it was no good. When asked to clarify, Joshua admitted to knowing his license was suspended.
Joshua was advised to step out of the vehicle, facing away from me. He was secured in double-locked handcuffs, checked for fit. I then read Joshua his Miranda Rights. After first getting an affirmative response he understood his rights, Joshua then agreed to talk to me about the vehicle and his license status. Joshua admitted to knowing there was no insurance on the vehicle and that the registration was suspended. A check of GA Drives revealed the registration to be suspended for no valid insurance on 2 July 2021. A check of Joshua’s license showed he was suspended for a second no insurance conviction with a violation date of 5/15/2021 and suspension date of 5/15/202.
I offered Joshua a chance to attempt to get liability insurance on the vehicle during the stop, but he was unable to do so. Joshua requested Brown’s Towing pick up his vehicle. Brown’s Towing sent All Around to pick up Joshua’s vehicle. When asked why he was driving if he knew all these things were wrong, Joshua commented he had made a dumb decision due to his girlfriend and her stepfather arguing. Joshua further stated there was no threat of physical violence; however, her stepfather often threatened to kick her out of the residence, and he thought by going to pick her up he might be able to calm the situation down.
Joshua was advised he was under arrest. Joshua was searched incident to arrest and no contraband was found. Joshua’s vehicle was turned over to All Around and a vehicle impound was completed. Joshua was seated and seatbelted in the rear seat of my patrol vehicle. He was then transported to the Barrow County Detention Center where he was released to on duty Detention Center staff. The rear seat of my patrol vehicle was searched prior to and after transport for contraband and none was found.
Joshua was issued three (3) citations for:
O.C.G.A. 40-6-10, No insurance for his operating a motor vehicle on the highways/roadways of the State with no valid insurance coverage (129472);
O.C.G.A. 40-6-15, Knowingly operating a motor vehicle with suspended registration for his operating a 1994 Nissan Frontier on Carl-Cedar Hill Road/Pierce Road while the vehicle’s registration was suspended for no valid insurance coverage (129473); and,
O.C.G.A. 40-5-121, Driving while license suspended for his knowingly operating a motor vehicle, a silver 1994 Nissan Frontier (GA tag [REDACTED]) on the highways/roadways of the State when his privilege to do so was suspended for a no insurance in the second conviction violation and suspension date 5/15/2021.
Joshua was also served with a notice of suspension. V WG 2395
