On April 30, 2026, at approximately 1814 hours, I responded Code 1 to [400 BLOCK] Hammond Rd, Statham, Barrow County, Georgia, in reference to a domestic dispute. Statham Police Department was assisting on the call, and Officer Smith (Badge #510) was the first officer to arrive on scene.

Prior to my arrival, Officer Smith detained the suspect, Juan Garcia, after the victim advised that the suspect had pulled a firearm on him. Officer Smith initially recovered the firearm and secured it. Upon my arrival, the firearm was turned over to me.

I made contact with the victim, identified as [VICTIM #1], who advised that he had been involved in a verbal argument with his stepfather, Juan Garcia, over the residence’s electrical power being turned off due to an unpaid bill.

The victim stated that during the argument, Juan Garcia retrieved a Smith & Wesson Model 10 .38 caliber revolver, serial number 75346, began waving it around, and pointed it in his direction. The victim advised that he was in fear for his safety and believed that his stepfather was going to shoot him.

The firearm was secured, and the serial number was checked through GCIC/NCIC, which revealed it was not reported stolen. The firearm was collected as evidence and placed into the Barrow County Sheriff’s Office property room.

Through the course of my investigation, I determined that Juan Garcia’s actions placed the victim in reasonable apprehension of immediately receiving a violent injury. The firearm described is considered a deadly weapon.

Based on the totality of the circumstances, probable cause exists to charge Juan Garcia with Aggravated Assault – Family Violence (O.C.G.A. § 16-5-21).

I advised Juan Garcia that he was under arrest for the above-listed charge(s). I then switched handcuffs with Officer Smith on Juan Garcia, ensuring the handcuffs were properly applied, checked for proper fit, and double-locked. Juan Garcia was placed in the rear of my patrol vehicle and transported to the Barrow County Sheriff’s Office for booking and processing. Upon arrival, he was turned over to jail staff without incident.

A check of my patrol vehicle’s rear seating area is conducted at the beginning and end of my shift for weapons and contraband, and again after each prisoner transport. The rear seating area was checked following the transport of Juan Garcia, and no weapons or contraband were located.

The identities of all involved parties were confirmed through [GCIC/NCIC / driver’s license / verbal identification]. This incident was documented and handled accordingly.
