[NARRATIVE #1 On September 08, 2025]

On Monday, September 8, 2025, at approximately 2356 hours, I responded Code 1 to 233 E Broad St, UPD, regarding a domestic dispute that had occurred at [300 BLOCK] Pleasant Hill Church Rd SE.

Upon arrival, I met with the caller, [VICTIM #1], who stated that she and her boyfriend, Richard Garrett, had gotten into a physical fight. She said Richard had been drinking and was paranoid about her talking to another man. She said he demanded she give him her phone, and when she refused, he snatched it from her hands. She said he then demanded her passcode, and when she refused to give it to her, he broke her iPad. He then grabbed her and held her down, trying to hold the phone up to her face for the Face ID to unlock it, but she covered her face with her hands, which made him even angrier.

She said he then grabbed her and threw her on the ground, got on top of her, and slammed her head against the floor. He then wrapped his hands around her neck and started squeezing. She said she thought she was going to die, and she started to black out. He then let up, but as she tried to get away, he grabbed her arm and pulled her back. She said he strangled her 3 or 4 times before she was able to beg him to stop, telling him she was going to die. He then got off her and went to get another beer.

Once there was space between them, she ran and grabbed her car keys, then ran outside. She said he tried to grab her again when she was running away, but she started screaming, causing him to let her go and tell her to stop screaming outside because he did not want the cops to be called. She then locked herself in her car, and he came over to the window, yelling at her. He told her if she called the police, it would ruin his life, then he placed the cell phone on top of her car, told her it was not worth it, got into his vehicle, and drove away.

Based on her statements of being strangled, I requested that a medical unit be dispatched to examine her. Once they arrived on scene, they checked her but did not see any immediate life-threatening injuries and advised her to go to the hospital for further exams.

While in the ambulance, I inspected [VICTIM #1]’s neck for any signs of strangulation and observed her skin to be very red with what appeared to be light marks beginning to show. I also observed a small cut on the back of her left elbow. She also had multiple bruises beginning to form on the back of her left upper arm. The were also some bruises beginning to form on the back of her right arm. I collected pictures of all the injuries.

[VICTIM #1] then showed me the iPad that Richard broke, and it was bent backwards, the screen was completely shattered, and there were multiple large dents in the metal housing. She advised that the iPad would cost approximately $1,000 to replace. I collected pictures of the iPad.

I then spoke to Richard over the phone, and he stated that [VICTIM #1] was the one who started everything. He said they were in bed getting ready to go to sleep when he asked for her phone so he could look up a conversation she had. He said while looking at her phone, he saw a text message conversation between her and a coworker of his, and as he went to open it, [VICTIM #1] punched him in the face and then started kicking him, trying to get the phone back.

He said they then started wrestling over the phone because she refused to allow him to see the conversation. He said at some point the phone became locked, and she refused to give him her password. He said they fought over the phone for a while, ending up on the floor. He said at one point he got up from the bed, accidentally knocking her iPad off the nightstand, causing the screen to break. He said that she eventually went outside, got in her car, and was going to leave, but he told her he would leave, placed her phone on top of her car, and left.

I then asked if he had any visible injuries, and he said he did not. I then asked him to go over the incident again, and he now stated that the iPad had been flung from the nightstand, across the room.

Based on [VICTIM #1]’s statements and the injuries she had, I developed probable cause for the following offenses: Violation of OCGA 16-5-41(a) Aggravated Assault Family Violence by grabbing [VICTIM #1], his current girlfriend, and with whom he has lived with previously, with his hands around her throat and squeezing, resulting in her being strangled, causing her to black out and think she was going to die.

Violation of OCGA 16-5-41 False Imprisonment Family Violence in violation of the personal liberty of [VICTIM #1], did (arrest) (confine) and detain said person without legal authority by holding her down while he was strangling her with his hands, and grabbing her multiple times as she attempted to leave the residence, preventing her from leaving during the domestic dispute.

Violation of OCGA 16-7-23 Criminal Damage to Property 2nd degree Family Violence by bending [VICTIM #1]’s iPad backwards, shattering the screen, and deforming the metal housing, during a domestic dispute, the value of said iPad was stated to be $1,000

Violation of OCGA 16-5-23.1(f) Battery Family Violence intentionally caused substantial (physical harm) or (visible bodily harm) to [VICTIM #1] by forcefully grabbing her arm, which resulted in visible bruising on her upper, left arm. Defendant and [VICTIM #1] are boyfriend and girlfriend and formerly lived in the same household.

Violation of OCGA 16-7-21 Criminal Trespass, Interference with Property, Family Violence by grabbing [VICTIM #1]’s phone from her hands and keeping it away from her during a domestic dispute. [VICTIM #1] and Richard are currently dating and have previously lived together.

[VICTIM #1] also told me she thought her right thumb may be broken, and she was going to get an X-ray to check when she went to the ER. [VICTIM #1] was given a family violence pamphlet, and she supplied a written statement. Richard was given the case number over the phone. Warrants for Richard’s arrest were secured for the above offenses.

[NARRATIVE #2 On September 09, 2025]

On 9-9-25 I Deputy C. Williams arrived at 4752 Hwy 129 Jefferson Ga Race Track to transport Richard Garrett on 5 Warrants for court and is being transported to the Barrow Co Jail. He was searched, restraint devices were checked for proper fit, He was placed in my Patrol vehicle and seat belted in.

We arrived at Barrow Co So without incident and he was turned over to Jail Staff. Patrol Vehicle was searched before and after transporting, contraband and none was found. Warrants was served.
