Officer’s Narrative:

On 09/20/2025 at 2250 hours, I (Sgt. Wolfe) overheard Ofc. Dutcher and Ofc. Gibbs being dispatched to a dispute call at Top Dawg Tavern located at 656 Exchange Cir, Winder, GA 30680. Dispatch advised that the caller stated two males were threatening to beat the caller up and that they were leaving on Exchange Blvd in a minivan. Dispatch then advised that the manager of Top Dawg Tavern called in, stating the two males who left were telling the caller to leave due to harassing a female.

Ofc. Gibbs arrived on scene and shortly after, requested an increased response from officers. Upon my arrival, code 3. I observed Ofc. Gibbs speaking with a male, later identified as Ryan Moen. I observed employees from Top Dawg sitting by the front door. Ofc. Dutcher arrived on scene, and I went to speak with the employees. I spoke with the manager, [WITNESS #1], who stated that Mr. Moen was inside the bar, sitting and talking with a female, whom she thought was her boyfriend. Ms. [WITNESS #1] stated that he then went to check on and talk to other guests, and Mr. Moen came outside and began talking about recipes and Charlie Kirk, and just continued on. Ms. [WITNESS #1] stated they don’t do politics and alcohol there because it just doesn’t work. Ms. [WITNESS #1] stated that the table respectfully told Mr. Moen to stop, and that Mr. Moen stated that he loved America, and the table stated that they told him to go love America somewhere else.

Ms. [WITNESS #1] stated that set Mr. [REDACTED] off, and he continued on. I asked if the group at the table were the two men who left. Ms. [WITNESS #1] stated it was the two people who left because she told them to leave. Mr. Moen then began screaming and yelling towards the employees, saying something about talking politics and that this is a free country, and that he was hit in the back. I approached Mr. Moen and told him to cut it out, and asked him if he wanted to go to jail. Mr. Moen stated no.

Mr. Moen stated that he was a veteran and he was trying to be a f*cking cop. Mr. Moen has slurred speech when speaking, and I observed a strong odor of an alcoholic beverage emitting from his person and breath when he spoke. Mr. Moen stated something about being hit in the back by the two guys and that he ran away. I then began to walk away, and Mr. Moen began cussing about something. I returned to him and he pointed to Ms. [WITNESS #1] and said, ” That’s a democrat lover right there, I swear on my life.” Mr. Moen stated, “I know the law and I’m trying to be a cop.” I again advised him that he was about to go to jail if he kept up his behavior.

I returned to Ms. [WITNESS #1], and she stated the two males at the table told Mr. Moen to leave and that they didn’t want to talk to him and for him to go back to wherever he had come from. Ms. [WITNESS #1] stated that curse words were exchanged between the group. Ms. [WITNESS #1] stated that she tried to separate the two from Mr. Moen, telling Mr. Moen to go back to his side of the bar. Ms. [WITNESS #1] stated, Mr. Moen then stated, “Who the f*ck are you, and you can’t make me.” Ms. [WITNESS #1] stated she explained to Mr. Moen that she was the manager on duty and that she could tell him. Ms. [WITNESS #1] stated Mr. Moen continued running his mouth, and she stated she had had enough. Ms. [WITNESS #1] stated he had already closed out his previous tab but had reopened a tab for one beer. Ms. [WITNESS #1] stated she had the waitress print out his open tab for the one beer and proceeded to hand it to Mr. Moen.

Ms. [WITNESS #1] stated that Mr. Moen then stated, “Who the f*ck are you to make me leave?” Ms. [WITNESS #1] then advised that she told Mr. Moen he had two options to either pay his tab and leave, and enjoy the rest of his weekend, and that she would like to have him back, but not this drunk or he could not pay his tab, not leave and she was going to call the cops and he could be arrested for disorderly conduct. Ms. [WITNESS #1] stated that the two males then began to intervene on her behalf because Mr. Moen continued his behavior and began calling her everything under the sun. I asked Ms. [WITNESS #1] how many times she asked Mr. Moen to leave, and she stated a million times and continued to give him the two options. Ms. [WITNESS #1] stated that she left to attend to other matters when employees came and got her, and stated that all three of them looked like they were going to fight.

Ms. [WITNESS #1] stated that the two gentlemen had gone to Mr. Moen, who was still at the bar, sitting down, and told Mr. Moen that he had already been asked, told to leave, and that they weren’t going to let him cause problems for the rest of the female employees in the building. Ms. [WITNESS #1] stated the two gentlemen “escorted” Mr. Moen outside, where they all smoked a cigarette and talked, and she left again. Ms. [WITNESS #1] stated she then observed all of them in the parking lot, and they were about to physically fight. Ms. [WITNESS #1] stated she did not witness what had happened and did not see them fighting before, but that they were going to.

Ms. [WITNESS #1] stated she separated the two males from Mr. Moen and told the two males to leave as they had said their boys were at homecoming and told Mr. Moen to go to the sidewalk and get off her property, because she had asked him multiple times. Ms. [WITNESS #1] then stated that Mr. Moen stated that the cops were on the way.

I then went to try and speak with Ofc. Dutcher about what Mr. Moen stated had occurred when Mr. Moen was attempting to give Ofc. Dutcher a military ID after he had already given his Georgia Driver’s License. Mr. Moen had to be told to back up multiple times before being pushed back by Cpl. Perrin. Mr. Moen began arguing with Cpl. Perrin and had to be told a couple of times to stand back by the patrol car.

At this point, I approached Mr. Moen and advised him to put his hands behind his back. I placed him in handcuffs behind his back. They were double-locked and checked for proper spacing. I then advised him he was under arrest for Public intoxication, disorderly conduct, and refusal to leave premises when requested.

I searched him incident to arrest for weapons, contraband, and means of escape. Nothing was located. I then placed him into the back of my patrol car, where he asked, “What the f*ck was wrong with me?” and that “I had f*cked up his life”. Mr. Moen was seat-belted in the back of my patrol car.

I asked Ofc. Dutcher and Ofc. Gibbs, what Mr. Moen had said occurred. Ofc. Dutcher advised me that Mr. Moen was extremely intoxicated, but stated that Mr. Moen stated he was outside with the two males talking politics, and that the males were going to their van to leave when they got back out and pushed him before getting back into their van and leaving. Ofc. Dutcher said he looked at Mr. [REDACTED]’s back, where he stated he got hit/ pushed, but did not see any marks.

I went and spoke with Ms. [WITNESS #1] again and [WITNESS #2], who was Mr. [REDACTED]’s server. They stated that Mr. [REDACTED] came to the bar around 7:30ish and provided me with his receipt from the first tab he had, which he had already paid. They stated that he had one draft Coors beer, one draft Blue Moon beer, two shots of Jager, and two shots of Patron.

I then transported Mr. Moen to the Barrow County Jail. While enroute, Mr. Moen was very agitated and vocal, cussing about being arrested and having forgotten why he was being arrested, and wanted me to explain to him again, even though I had already explained it to him. Due to his behavior, I advised dispatch to let the jail know.

Once at the Barrow County Jail, Mr. Moen was issued the following citations:
#WC002101 public drunkness
#WC002102 refusal to leave
#WC002103 disorderly conduct

The back seat of my patrol car was checked before and after Mr. Moen.
