Officer’s Narrative:

On September 10, 2025, at approximately 2045 hours, I was on routine patrol in Winder. On Matthew School Rd and Loganville Hwy, I responded Code 1 to a Hit and Run involving a gray 2018 Honda CR-V with GA tag# [REDACTED] which fled the scene.

Arriving on scene with the victim vehicle, a white 2012 Dodge Durango with the GA tag# [REDACTED]. [VICTIM #1] informed me that she was rear ended by a gray SUV hatchback vehicle with a tag# beginning with “[REDACTED]” and driven by a female. I was able to observe a gray paint transfer on the rear of her vehicle. I provided her with a case number and ensured there were no injuries. Meanwhile Deputy Kinney advised me that he was able to identify the suspect vehicle above using FLOCK and was heading south on Christmas Ave into Walton County.

Deputy Wright informed me that he made contact with a Monroe PD officer and they located the vehicle. Afterwards it was indicated that Monroe PD successfully stopped the vehicle and then awaited for Deputy Wright and me to arrive. Upon arrival I observed Lorella Milan, the driver, standing in front of the Monroe PD patrol vehicle. Officer Cohen of Monroe PD stated that the vehicle had recent front-end damage and could smell fluid leaking. He stated that Lorella told him that the damage was old damage.

I could see the front of the Honda CR-V was smoking in the front. Overlooking the damage, I could see white paint transfer on the front bumper. The front end of the vehicle was pushed in significantly that leaking fluid within the engine bay was causing steam. I walked up to Lorella and asked what happened. She admitted to the hit and run, stating “I fu*ked up” and proceed to tell me that she rearended the vehicle, panicked and left because she was not involved in an accident before. She told me that no one got out of the car. I could smell a moderate odor of an alcoholic beverage coming from her person.

Lorella stated she had not consumed any alcoholic beverages. I asked her if she would go through field sobriety testing with me and she agreed.

Each exercise was explained and appropriately demonstrated prior to having Lorella perform. Lorella also provided an affirmative response stating that she understood my instructions.

Horizontal Gaze Nystagmus (explained and observed);

Lorella displayed the following 6 clue(s) during the Horizontal Gaze Nystagmus exercise:

  • Lack of smooth pursuit – Left eye then right eye
  • Distinct and sustained nystagmus at maximum deviation – Left eye then right eye
  • Onset of nystagmus prior to forty-five degrees – Left eye then right eye
  • Vertical nystagmus observed

Lorella would sway to a significant degree. During this portion of testing she would take long exhales and the odor of an alcoholic beverage would emanate from her person.

Walk and Turn (explained and observed);

Prior to attempting the Walk and Turn exercise, Lorella indicated no medical problems preventing performance. A flat, smooth surface was selected, and Lorella as instructed to use a marked line on the roadway. Lorella was told to place her left foot on the line and her right foot immediately in front, with the right heel touching the toe of the left foot. Lorella was instructed to stand with her hands at her sides and not to start until instructed. I confirmed that Lorella understood the instructions, and then I instructed her to take nine steps in a heel-to-toe manner.

Lorella displayed the following 7 clue(s) during the Walk and Turn exercise:

  • Started too soon (1) time
  • Missed heel to toe at steps 1, 4 down and 2, 5 on return
  • Used arms for balance
  • Did not maintain balance
  • Improper turn: Took one large step similar to an about face
  • Incorrect number of steps: 10 Down
  • Stepped off the line at steps 1 down

One Leg Stand (explained and observed);

Prior to attempting this exercise, Lorella was instructed to stand with her feet together and arms at her sides. Lorella was asked not to begin the exercise until instructed, and she confirmed that she understood.

Lorella was instructed to raise the foot of her choice approximately 6 inches while keeping it parallel to the ground. While holding that position, she was to keep her leg straight and count out loud while looking at their toe until instructed to stop.

Lorella displayed the following 3 clue(s) during the One Leg Stand exercise:

  • Put foot down at seconds 5, 9
  • Used arms for balance
  • Swayed while balancing

During this exercise, each time Lorella placed her foot down she restarted counting instead of continuing from her previous number.

I then utilized the Portable Breath Test and had a positive result. (0.132)

Talking with Lorella, I advised her that I know she was not being honest with her previous statement about drinking. She admitted at this time that she had two beers at a friend’s house. Lorella stated she does not take any medications. Lorella stated she does not use any illegal drugs.

Based on my observations, the traffic violations and the general demeanor of Lorella led me to conclude that she was operating a motor vehicle under the influence of alcohol. Lorella was informed they were being placed under arrest. I immediately read Lorella Georgia’s implied consent notice and she agreed to a state administered chemical test of her breath.

Lorella Milan was handcuffed behind the back. The handcuffs were double locked and checked for fit. A search of her person was conducted incident to arrest. No weapons or contraband or means of escape were located. Lorella was secured in the rear seat with a seat belt.

While grabbing her phone from her vehicle, I observed a half empty case of White Claw Seltzers in the passenger seat, although no open containers were located.

Lorella was escorted to the detention center.

A search of my rear seat was conducted before and after transport. No items were found.

While at the detention center, Milan registered a BrAC of 0.130 on the Intoxilyzer 9000. (serial number 90-000602). The test was conducted by me and my permit number is 957268

Milan was charged with:

  • O.C.G.A. § 40-6-391(a)(5) – DUI Per Se – Alcohol (BAC 0.08%+)
  • O.C.G.A. § 40-6-390 – Reckless Driving
  • O.C.G.A. § 40-6-270 – Hit and Run
  • O.C.G.A. § 40-6-49 – Following Too Closely

Milan was issued a DDS 1205 form, which was explained to her, and she signed.
