Officer’s Narrative:

On Saturday, 03/05/2022, at approximately 2144 hours I, Deputy Wyatt, responded code three (emergency lights and siren activated) to the area of Harmony Grove Church Road and Scenic Lane in reference to an accident with injuries. The driver of the vehicle was treated by EMS personnel on scene and declined being transported. After investigating the accident, the driver of the vehicle was ultimately placed under arrest for traffic related offenses.
Upon my arrival to the scene, I observed a white Toyota Rav4 bearing Georgia license plate [REDACTED] in the ditch of the southbound side of Harmony Grove Church Road. I also observed a female who was later, identified as Shelby Haney, sitting in a chair of a driveway across the roadway from the vehicle.
Shelby was driver of the vehicle when it was wrecked. I looked through the front driver window of the vehicle before going to speak with Shelby and observed an opened 12-ounce glass bottle of Bud Light Platinum in the center cup holder of the vehicle.
I then went to speak to Shelby who was being evaluated by EMS personnel. I obtained Shelby’s identifying information and asked her what happened that caused her to wreck. Shelby stated she was not familiar with the area and ran off the road which caused her to wreck.
I informed Shelby after EMS personnel finished evaluating her, I would speak with her further. when I made my initial contact with Shelby to speak with her, I could smell the odor of an alcoholic beverage emitting from her person and I could see her eyes were glassy. I went to my patrol vehicle to run Shelby’s identifying information and vehicle information through NCIC/GCIC. Shelby ultimately denied being transported to a hospital by EMS personnel.
Once EMS finished evaluating Shelby I spoke with her further in reference to her wreck. I informed Shelby I could smell the alcoholic beverage emitting from her person and that I observed a bottle of bud light in the center console cup holder of the vehicle.
I asked Shelby if she had been drinking to which she stated no, and the bottle was her boyfriend’s. I asked Shelby where her boyfriend was, and she stated she just dropped him off. I asked Shelby if she drank prior to driving her vehicle and she stated she had 1 drink at her home approximately 2 hours before taking her boyfriend home and her accident.
Shelby then stated she was not taking her boyfriend home but going to pick him up. I asked Shelby how the bottle in the vehicle was her boyfriend’s if she had not yet picked him up. Shelby stated the bottle was not hers but believes it was her boyfriend’s. Shelby stated the bottle was possibly in her car from a previous day when she got off work.
Due to the inconsistencies in Shelby’s statements, the odor of an alcoholic beverage emitting from her person, and the open container I observed in her vehicle I asked her if she would be willing to go through Standardized Field Sobriety Testing. Shelby agreed and we walked to the front of my patrol vehicle so I could conduct my SFST.
Before conducting the Horizontal Gaze Nystagmus portion of SFST I asked Shelby if she had any problems with her eyes or wore glasses or contacts. Shelby stated she has problems with her eyes and that she has neurological issues that causes her to have nystagmus in her eyes. When I asked Shelby her specific diagnosis that caused her nystagmus, she could not tell me.
Shelby proceeded to show me the nystagmus in her eyes by looking left and right. I then made multiple passes to further observe the nystagmus in Shelby’s eyes. While making these passes, I did observe nystagmus in Shelby’s eyes. Due to Shelby having what I believed to be a natural nystagmus I did not conduct SFST.
I once more asked Shelby what she had to drink and this time she stated 1 mixed Bacardi shot. I also again asked Shelby whose bottle was in the center console and this time she stated she did not know. Shelby went on to say she did not know because she does not drive her car very often.
Based on my observations of the open container inside of Shelby’s vehicle, the odor of alcohol emitting from her person, her eyes being glassy, the inconsistency in her statements, and her wrecking her vehicle I placed Shelby under arrest for DUI. Shelby was handcuffed behind her back. The handcuffs were checked for proper fit and double locked. Shelby was placed in the rear passenger seat of my patrol vehicle and seat belted in.
After Shelby was placed in my patrol vehicle I went to her vehicle and searched it for any other open containers. The following items and their locations were found during the search:
12-ounce bottle of Bud Light Platinum with some liquid still in it was located in the cup holder of the center console.
An empty 12- ounce bottle of bud light was located in the back seat of Shelby’s vehicle and another empty bottle was located in the back floorboard.
Also located in the back floorboard of Shelby’s vehicle was a box of Bud Light platinums which was open. This box had multiple unopened bottles inside of it which still had condensation on them.
After the search Shelby’s vehicle and while waiting for the tow truck to arrive on scene I read Shelby implied consent for individuals 21 year of age an older for blood. After having implied consent read to her Shelby consented to have her blood drawn.
A brief period of time after reading implied consent to Shelby, Hammond’s Wrecker Service arrived on scene and took possession of Shelby’s vehicle. I then transported Shelby to Northeast Georgia Medical Center (Barrow Campus) to have her blood drawn. Upon arrival to NEGMC I escorted Shelby to the lab where she had her blood drawn.
After having her blood drawn Shelby was escorted back to my patrol vehicle and again placed in the rear passenger seat and seat belted in. Once Shelby was again in my patrol vehicle, I transported her to the jail where she was turned over to the jail staff upon arrival without incident. After transporting Shelby, the rear passenger seat of my patrol vehicle was searched.
Shelby was issued the following citations:
DUI less safe (O.C.G.A. 40-6-391 (A)(1)) (Citation number: 131541)
Failure to Maintain Lane (O.C.G.A. 40-6-48) (Citation number: 131542)
An accident report was also completed on this incident (accident report number: 2022-00014236)
