On 04/12/2026 at approximately 2009 Hours, I Ofc. Dutcher, J #141 was dispatched to [200 BLOCK] W Oak St, Winder GA. 30680 in reference to a Disturbance call for loud music and arguing. I traveled code 1 in my marked patrol vehicle #398.

Upon my arrival, I met with three male individuals: [REDACTED], Sean Kelley, and [REDACTED]. Upon my arrival, I noticed loud audible music playing from the residence. When I exited my marked patrol vehicle, one of the males proceeded to turn down the music and state that they turned it off. I then informed them that although I appreciate them turning down the music, they were still playing it loud enough to disturb the neighbors, and that I got a call referencing them arguing and yelling outside. All three of the males then stated that the neighbors were lying, and there was no arguing. All three of the males then became very defensive and acted like they did not want to speak with me.

While speaking with them, I observed a strong odor of Marijuana emanating from the residence that I was able to identify based on my knowledge, training, and experience. I asked the males where the odor of marijuana was coming from, and Sean Kelley spoke up, stating that it was the neighbors.

I then asked them for their identification, and all three males obliged and provided me with their identification. About this time, Sgt. Yarbrough arrived and informed me that this residence has been the source of many complaints from the neighbors, referencing the loud music and arguing. (Reference Incident number 2026-00016549). I then asked the males why they were playing the music, and they stated that they were moving out and were having one last hangout.

I then entered all three males into GCIC to verify if there were any warrants for them, with negative results. I then informed all three males of the city ordinance Disorderly House, and that if law enforcement is constantly called for problems at the residence that continue to occur, then all occupants could face legal consequences. All three of the males stated that they understood. Sgt. Yarbrough and I then left them with the warning and left the scene, returning to service.

At approximately 2106 hours, I was dispatched to [200 BLOCK] W Oak St, Winder GA. 30680 in reference to a dispute in progress. I responded code 1 in my marked patrol vehicle #398. Upon my arrival, I observed [REDACTED] and [REDACTED] in the front yard of [200 BLOCK] W Oak St, loading a van with their belongings. I was then told that the complainant [VICTIM #1] was in the rear of the lot at [200 BLOCK] W Oak.

I then made contact with [VICTIM #1] and asked her to explain what had happened. [VICTIM #1] stated that Sean Kelley was heavily intoxicated and had left his residence, went onto [VICTIM #1]’s yard, and began arguing with her and calling her a bunch of names. [VICTIM #1] stated that she told him to leave, and Sean continued screaming and yelling at her. [VICTIM #1] then proceeded to call law enforcement, and Sean left the scene by going to his property and proceeding to climb into a bedroom window attached to his own house. I then observed [VICTIM #1]’s neighbor, [WITNESS #1], approaching the scene.

I then made contact with [WITNESS #1] and asked him if he had seen anything, and he stated that he was on his half of the duplex when he heard a male start yelling. He then walked outside and observed Sean on [VICTIM #1]’s property, yelling and arguing with her. He then stated that he observed the male leave and go towards his own house when [VICTIM #1] called for law enforcement.

I then went to [200 BLOCK] W Oak St again and made contact with [REDACTED] and [REDACTED] and asked where Sean was, to which they responded he was inside. I told them to get them, and they yelled for Sean to come to the door. After several moments, Sean walked to the front door and took one step outside, but refused to exit the porch. I asked Sean several times to come off the porch and come talk to me, and he refused multiple times. At this moment, Sgt. Yarbrough and I approached Sean, placed his hands behind his back, and informed him that he was under arrest.

Sean was then placed in handcuffs, double locked, and checked for proper fit. Sean was then escorted to the front of my marked patrol vehicle, where he was searched for any weapons, contraband, or means of escape. While searching Sean’s person, I located a small cellophane-wrapped bag that contained approximately 1.57 Grams of Green Leafy Marijuana. The back seat of my patrol vehicle was also cleared of any weapons, contraband, or means of escape with negative findings. Sean was then placed in the rear passenger side seat of my marked patrol vehicle, with the seatbelt being placed over him and buckled in for safety. I then provided Central Dispatch with my starting mileage before proceeding to the Barrow County Detention Center. Upon arrival at BCDC, I relinquished custody of Sean and his property to Barrow County Sheriff’s Office Correctional Officers. I then cleared the backseat of patrol vehicle #398 of any weapons, contraband, or means of escape with negative findings.

Sean was arrested on citations for Disorderly Conduct, Disorderly House, public intoxication, and Possession of marijuana less than an ounce.

The Marijuana was entered as evidence/ placed into evidence locker #9, and given a receipt for property, as well as entered into LERMS and given a LERMS receipt as well.
