On December 7, 2025, I responded code one, non-emergency to Applebee’s, located at 544 Carl-Bethlehem Road for an alarm call.
Upon arrival, I witnessed a silver sedan on Meridian Parkway, driving behind Applebee’s and then turning into the parking lot and parking on the side of the building to Applebee’s. Continuing with my call, I checked the doors that dispatch had informed me of, where the alarm was coming from, which were the patio doors. After confirming that both patio doors were secure and no signs of forced entry had occurred, I drove around the building to where I last saw the silver sedan.
The silver sedan, now identified as a 2016 Nissan Altima S, was bearing a Georgia registration number [REDACTED]. I then radioed dispatch to report the plates and informed them that both patio doors were secured and there was no sign of forced entry. I then got out and approached the above vehicle. I then knocked on the driver’s window of the vehicle. A male, identified as Juan Danny Perez-Perusquia, who identified himself as Daniel Perez, rolled down the window and was completely naked, covering up his privates with his blue jeans. A female, identified as [REDACTED], was in the rear passenger seat, pantless but still wearing her top. Both parties were instructed to dress themselves. I then requested Daniel’s driver’s license.
Due to a slight language barrier, [REDACTED] was translating for me and telling Daniel what I was requesting. Daniel then stated that he did not have a driver’s license. I then asked Daniel to provide me with his first and last name and date of birth. Daniel replied, “Please, just let me go, I have work.” I instructed Daniel once more for his first and last name and date of birth. Unable to understand Daniel, I asked [REDACTED] for his first and last name and date of birth, and she provided me with his information. I then requested [REDACTED] for her license. [REDACTED] complied.
A GCIC/NCIC inquiry was then run on both parties. [REDACTED]’s return was valid and clear. There was no return for Daniel. I then walked back over to the driver’s door of the vehicle and confirmed once more with Daniel that he did not, in fact, have a driver’s license. Daniel stated, “No.” Daniel was then instructed to exit the vehicle multiple times. At first, Daniel did not comply, but eventually stepped out without issue. Daniel was then instructed to turn around and place his hands behind his back, to which he complied. I then placed Daniel into handcuffs in a standing position, checked for proper fit, and double locked the cuffs. Daniel was then informed that he was currently being detained until I could fully verify he did not have a driver’s license.
Daniel was walked over to my patrol car and further questioned about whether he had a license and, if so, where it was. Daniel then stated that he did not have a driver’s license. Daniel was then searched incident to arrest for any weapons, contraband or means of escape, finding none. Lastly, Daniel was properly seatbelted and secured in the back of my patrol vehicle. Daniel was informed that he was now under arrest for the following:
Driving without a valid driver’s license
Public indecency
After speaking to other deputies on scene, they informed me that [REDACTED] stated that Daniel did not have a valid driver’s license. Once again, I approached the vehicle on the driver’s side, where Deputy Matherly was speaking with [REDACTED]. While standing beside the car with Deputy Matherly, [REDACTED] made a very clear statement that Daniel was, in fact, driving the vehicle, further confirming that Daniel was driving without a valid license. Furthermore, [REDACTED] was asked if she had anything to drink tonight because she would be allowed to drive the car away from the scene. [REDACTED] stated that she had been drinking, but could not say how much.
[REDACTED] was asked if she would voluntarily take a breath test to see whether she was okay to drive. It was made very clear to [REDACTED] that she was not in trouble and would not be after testing. It was to make sure she was under the legal limit, [REDACTED] agreed. After the test concluded, [REDACTED] called her sister to come pick her up and the car. I explained to [REDACTED] that I was being very nice and only letting her go with a verbal warning at this time, but to save stuff they were doing or about to do for the house. Daniel was then transported to the Barrow County Detention Center, where he was turned over to detention staff without issue.
The following warrants will be taken for Juan Danny Perez-Perusquia:
***O.C.G.A 16-6-8 Public Indecency – A person commits the offense of public indecency when he or she performs any of the following acts in a public place:
(1)An act of sexual intercourse;
(2)A lewd exposure of the sexual organs;
(3)A lewd appearance in a state of partial or complete nudity;
– TO WIT: Daniel Perez was completely naked in his vehicle while in the parking lot of Applebee’s in Bethlehem, Ga, between the hours of 0340-0345 on 12/07/2025
***O.C.G.A 16-11-36 Loitering or Prowling – (a) A person commits the offense of loitering or prowling when he is in a place at a time or in a manner not usual for law-abiding individuals under circumstances that warrant a justifiable and reasonable alarm or immediate concern for the safety of persons or property in the vicinity.
TO WIT: Daniel Perez was sitting in his car in the parking lot of Applebee’s, a closed business in Bethlehem, Ga., between the hours of 0340-0345 on 12/07/2025
***O.C.G.A. 40-5-20 License Required – (a) No person, except those expressly exempted in this chapter or in Chapter 6 of this title, shall drive any motor vehicle upon a highway in this state unless such person has a valid driver’s license under this chapter for the type or class of vehicle being driven.
TO WIT: Daniel Perez did knowingly and willingly drive a 2016 Nissan Altima S bearing Georgia registration number [REDACTED] to Applebee’s in Bethlehem, Ga. between the hours of 0340-0345 on 12/07/2025
Probable cause was established due to Daniel being in the parking lot of a closed business, completely nude in the front seat of his vehicle, and the testimonial evidence of Daniel driving without a valid license.
