Officer’s Narrative:

On 04/08/2026 at 2026 hours, I (Sgt. Wolfe) was dispatched to a welfare check at 115 Martin Luther King Jr, Winder, GA, for a female who was requesting the police. Dispatch was advising that the female was very hard to understand, but that she was saying that somebody was smacking her a*s, and was asking her to have sex.

Upon my arrival. Code 3, I observed a female walkin from the side of the Cash and Carry convenience store. I met with the female, later identified as [REDACTED BY AGENCY], who stated she was approached by a Hispanic male, who was asking her to have sex with her, and she declined, and the male smacked her a*s and left. I asked her what the male looked like or was wearing. [REDACTED BY AGENCY] stated that the male was Hispanic, wearing blue jeans and a black shirt. I asked her where the male went, and she stated that he was still inside the store. [REDACTED BY AGENCY] stated that she wished to press charges against the male.

I entered the store and observed a male matching the description standing in front of the cashier counter. I asked him what was going on tonight. I observed a strong odor of an alcoholic beverage emitting from his person, and breath when he spoke. Mr. Jimenez Flores had bloodshot, watery eyes and appeared intoxicated. The male, later identified as Oscar Jimenez Flores, spoke broken English and had slurred speech when he spoke. Mr. Jimenez Flores stated he was playing the “ding ding” machines. I asked if he had spoken to any females tonight, and at first he stated yes, but later claimed he did not and did not speak of anything happening with a female this evening.

Mr. Jimenez Flores confirmed that he had consumed some alcoholic beverages. Mr. Jimenez Flores had trouble following directions and began walking back toward the cashier, speaking with him rather than speaking with me. I then began trying to place Mr. Jimenez Flores into handcuffs behind his back. Mr. Jimenez Flores started to tarn around on me and pull away, but I pushed him up against the counter and was able to get him into handcuffs behind his back. They were double-locked and checked for proper spacing.

I searched Mr. Jimenez Flores incident to arrest for weapons, contraband, and means of escape. In his left front pocket. I located some loose marijuana nuggets. Mr. Jimenez Flores began saying something to the time of only $10 dollars, referring to the marijuana. Mr. Jimenez Flores was then placed into the back seat of my patrol car and secured with a seatbelt.

I went back and spoke with [REDACTED BY AGENCY] further. [REDACTED BY AGENCY] confirmed that Mr. Jimenez Flores, was the male who was involved in this incident. [REDACTED BY AGENCY] stated that she was sitting next door to the Cash and Carry and was going to head into the store when Mr. Jimenez Flores approached her and began offering her money and asking her if she wanted to suck his d*ck. [REDACTED BY AGENCY] stated Mr. Jimenez Flores offered her $20 to perform that act. [REDACTED BY AGENCY] stated she refused the offer and did not wish to participate in any sexual intercourse with Mr. Jimenez Flores.

[REDACTED BY AGENCY] stated that Mr. Jimenez Flores then asked if she wanted to have sex with him [REDACTED BY AGENCY] stated that is when she began to walk away from him. She stated that when she walked away, Mr. Jimenez Flores slapped her left butt cheek with his hand. [REDACTED BY AGENCY] stated she told Mr. Jimenez Flores to leave her alone, and then called the police. [REDACTED BY AGENCY] stated she did not give permission, or want any physical contact with Mr. Jimenez Flores, nor gave him permission to touch her. [REDACTED BY AGENCY] denied any medical attention. [REDACTED BY AGENCY] then completed a written statement regarding what had occurred.

I had dispatch contact Language Line to connect me to a translator to speak with Mr. Jimenez Flores. I was able to obtain his name and date of birth. I read Mr. Jimenez Flores his miranda rights, and he was unclear if he wished to speak with me, and just said he had gone to the store. I ended my conversation with Mr. Jimenez Flores.

It should be noted that Mr. Jimenez Flores’ property, which included some loose change, a cell phone, and loose cash, was placed on the top of my patrol car when he was searched. I did not realize it was still there when I proceeded out of the parking lot of the Cash and Carry. I instantly heard the change on top of my car and stopped. The loose change was unable to be located, but the loose cash was, along with the cell phone that had fallen off. The phone’s screen was cracked and damaged. I can not say for certain that the damage occurred from falling off my patrol car, as I had not looked at the front of the phone. When I pulled it out of his pocket, I had only seen the orange back of the phone. His property was taken and turned over to BCSO staff.

I transported Mr. Jimenez Flores to the Barrow County Jail without incident.

Once back at the Winder Police Department, the marijuana had a net weight of 0.48 grams. It was given property receipt #A-28257. It was placed into evidence locker #008. A LERMS property receipt was also completed.

I obtained the following warrants for Mr. Jimenez Flores:

The back seat of my patrol car was checked before and after Mr. Jimenez Flores was placed inside.
