On 09/05/2024 at approximately 1650 hours I responded code 3 (emergency lights and sirens) to the area of Rockwell Church Road Northwest and Than Skinner Road Winder, GA 30680 in reference to a hit and run involving injuries.

Upon arrival I met with [VICTIM #1] who was driving a white Ford Escape ([REDACTED]). He advised he was traveling (eastbound) on Rockwell Church Road Northwest approaching Than Skinner Road when he saw a blue Honda Civic approach the Thank Skinner Road stop sign. He then noticed at the last second the Civic was not stopping or slowing down for the stop sign so he braced for impact. The Civic collided into the Escape.

[VICTIM #1] stated her chest was hurting but he started to get out of her vehicle to meet with the other driver who he described as being a younger white male (possibly in his 20’s) with dark brown or black hair. As [VICTIM #1] was getting out of her vehicle, the male drove the Civic away and never returned. It had front bumper damage and the front grille fell off during the collision.

While I was still with [VICTIM #1], Winder Police Officers advised they located a blue Honda Civic with front end damage and a white male driver at the Valero Gas Station (183 West Athens Street Winder, GA 30680). After I finished with [VICTIM #1], I met with Winder Officers. I was told the officers observed the male (later identified as Nicholas Iline) attempting to drive the Civic in the parking lot of the Valero but was driving over curbs. When Nicholas saw that officers noticed his driving behavior he went to a gas pump and began to pump gas. Officers noticed airbags were deployed and more damage was done to the Civic (bearing Georgia license plate of [REDACTED]).

I then spoke with Nicholas as he was sitting down by the Civic. I noticed his eyes were heavy, I could smell a faint odor of an alcoholic beverage coming from his person, his mouth was dry, his pupils were constricted, and his speech was slow as well as slurred. Nicholas stated the damage from his vehicle came from him hitting a pole. He advised that he was driving around from his house in Alpharetta and did not know where he was. I asked when he last used drugs or drank alcohol and Nicholas slowly stated he did not.

I asked Nicholas if he would participate in the Standardized Field Sobriety Test (SFST) and he agreed. I had Nicholas stand up and as he did, he stumbled. He stated he did not have medical conditions that would prevent him from prevent him performing the exercises.

SFST began
Horizontal Gaze Nystagmus (HGN) and Vertical Gaze Nystagmus (VGN): instructions and performance
I explained to Nicholas to stand with his feet together, hands down by his side, and to keep his head still. I instructed him to not move their head during the HGN/VGN and to follow the tip of my finger with their eyes only. He stated he understood my instructions. Throughout the HGN, Nicholas had equal tracking in both eyes and equal pupil sizes in both eyes. He followed the tip of my finger with his eyes and this is what I observed:

Walk and Turn: Instructional, demonstration, and performance
I instructed Nicholas to stand with his back to my marked patrol vehicle’s front bumper. I confirmed the surface was flat and dry for the imaginary line for him to walk. I told Nicholas to stand heel to toe (right in front of left) with his hands by his side, looking at his feet, and to not begin until I told him to start. I then went through the instructions of him walking heel to toe nine steps, keeping his hands by her side, looking at his feet while he walked, and to count out loud while he did the nine steps. I told Nicholas on his ninth step he would leave his left foot planted and would do a series of small steps to turn around and do the same nine heel to toe steps again. While I instructed Nicholas I stood heel to toe I demonstrated the steps and turn to him. I asked if Nicholas understood I provided to him, and he said yes. During the instructional period, I had Nicholas in the heel to toe position. He was unable to maintain his balance and stepped out of heel to toe almost the entire time. I instructed Nicholas to begin.

The following is what I observed of Nicholas during the walk and turn: He was unable to maintain his balance during the instructional phase He took 11 steps on the first path and 9 steps on the second path He turned improperly

One Leg Stand: Instructional, demonstration, and performance
I instructed Nicholas to stand with his feet together and hands by his side until I told him to move. I stood with my right foot off the ground while I instructed Nicholas. I told him he would pick whichever foot he wanted to, but he would lift his foot off of the ground six inches. I told him he would look at his foot and keep his hands by his side all while counting out loud (one thousand one, one thousand two). I told him he would keep the lifted leg straight. I advised Nicholas he would keep his foot lifted six inches off the ground and count out loud until I told him to stop. I asked him if he understood and after going through the instructions again, he stated he understood. I got my stopwatch ready for 30 seconds and had Nicholas begin.

Lack of Convergence: Instructional and performance
I instructed Nicholas to stand with his feet together, hands by his, and to keep his head still. I told him to follow the tip of my finger with his eyes only. I advised him I was not going to touch him but that I was going to get close to his nose after I circled around his face. Nicholas advised he understood. This is what I observed:

Nicholas’s left eye drifted away and his right eye crossed as I moved the tip of my finger close to the bridge of his nose.

Modified Romberg Balance: Instructional and performance
I instructed Nicholas to stand with his feet together, hands by his side, and to keep his head still until I told him to move. I instructed Nicholas when I told him to begin, he was going to lean his back and close his eyes. He then was going to silently (in his head) count to 30 seconds with his eyes closed. When he counted to 30 seconds he was to stop and tell me. I set Nicholas to stand with her head leaned back, hands to his side, feet together, and eyes closed. I got a stopwatch ready and told him to begin counting to 30 seconds. This is what I observed:

Nicholas kept his eyes closed and head leaned back. He swayed slightly as stood. Nicholas told me to stop when he reached to his 30 seconds and he was 7 seconds from my timers.

Finger to Nose: Instructional, demonstration, and performance
I instructed Nicholas to stand with his feet together, hands by his side, and to keep his head still until I told him to move. I showed Nicholas how to stand with both of his pointer fingers out and his palms facing outwards. I had him stand in the position and he followed the instructions. I showed Nicholas he was going to touch the tip of his nose with the tip of his finger with the finger I told his to do so with. Nicholas stated he understood. I instructed his when I told his to do so he was going to close his eyes and as I called out Left or Right he was going to tap the tip his pointer finger to his nose. He stated he understood. This is what I observed:

Nicholas was able to touch the tip of his nose with the tip of his finger with every pass except the last pass. The tip of his left finger touched the bridge of his nose.

SFST concluded.

PORTABLE BREATH TEST (PBT)
Nicholas was willing and provided a breath sample for the handheld Alco-Sensor. The Alco-Sensor indicated the presence of alcohol on Nicholas’ breath (0.009).

I placed Nicholas in handcuffs behind his back and advised him he was under arrest. I checked the handcuffs for proper fit and double locked them. He was searched for weapons and drugs, none were found. I secured him in seat belt in the back seat of my marked patrol vehicle. I conducted a probable cause search of the Civic and nothing was found. Due to airbag deployment, I transported Nicholas to the hospital where he was medically cleared by medical staff. I then transported him to the Barrow County Detention Center and turned him over to the staff. The back seat was searched for contraband before and after each transport. Nicholas will be cited.
