Officer’s Narrative:

[NARRATIVE #1 on May 31, 2025]

On 05/31/2025 at approximately 0432 hours, Ofc. Melniciuc and were dispatched to a dispute call at 213 Exchange Blvd (Waffle House), in reference to multiple people being drunk and belligerent. Ofc. Melniciuc traveled Code 3 in his marked patrol vehicle #406.

Upon arrival, Ofc. Melniciuc noticed a Black Honda Accord matching the description given to us by Central dispatch leaving Waffle House, proceeding north on Loganville Hwy. Ofc. Melniciuc then initiated the traffic stop, leading both of us to make contact with the occupants of the vehicle. The driver was identified as Shamika Scott, the passenger was Javarus Hodge, and the backseat passenger was Kamaya Williams. While we were conducting the traffic stop, Sgt. Wolfe traveled to Waffle House to gather a better description of the people causing the disturbance. After talking to the Waffle House staff, Sgt Wolfe then informed me that all 3 parties inside the vehicle matched the description provided to them. I then asked Shamika where they were coming from, and she stated Waffle House.

I then got back with Sgt. Wolfe, asking him for a description of the incident, which he said that the 3 parties were at Waffle House when a woman (who matched the description of the driver) received food that she was not happy with because it had an eggshell in it. She then became Irate and yelled at the staff. Shamika then took her plate and threw it behind the counter, and while being confronted about it, she then spat out her food at the Waffle House employee. While Shamika and the Waffle House employee were arguing, Javarus then became irate and began arguing and yelling at the staff member as well. Javarus was threatening the employee and saying that he wanted to fight him several times before eventually going to the vehicle for an unknown reason.

Ofc. Pierce and Ofc. Gibbs also arrived at the Waffle House and verified the story that was provided to me. However, Sgt. Wolfe was originally told that Shamika, Javarus, and Kamaya were asked to leave by the staff and refused, but Ofc. Pierce was told that they were not asked to leave, so I was unable to verify that part of the incident. However, I had enough probable cause based on the three other officers’ testimony, as well as Shamika stating that she was at the Waffle House, to arrest Shamika in an attempt to gather more information. While attempting to talk to Shamika, she became very irritable and did not appear to want to cooperate, so I asked her to step out of her vehicle and placed her in handcuffs, double-locking them and checking for proper fit. I then asked, Ofc. Gibbs to perform a frisk to make sure that she didn’t have any weapons on her person. After Ofc. Gibbs frisked her, and I placed Shamika in the rear seat of the patrol vehicle, buckling the seatbelt for safety. I then began to read her Miranda Rights before proceeding with asking any questions. While I was reading Miranda, Shamika was very irate and yelling and talking over me constantly. She then promptly denied Miranda, and I ceased all questions.

I then proceeded to the vehicle and removed Javarus from the vehicle, placing him in handcuffs, double-locking and checking for proper fitness. I then escorted him to the back of Sgt. Wolfe’s vehicle, where I informed him that he would be under arrest for disorderly conduct as well. At this moment, Shamika’s cousins had walked to the scene to inquire about what was going on. Sgt. Wolfe recovered one of the cousins’ driver’s licenses to verify they were legal to drive before allowing them to remove the vehicle from the scene.

I then provided Central Dispatch with my starting mileage. I then informed dispatch that I had one in custody and provided my starting mileage before I continued to the Barrow County Jail. I then transported Shamika to the Barrow County Jail while Sgt. Wolfe transported Javarus, where we relinquished custody of both to the Barrow County Sheriff’s Office Correctional Officers.

During the traffic stop, Ofc. Gibbs identified the woman in the rear passenger seat and discovered she had a warrant. See Ofc. Gibbs supplement for further information.

Shamika, Javarus, and the other passenger have all been criminally trespassed from 213 Exchange Blvd, Winder, GA. 30680. (Waffle House). They have all been entered into LERMS.

An email was sent to the Evidence Tech, [REDACTED], to go and try to retrieve video of the incident.

[NARRATIVE #2 on May 31, 2025]

On May 31, 2025, at approximately 0433 hours, I was dispatched to a dispute located at the Waffle House (213 Exchange Blvd, Bethlehem, GA 30620). When I arrived, the caller advised that the subjects had left the scene. Winder Units found and stopped a vehicle matching the description given by the caller. I then left Waffle House to assist Officers with the traffic stop.

