[NARRATIVE #1 on April 25, 2026]
On 04/25/2026 at 1411 hrs, I responded code 1 (non-emergency) to 967 Carl-Bethlehem Rd, Winder, GA 30680 in reference to a hit and run report.
Upon arriving at the scene, I made contact with the caller, identified as [VICTIM #1], who was driving a GMC Sierra with Georgia license plate [REDACTED]. She reported that while she was traveling southbound on Carl-Bethlehem Road, the car in front of her went onto the grass. At that moment, a white vehicle swerved into her lane, sideswiping her vehicle from the front bumper to the back. While I was speaking with her, her husband arrived at the scene and mentioned that he had seen a white vehicle on Bill Rutledge that matched the description of the vehicle that had fled the scene.
I decided to approach the area and noticed a white Nissan Pathfinder with a Georgia license plate, [REDACTED]. As I walked up to the vehicle, I observed significant damage on the right side and saw that an airbag had deployed. Upon closer inspection, I saw a female in the driver’s seat, later identified as [WITNESS #1], who informed me that she was driving. There was also a male in the passenger seat, later identified as Marty Fouche.
I asked both of them if they required medical attention, but they both declined. I then asked [WITNESS #1] to step away from Marty to speak with her privately. She explained that they had been involved in an altercation with another vehicle but had left the scene because they were unsure of what to do. When I inquired why she didn’t call the police, she mentioned that she was currently on the phone with her insurance company to process the claim.
Based on the situation, I placed [WITNESS #1] under arrest, applied handcuffs to the back, ensured they fit properly, double-locked them, and then placed her into my patrol vehicle.
After the accident, I spoke with the passenger, Marty, who claimed he was in the passenger seat the entire time. When I questioned him about why he didn’t call the police immediately after the accident, he said he didn’t have a phone and had stepped outside to inspect the damage.
However, upon further investigation, I noticed that Marty had redness on the left side of his neck, which is typical for someone who was seated on the driver’s side of the vehicle. Additionally, the driver’s seat was positioned much further back than the passenger seat. When I asked Marty to sit in the passenger seat, his knees were cramped and did not fit comfortably. I also observed that the passenger seat was cluttered with a purse and other feminine items.
[WITNESS #1] was read her Miranda Rights and indicated that she would speak to us. She stated that Marty was the one driving the vehicle, but when the accident happened, he asked her to switch seats. She documented this account in a witness statement. Based on her statement and my observations, Marty was arrested with his hands secured behind his back, double-locked and checked for fit, and placed in my patrol car. [WITNESS #1] was unarrested.
Both parties were given Case Cards, and Hammonds ultimately transported the vehicle to their impound yard. Marty was taken to the Barrow County Detention Center, where he was handed over to jail staff without any further complications. I searched my patrol car both before and after he was placed inside it.

[NARRATIVE #2 on April 25, 2026]
Vehicle 1 was traveling northbound on Carl-Bethlem Road and was passing Englewood Road when it failed to maintain its lane. It veered into the southbound lane and side-swiped Vehicle 2 before fleeing the scene. Vehicle 1 had its airbag deployed and sustained disabling and major damage along the entire driver’s side. Hammond’s Wrecker took Vehicle 1 to the impound yard.
Vehicle 2 was traveling southbound on Carl Bethlehem when Vehicle 1 entered its lane, collided with it, and caused damage to all the driver’s side doors, both front and rear.
Neither needed medical attention and were given case cards.
I later made contact with the Vehicle 1 driver, and he was placed under arrest. Please see the case report pertaining to the arrest.
