On 7/5/2025 I responded Code 1 non-emergency to [1200 BLOCK] Etheridge Dr in reference to a Domestic Dispute.
Upon arrival I met with a Sergio Macias-Serna subject. He stated that he and his wife, [WITNESS #1] had begun arguing once she arrived home from work. He stated while arguing, the family’s young kitten entered the kitchen and began climbing on things within the kitchen. He stated that the children within the home know that the cat is to stay in the back area of the house within the bedrooms, not within the kitchen or living room. He stated he called for the children to come to retrieve the cat from the kitchen, but they did not do so. He then stated that a few days earlier, he observed the cat started acting funny after eating something out of the roadway in front of their house. He then stated the next thing he knew, the cat was lying on the floor and not moving. Mr. Macias did not go into any more detail about the cat, just about the argument and how it did not get physical or overly heated between him and his wife.
While speaking with Mr. Macias, Deputy Bazinet spoke with Ms. [WITNESS #1] and her three juvenile children that were home at the time. She stated that the cat belonged to her son, and that he had been called by his stepfather to enter the kitchen and retrieve the cat because it was not supposed to be in there. She stated she then stepped out of the room for a moment while Mr. Macias and her middle-daughter were still in the kitchen. She stated she then returned to her daughter holding the cat, which was now deceased, after Mr. Macias threw it against the wall.
Deputy Bazinet then spoke with the middle child who witnessed the incident with the cat. She stated that her father got upset with the cat being in the kitchen, as well as the fact that he had been drinking and has a temper. She stated he picked the cat up by the head and threw it against the wall. She stated the cat began to shake once hitting the ground and began bleeding out of its mouth where it ultimately passed away a few moments after being thrown into the wall. She then called her older sister (also a juvenile) to call 911 and report the incident.
The cat was seen by Deputy Bazinet and a photo was also captured. The cat was deceased upon law enforcement’s arrival, as well as there being blood on the ground and on the wall, consistent with the testimony given by the middle child. Pictures of the cat and of the scene will be attached. No crimes were alleged involving the argument itself. Statements obtained by Mr. Macias were translated through the County’s provided Spanish speaking language-line and statements obtained by Ms. [WITNESS #1] were translated by her children.
Mr. Macias was placed into proper-fit, double locked handcuffs to the rear of his person and escorted to my patrol vehicle. Before entering, he was searched incident to arrest where no contraband was located on his person. I then placed him into the rear seat of my patrol vehicle and transported him to the Barrow County Detention Center where he was turned over to staff without incident.
Mr. Macias was placed under arrest for OCGA 16-12-4(d) Aggravated Cruelty to Animals and OCGA 16-5-70 Cruelty to Children 2nd Degree. The cruelty to children charge was taken after consideration and speaking with the Magistrate Court Judge on 7/6/2025 at approximately 2000 hours.
Mr. Macias did maliciously cause the death of his juvenile son’s cat by picking it up by the head and throwing it against the kitchen wall during an argument. The cat suffered fatal injuries from this action and was deceased upon Law Enforcement’s arrival on scene. Blood was located on the wall and the floor of the kitchen.
Mr. Macias-Serna did intentionally cause his wife’s daughter, [VICTIM #1], excessive mental pain by allowing her to witness the act of Aggravated Cruelty to Animals. The act witnessed was the family’s cat being thrown against the wall. The cat sustained fatal injuries. [VICTIM #1] was 14 years of age at the time of witnessing the act committed.