I assisted Officer Dutcher in detaining the driver of the vehicle. I observed a passenger in the rear seat of the vehicle. I approached the vehicle and asked her if she had her license. She explained she did not have her license on her person and proceeded to give me her name and date of birth. She identified herself as Kamaya Williams. I then told Ms. Williams that I would be right back. Upon searching Ms. Williams in GCIC/ NCIC, GCIC/NCIC showed Ms. Williams had an outstanding warrant out of Newton County for Aggravated Assault. I then asked Central Dispatch to confirm the warrant.

I then approached the vehicle and asked Ms. Williams to step out. I then instructed Ms. Williams to place her hands behind her back. I placed handcuffs around her wrists, ensuring they were double-locked and checked for proper fit. I placed two sets of handcuffs on her due to her lack of shoulder mobility. I walked Ms. Williams back to my marked patrol vehicle 380. I conducted a search incident to arrest for weapons, contraband, and means of escape with negative results. I then placed Ms. Williams in the back of my patrol vehicle. I placed a seat belt over her for safety. When dispatch confirmed the warrant was valid, I informed Ms. Williams that she was the warrant was valid.

I then transported Ms. Williams to the Barrow County Detention Center.

Upon arrival at the Barrow County Detention Center, I released Ms. Williams into the custody of the intake deputies. I filled out the necessary paperwork.

I searched my marked patrol vehicle for contraband before and after transporting Ms. Williams with negative results.

I left with no further incident.

[NARRATIVE #3 on May 31, 2025]

On 05/31/25 at 0432 hours, Ofc. Dutcher, Ofc. Melniciuc, Ofc. Gibbs and I (Sgt. Wolfe) were dispatched to the Waffle House located at 213 Exchange Blvd, Winder, GA reference to a dispute involving 8 to 9 intoxicated persons who were possibly getting ready to fight.

Upon my arrival, Code 3, Ofc. Melniciuc, Ofc. Dutcher and I observed two vehicles leaving the parking lot of the business. One was a black four-door vehicle. I made contact with the caller, [VICTIM #1], who was an employee at the Waffle House. Mr. [VICTIM #1] stated that we just passed them, referencing the people who were causing issues. I advised Ofc. Melniciuc of this information, and he stopped one of the vehicles that was seen leaving.

Mr. [VICTIM #1] stated that they came in, and he did not know if they were drunk or just having a good time. He stated that he made their food and that they were the same people whom they had issues in the past with. He advised that’s what started it off tonight regarding their issues with another cook. He advised that he was making their food, and they were yelling and being loud so much that he could not hear his waitress’s call out the orders. He advised that he had asked them to quiet down, but they began to talk back. He stated he made their food, and they started eating. He stated that a female began complaining that there was an eggshell in her food, so he offered to remake the order, and the female threw the plate down towards the dish pit.

He asked her if she would like him to remake the food, and she just began talking louder and began to spit on his face with food in her mouth. Mr. [VICTIM #1] stated that the female’s boyfriend then began accusing Mr. [VICTIM #1] of throwing something toward the female. Mr. [VICTIM #1] stated that he told the male that he literally didn’t throw sh*t at her. Mr. [VICTIM #1] stated that the male then stated that we can take it outside since you don’t want to take your ski mask off. Mr. [VICTIM #1] stated that he wears a “ski-like mask/hood” due to all the grease he is constantly working around and a lot of the smell.

Mr. [VICTIM #1] stated that they started arguing about his ski mask, and he stated that he advised the group that he wanted them to get out. Mr. [VICTIM #1] stated that he told the group that they had 5 minutes to finish up and get out or he would call the police. Mr. [VICTIM #1] stated that the group ate the rest of the food, and they left.

I confirmed with Mr. [VICTIM #1] that it was a black Honda, and he stated yes. Mr. [VICTIM #1] then advised that the female was a heavyset female wearing red and the male was dressed in black shorts and a black shirt.

I left and met with Ofc. Melniciuc, who had the vehicle stopped. The occupants inside the vehicle matched the description of the patrons who were being disorderly with Mr. [VICTIM #1]. Inside the vehicle, they had Waffle House cups and food from Waffle House. The male and female were subsequently arrested for disorderly conduct, and another female who was inside the vehicle was arrested for an outstanding warrant. All three were trespassed from the Waffle House

I transported the male, Javarus Hodge, for Ofc. Dutcher to the Barrow County Jail without incident. During the transport, Mr. Hodge was upset that he was going to jail for disorderly conduct, making statements that wouldn’t you be upset if your food was wrong, and that I couldn’t just give him a citation for the charge.

The back seat of my patrol car was checked before and after Mr. Hodge was placed inside.
