On 1 December 2021 at 1901 hours, I responded non-emergency (code 1) to [1500 BLOCK] Mill Creek Road Bethlehem Barrow Georgia 30620 in response to a domestic disturbance call. Dispatch advised per the complainant, he and his girlfriend who has lived with him since July 2021 were trying to separate however, she would not leave with her children.
Upon my arrival at 1915 hours, I was met at the end of the driveway by a male subject. He was identified as [VICTIM #1]. When asked to explain what was going on, [VICTIM #1] advised he and his girlfriend had gotten into an argument and had decided to end the relationship. [VICTIM #1] continued by telling me her adult age children had shown up and initially refused to leave the residence but had since agreed to stay outside. [VICTIM #1] further stated his girlfriend was inside the residence packing up her clothing now. I asked [VICTIM #1] how long they had been together, and he responded by stating they have been in a relationship for almost 1 year now and she had been living with him since July of this year. I asked if she was contributing to the house and [VICTIM #1] confirmed she was. I explained to [VICTIM #1] while she was leaving voluntarily tonight, he would have to get an eviction as she had established residency. Sgt. Jordan provided a Georgia license identifying the girlfriend as Sabrina Bello Rosas. When asked if anything physical had transpired between the two of them, [VICTIM #1] denied any physical contact stating it was verbal only.
I entered the residence and met with Sabrina in the hallway. I immediately observed a redness to the right side of Sabrina’s neck. I asked her if the altercation had gotten physical and she responded yes, it had. Sabrina explained she and [VICTIM #1] had been arguing in the garage. During this time, he had attempted to contact her mother via his telephone. Sabrina indicated this upset her as she did not wish to have her mother involved in their problems and as such she stated when [VICTIM #1] would not hang up the phone, she “swatted” at his hand. Sabrina further made a slapping motion while saying this. Sabrina continued by stating [VICTIM #1] began telling her to leave and picked her up and moved her outside the garage. At some point, Sabrina re-entered the residence and the two continued arguing in the master bedroom over a phone. Sabrina stated while in the master bedroom was when [VICTIM #1] had pushed her head onto the bed by placing his hand on her neck and had risen a fist as if to strike her. Sabrina advised [VICTIM #1] did not strike her, as her adult age children arrived at the residence and were banging on the bedroom door. I left Sabrina to continue packing while I returned to speak with [VICTIM #1] again. Sgt. Jordan and I conferred, and he indicated on initial contact with Sabrina she had failed to mention anything about the phone or being grabbed/pushed on the side of the neck.
On the front porch, I confronted [VICTIM #1] about the physical altercation taking place. [VICTIM #1] reluctantly admitted to them arguing in the garage and Sabrina slapping his phone out of his hand and onto the concrete floor before she picked it up and flung it against the wall. [VICTIM #1] showed me his phone, which is a black Samsung Galaxy 21. The front and side of the phone were shattered, and the screen was flickering. When asked how much the phone cost, [VICTIM #1] advised $1,200. I then pointedly asked [VICTIM #1] how Sabrina sustained the redness/red marks on her neck, and he stated he did not know. [VICTIM #1] denied ever placing his hand on Sabrina’s neck and forcing her head onto the bed. I explained to [VICTIM #1] it was difficult for me to believe him as I had already caught him in a lie, regarding when first asked [VICTIM #1] denied any physical contact between the two.
I returned to Sabrina and had her go through the entire incident again. Her story was the same. I observed her neck to still be red and each time she was asked to explain the events, Sabrina grabbed her neck causing it to still have a reddish hue to it. In examining her neck, I noticed no distinct finger impressions normally associated with when someone is grabbed/pushed on the side of their neck. I then asked [VICTIM #1] to show me the garage. He led me there and demonstrated approximately where the two had been standing when his phone was slapped out of his hand. [VICTIM #1] stated he was unsure which wall Sabrina had thrown the phone at. Looking at the walls I was unable to decisively determine which wall if any the phone had struck.
Speaking with [VICTIM #1] in the garage he elaborated that he and Sabrina had been arguing all day long. When asked about the phone slapping, [VICTIM #1] stated it happened earlier in the day right before or after Sabrina’s children came home from school. When asked about what time this was [VICTIM #1] indicated around 2:30 pm this afternoon. [VICTIM #1] continued by stating since this incident they had sat together on the couch and talked regarding the breakup.
Sabrina was out front now and I again clarified with her that she had slapped [VICTIM #1]’s hand when he called her mother in the garage. Sabrina confirmed this and again when speaking about it made a slapping motion when speaking about the phone. When asked if she threw it, Sabrina denied doing this.
Based on the interviews and physical evidence on scene, Sabrina was identified as the predominant aggressor. She made physical contact of an insulting manner to the person of [VICTIM #1] by slapping his hand in the garage and causing his phone to fall and strike the floor. Sabrina was placed in double locked hand cuffs behind her back and checked for fit. She was notified she was under arrest for simple battery family violence and criminal damage to property in the second. Sgt. Jordan placed Sabrina in his patrol vehicle and transported her to the Barrow County Detention Center for processing. Sgt. Jordan was asked to ensure a Spanish speaking officer was present to make sure Sabrina understood the reason she was being arrested.
I remained on scene with [VICTIM #1] covering what some of the next steps in the process were. [VICTIM #1] was explained he was the victim in this case and [VICTIM #1] responded that he did not wish to pursue charges. I explained to [VICTIM #1] in family violence incidents if the predominant aggressor could be identified an arrest was required. [VICTIM #1] was provided a case card and I outlined the phone numbers present on the front of the card.
I secured the following warrants on Sabrina: simple battery family violence O.C.G.A. 16-5-23 (a), for her intentionally making physical contact of an insulting or provoking nature with [VICTIM #1] when she slapped/swatted at his hand and criminal damage to property in the second O.C.G.A. 16-7-23, for her causing damage to [VICTIM #1]’s Samsung Galaxy 21 when she slapped/swatted it out of his hand causing it to strike the concrete floor and shattering/damaging the device making it inoperable and said device is valued at $1,200.
