Officer’s Narrative:

On November 8, 2025, at approximately 2142 hours, Officer Hambrick Badge (516) and Massey Badge (511) were dispatched to 504 Hayes Lake Road, Statham, Ga 30666 (Texaco) to a Domestic Dispute.

Upon arrival, Officers made contact with an unarmed black male who was later identified as Malik Payne, sitting in his white Volkswagen. Officers gave several verbal commands to Mr. Payne, who complied by getting out of the vehicle with his hands in the air.

Officers separated both parties and made the scene safe by recovering a handgun that was on the table that was at the entrance of the Texaco. Officer Hambrick spoke with Mr. Payne, and Officer Massey spoke with the complainant/victim, [VICTIM #1].

Ms. [VICTIM #1] stated to Officer Massey that she took the firearm and placed it on the table to keep Mr. Payne from using it. Officer Massey recovered the firearm and secured it by unloading it, rendering it inoperable, and placing it in his patrol car.

Ms [VICTIM #1] stated that Mr. Payne started an argument, which turned physical which resulting in her having redness around her neck and a busted lip.

Officer Hambrick spoke to Mr. Payne, who had a faint smell of alcohol on his breath and wanted a black/mild to smoke, but was not allowed to go back in the car.

Mr. Payne was given several voice commands to stand in front of the patrol vehicle. Mr. Payne complied and stated that he and Ms. [VICTIM #1] were out at a restaurant in Buford, Ga, and on their way back home, an argument ensued with Ms. [VICTIM #1].

Mr. Payne stated that as the argument escalated, he was struck in the face by Ms. [VICTIM #1] four times, and so he started defending himself. Officers noticed that there were inconsistencies with his story.

Officers detained Mr. Payne by placing him in the back of Officer Hambrick’s patrol car until further investigation. Mr. Payne was patted down for weapons and contraband, but none were located.

Officers made contact with the store clerk, [REDACTED], and asked if we could look at the video camera that was outside.

Officers observed Mr. Payne throwing out several items from the car and taking Ms.[VICTIM #1] purse to the dumpster. Mr. Payne was also observed placing his hands around the throat of Ms. [VICTIM #1], choking/strangling her inside his vehicle. Mr. Payne was also observed grabbing/biting the lip of Ms. [VICTIM #1]. Mr. Payne is seen a few seconds later with a handgun in his hand, and he placed it in the driver’s seat. Mr. Payne’s [REDACTED BY AGENCY], juvenile (2), is observed twice climbing/going/in/out of the car around the firearm, placing the juvenile (2) in danger.

Ms. [VICTIM #1] at some point recovered the firearm out of the reach of Mr. Payne and the juvenile (2) and placed it on the table to the right of the entrance of the store (Texaco). After viewing the video.

Officers went outside of the store (Texaco) and asked Mr. Payne to step out of the vehicle and placed him in handcuffs behind his back double double-locking them, checking for fit, and conducted a search incident to arrest and placed him in the vehicle with a lap-shoulder belt placed across his person. Mr. Payne was then read Miranda.

Officer Hambrick asked Ms. [VICTIM #1] if she felt she was in fear for her life while she was being choked, and she stated yes. I asked Ms. [VICTIM #1] to fill out a Voluntary Victim / Witness Statement.

Mr. [REDACTED] came to pick up Mr. Payne’s vehicle per his request. Mr. [REDACTED] driver’s license information was run through GCIC / NCIC, and he was able to drive off without further contact.

I, Officer Hambrick, transported Mr. Payne to the Barrow County Detention Center without incident, and a chain of custody was given to the Deputies on duty. The firearm was logged into evidence at the Statham Police Department in locker #4.
