On Friday, 11/26/2021, at approximately 2205 hrs, I responded “code 3” (emergency) to a domestic dispute located at [500 BLOCK] Saddle Ridge Dr in Bethlehem GA. While en route, dispatchers advised that the caller stated that her boyfriend put a gun to her head. Dispatchers advised that the caller stated that her boyfriend was outside the residence. The caller told dispatchers that her boyfriend still had the gun.

Upon arrival, I observed a male standing outside of the garage, talking on the cell phone. I gave the male loud verbal commands to show his hands. The male complied, was detained, and placed in handcuffs, checked for fit and double locked. I patted the male down for weapons, and I located a pocketknife in his pocket. I identified the male as [VICTIM #1]. I read [VICTIM #1] Miranda rights and he agreed to speak to me.

I asked [VICTIM #1] what happened. [VICTIM #1] stated that a verbal argument occurred because the caller/suspect, Mary Love, was upset that she could not find her Christmas wreath. [VICTIM #1] told me that he and Mary had both been drinking. [VICTIM #1] said that he and Mary were dating and that they do live together. [VICTIM #1] said that during the argument, Mary hit him multiple times and he had video of the altercation. [VICTIM #1] showed me the videos. [VICTIM #1] was taken out of handcuffs.

During the videos, I observed [VICTIM #1] and Mary verbally arguing about relationship issues and the Christmas wreath. The videos showed Mary and [VICTIM #1] arguing in the bedroom, where they both sleep. [VICTIM #1] and Mary were arguing, and Mary is refusing to let him in the bedroom. Mary hits [VICTIM #1] and his phone out of his hand. [VICTIM #1] stated that he was going to in the bedroom to retrieve his handgun in order to prevent Mary from getting to it. I asked [VICTIM #1] where he put the handgun since it was not on his person. [VICTIM #1] told me that the handgun was in his car and gave me permission to retrieve it. [VICTIM #1] went on to show another video where he and Mary are arguing about relationship issues. During this video Mary pushes [VICTIM #1] down a flight of stairs. [VICTIM #1] provided me with videos showing Mary getting in his face and both parties verbally arguing about a Christmas wreath and relationship issues. [VICTIM #1] is also seen being chased by Mary around the house, and he does push her to keep her away from him.

I spoke to Mary. Mary stated that she and [VICTIM #1] did get into a verbal argument about her Christmas wreath and relationship issues. Mary told me that she and [VICTIM #1] had been drinking this evening. Mary told me that [VICTIM #1] got angry with her, and he put a gun to her head. Mary said that while he pointed the gun to her head, they began to wrestle. Mary stated that she did push [VICTIM #1] down the stairs. I advised Mary that there was video of the altercations that took place, specifically where she pushed [VICTIM #1] down the stairs. I told Mary that in the video there was no gun at her head, like she stated.

Due to the fact that Mary admitted to pushing [VICTIM #1] down the stairs, and Mary was seen on video hitting [VICTIM #1], I established probable cause to place Mary under arrest for simple battery family violence (OCGA 16-5-23). I placed Mary in handcuffs, checked for fit and double lock. I searched Mary incident to arrest. I placed Mary in my patrol car and transported her to Barrow County Jail without incident. I transferred custody of Mary to the deputies on duty.

I charged Mary with the following charge(s):

Due to the fact that Mary was seen on video and admitted to pushing [VICTIM #1] down a flight of stairs and she was seen hitting [VICTIM #1], I charged Mary with simple battery family violence – OCGA 16-5-23.

I placed all videos into evidence at the Barrow County Sheriff’s Office. I checked my backseat before and after transporting Mary to the jail, and I did not locate any contraband.
