On 10/16/2025 at approximately 1851 hours, I responded Code 3 (emergency) to the area of Arnold Rd NE and Danielle Dr in Statham, GA 30666, in reference to an accident with injuries – overturned. The caller advised that a car had flipped in a ditch and that the driver, who was wearing a gray shirt and blue jeans, was running away.

Upon arrival in the area, I received information that the driver had been observed running south on Arnold Rd NE. Myself and other deputies proceeded to check the area. A short time later, I observed a white male, wearing a gray shirt and blue jeans, running along the side of the road near [100 BLOCK] Arnold Rd NE. Upon coming to a stop, I ordered the male, later identified as Kenneth Cash, to get on the ground. Kenneth complied and was handcuffed behind his back. Checking for proper fit and double locking the handcuffs. Kenneth was informed that he was being detained.

Due to Kenneth having minor visible injuries to his head and arms, a med unit was requested to respond. While waiting for the med unit to arrive, I read Kenneth the Miranda warning to which he stated he understood and agreed to speak with me. I asked Kenneth what happened, and he stated that he had fallen asleep and flipped his car. When asked why he ran from the scene of the accident, he stated that he was trying to get home to his parents. While speaking with Kenneth, a strong odor of alcohol could be smelled coming from his person. I asked Kenneth if he had recently consumed alcohol and he stated that he had a pitcher of beer approximately one hour ago. Due to Kenneth having been involved in a rollover accident and having a visible laceration to his head, field sobriety exercises were not attempted.

After the med unit arrived and checked Kenneth, they advised that all his vitals appeared to be normal and that he was refusing to be transported to the hospital. Based on my observations, the traffic violations, the general demeanor of Kenneth, and the totality of the circumstances, I believe Kenneth was operating a motor vehicle under the influence of alcohol. I then escorted Kenneth to my patrol vehicle and informed him that he was under arrest for DUI (Less Safe). Kenneth was searched incident to arrest and no weapons, contraband, or means of escape were located. He was then placed in the rear seat of my patrol vehicle and secured with the seatbelt.

I read Kenneth the Georgia Implied Consent Notice for suspects over the age of 21. Kenneth agreed to submit to a chemical test of his blood under the Georgia Implied Consent Law.

I then returned to the scene of the accident and located two unopened cans of beer which had fallen out of the vehicle. There was also a red solo cup which had a strong odor of alcohol.

Kenneth was then transported to Northeast Georgia Medical Center Barrow to receive medical clearance for the jail. While at the hospital, the on-duty phlebotomist attempted to conduct the blood draw, but Kenneth refused to submit to any testing. Kenneth advised that without his parents or his attorney present, he would not submit to any testing.

Once cleared, Kenneth was transported to the Barrow County Detention Center where he was released into the custody of the jail staff. I searched the back seat of my patrol vehicle for contraband before and after transport with negative results.

The following citations were issued: OCGA 40-6-391(a)(1) – DUI – Alcohol (Less Safe) (Citation No: E032131); OCGA 40-6-270(a) – Hit and Run (Citation No: E32132); OCGA 40-6-8 – Failure to Maintain Lane (Citation No: E032133); OCGA 40-6-253 – Open Container of Alcoholic Beverage (Citation No: E032134).

Kenneth was also served with the Georgia Department of Driver Services Notice of License Suspension due to his refusal to submit to the State administered chemical testing after arriving at the hospital.
