Officer’s Narrative:

On September 6, 2025, at approximately 2339 hours, I, ofc Melniciuc, was dispatched to [100 BLOCK] 2nd St Apt [REDACTED] Winder, GA 30680, in reference to a domestic dispute. The caller utilizing Language Line stated her partner, Oscar, had hit her with his fist and was drinking I traveled to the location code 3.

Upon arrival, Sgt Wolfe made contact at the front door. The front door opened, and upon pushing the door forward, a male, later identified as [REDACTED], began coming down the stairs. I then ordered [REDACTED] to come down. Due to [REDACTED]’s inability to speak English, I grabbed him and told him to stay outside. In doing so, Sgt Wolfe went upstairs and made contact with the caller and victim, [REDACTED BY AGENCY] Sgt Wolfe advised me to detain [REDACTED] and also called in a med unit to come and evaluate [REDACTED BY AGENCY] for her injuries.

I then detained [REDACTED] and placed him in properly fitted handcuffs, double-locking to ensure they didn’t tighten further. I then patted [REDACTED] down for any weapons. None were discovered. I then placed [REDACTED] in the back of Ofc Dutcher’s marked patrol vehicle. [REDACTED] was later transferred to my marked patrol vehicle.

I then went upstairs and made contact with [REDACTED BY AGENCY] I observed numerous red welts on [REDACTED BY AGENCY] forehead. I also observed red marks and scratch marks on her arms and back. Photographs of the injuries will be attached to this case report. Due to [REDACTED BY AGENCY] inability to speak English, her friend and roommate, [REDACTED], translated for me. I then asked [REDACTED] to ask what had happened. [REDACTED BY AGENCY] began to explain that she and Oscar Ortiz were downstairs in the living room. She then explained that she had told Oscar to go to sleep because Oscar and his friend were being loud and they had a little bit too much to drink. [REDACTED BY AGENCY] then stated Oscar was drinking alcoholic beverages and was unsure how many.

[REDACTED BY AGENCY] then advised that, after telling Oscar to go to bed, he began to get aggressive with her, and Oscar began punching her in the head with a closed fist several times. [REDACTED BY AGENCY] also stated that Oscar then threw her on the ground and started pulling her hair. I then asked [REDACTED BY AGENCY] if Oscar had put his hands around her neck, and if so, did she lose consciousness or couldn’t breathe. [REDACTED BY AGENCY] stated yes, he had put his hands around her neck, but she did not lose consciousness or the ability to breathe. [REDACTED BY AGENCY] also added that when she was on the ground in the living room, Oscar began pulling her hair and pulling her all around the living room.

I then asked [REDACTED BY AGENCY] if anyone else had witnessed the incident in the living room, and she stated that a friend was present, but none of her children were present at the time. [REDACTED BY AGENCY] also added that during the assault, Oscar had told a fiend to shut the door so no one could see, which he did and left.

I then asked [REDACTED BY AGENCY] if she was afraid that Oscar would continue to hurt her and cause bodily harm, to which she stated yes. I then asked [REDACTED BY AGENCY] if she had attempted to get up and leave while she was being assaulted, and she stated Oscar was holding her down, and she eventually got up and ran to the bathroom upstairs to hide.

During this time, a med unit arrived and evaluated [REDACTED BY AGENCY]. [REDACTED BY AGENCY] refused any treatment from the med unit.

During the investigation, it was discovered that Oscar had left the scene in a white Jeep Compass temp tag [REDACTED] prior to our arrival. [REDACTED] was undetained and released and was positively identified as a roommate of the residence and not the suspect.

[REDACTED BY AGENCY] was provided with a Peace Place Brochure, a business card, and a case number.

On September 7, 2025, at approximately 0117 hours, I, ofc Melniciuc, was dispatched to [100 BLOCK] 2nd St Apt [REDACTED] Winder, GA 30680, in reference to a follow-up. Dispatch advised she had Oscar on the line and that he was the suspect from the domestic that had occurred. I traveled to the location code 1.

Upon arrival, I spotted the white Jeep Compass temp tag [REDACTED] parked. I then asked dispatch to advise Oscar to step out of the residence. A short time later, Oscar came out. A strong odor of alcoholic beverages was emitting from his person after I approached him. I then asked him if his name was Oscar Ortiz, to which he stated yes.

Due to testimonial and physical evidence, I placed Oscar into custody for Battery Family Violence, Simple Battery Family Violence, Simple Assault Family Violence, False Imprisonment, and Disorderly Conduct. I put Oscar in properly fitted handcuffs, double-locking them to ensure they didn’t tighten further. I then conducted a search incident to arrest and check for any weapons, illegal contraband, or means of escape. Nothing was found at the time of the search. I then secured Oscar in the back seat of my marked patrol vehicle with a seatbelt.

I then drove my marked patrol vehicle, code 1, to Barrow County Jail, where Oscar was turned over to BCDC Staff.

The back seat of my patrol vehicle was searched before and after Oscar’s transport, but nothing was discovered. My body camera was activated during Oscar’s arrest and transport.

Warrants were issued for Oscar Simple Battery FV(2025-2869MW), Simple Assualt FV(2025-2868), Battery FV(2870MW), False imprisonment(2025-2871), Disorderly Conduct(2025-2875).
