Officer’s Narrative:

On 12/27/2021 at approximately 0226 hours I, Officer T. Good and Officer O. Flores, were conducting an area check behind Holly Hill Mall located at 189 W Athens St Winder GA 30680 and located a tent in the woods.

Upon noticing the tent, I drew my service weapon and activated the weapons light to illuminate the tent. I announced our presence to the tent and advised “Winder Police Department, make yourself known.” No response came from the tent. Officer O. Flores advised that he could hear somebody snoring within the tent and he approached and shook the tent while announcing himself. The tent was occupied by a Mr. Thomas Culberson and Ms. Sonya Bundy. I directed both subjects out of their tent and they were advised of the Urban Camping City Ordinance. I recognized Mr. Culberson and Ms. Bundy from a prior incident where Mr. Culberson had overdosed on Heroine. I asked Mr. Culberson if he was still a drug user and he advised that he was not. Mr. Culberson and Ms. Bundy both advised that we could search their person’s and belongings.

Officer B. Bazinet arrived on scene and I advised him of the circumstances. I then requested consent to search Mr. Culberson and Ms. Bundy and they both agreed to a search of their person and belongings. I searched Mr. Culberson while Officer B. Bazinet searched Ms. Bundy. I relinquished 3 pocket knives from Mr. Culberson and passed them to Officer O. Flores.

Officer B. Bazinet and I then searched the tent of Mr. Culberson and Ms. Bundy. Officer B. Bazinet located an improvised smoking device made out of an alcohol container. I located 2 cigarette packages and dumped them on the floor of the tent exposing a small black twisted off bag. I picked up the bag and it contained a hard substance. Officer B. Bazinet then detained Mr. Culberson, and Officer O. Flores detained Ms. Bundy. Officer B. Bazinet hand cuffed Mr. Culberson behind the back while double locking and checking for fit. Officer O. Flores hand cuffed Ms. Bundy behind the back while double locking and checking for fit.

Officer B. Bazinet and I then inspected the contents of the small twisted off bag. The bag contained a large shard of a white granular substance suspected to be methamphetamine.

Officer B. Bazinet then read both Mr. Culberson and Ms. Bundy their Miranda Warning to which they both agreed to answer questions. They agreed at 0240 hours. Officer B. Bazinet asked who the methamphetamine belonged to. Both parties declined ownership.

I then placed both Mr. Culberson and Ms. Bundy under arrest for possession of methamphetamine. We escorted both subjects to our patrol vehicles and Mr. Culberson stated “I didn’t even know that meth was in my cigarette pack.” No officer stated that the methamphetamine was found in a cigarette pack.

I searched Mr. Culberson incident to arrest for weapons, contraband, or means of escape. The search yielded negative results. I secured Mr. Culberson with a locked seatbelt in the rear passenger seat of Patrol Unit 383.

Cpl. K. Martinelli then searched Ms. Bundy incident to arrest for weapons, contraband, or means of escape. The search yielded negative results.

I transported Mr. Culberson to the Barrow County Detention Center and turned him over to detention staff. While the detention deputies were searching Mr. Culberson, they located in his front right watch pocket of his pants, a small clear bag containing a white granular substance suspected to be methamphetamine. Detention staff also located in his right sock, below the boot line, a zip lock bag containing a green leafy substance suspected to be marijuana.

Officer O. Flores transported Ms. Bundy to the Barrow County Detention center and turned her over to detention staff.

A back seat check was conducted of Patrol Unit 383 for weapons, contraband or means of escape both prior to and after transport. The check yielded negative results.

All necessary jail paperwork has been completed.

I processed the evidence at the police department and conducted a field test kit for both samples of methamphetamine and it field tested positive. I weighed each sample of methamphetamine and the first sample in the black bag weighed 1.25g packaged. The sample in the small clear bag weighed .24g packaged. The suspected marijuana weighed 3.83g packaged.

Mr. Thomas Culberson was charged with the following:

OCGA 16-13-30(a) Possession of Methamphetamine: Mr. Thomas Culberson did, in violation of OCGA 16-13-30(a) Possession of Methamphetamine, commit the offense Possession of Methamphetamine when he “(a)….. possess, or have under his control any controlled substance.” TO WIT: Mr. Thomas Culberson possessed in a tent in which he was residing, a cigarette package containing a small, twisted off, black bag containing a 1.25g of a white granular substance suspected to be methamphetamine. Mr. Culberson also possessed in the front right watch pocket of the pants he was wearing a small clear plastic bag containing .24g of a white granular substance suspected to be methamphetamine.

OCGA16-13-2(b) Possession of Marijuana Less than 1 Ounce: Mr. Thomas Culberson did, in violation of OCGA 16-13-2(b) Possession of Marijuana Less than 1 Ounce, commit the offense Possession of Marijuana Less than 1oz, when he was in possession of less than 1 ounce of marijuana. TO WIT: Mr. Thomas Culberson had within his right sock a clear plastic bag containing 3.83g of a green leafy substance suspected to be marijuana.

OCGA 42-5-15 Crossing Guard Lines of Correctional Facilities with Weapons, Intoxicants, or Drugs: Mr. Thomas Culberson did, in violation of OCGA 42-5-15 Crossing Guard Lines of Correctional Facilities with Weapons, Intoxicants, or Drugs, commit the offense Crossing Guard Lines of Correctional Facilities with Weapons, Intoxicants, or Drugs when he “(a)come inside the guard lines established at any state or county correctional institution with a gun, pistol, or any other weapon or with or under the influence of any intoxicating liquor, amphetamines, biphetamines, or any other hallucinogenic or other drugs, without the knowledge or consent of the warden, superintendent, or his designated representative.” TO WIT: Mr. Thomas Culberson had on his person after being searched and asked by Law Enforcement if he had any further drugs or weapons prior to entering the Barrow County Detention Center. Mr. Culberson denied any further possession of drugs, and Barrow County Detention Staff located within Mr. Culberson’s front right watch pocket of the pants he was wearing .24g of a white granular substance suspected to be methamphetamine, and within his right sock below the boot line 3.83g of a green leafy substance suspected to be marijuana.

Ms. Sonya Bundy was charged with the following:

OCGA 16-13-30(a) Possession of Methamphetamine: Ms. Sonya Bundy did, in violation of OCGA 16-13-30(a) Possession of Methamphetamine, commit the offense Possession of Methamphetamine when she “(a)….. possess, or have under his control any controlled substance.” TO WIT: Ms. Sonya Bundy possessed in a tent in which she was residing, a cigarette package containing a small, twisted off, black bag containing a 1.25g of a white granular substance suspected to be methamphetamine.

I cleared the call and returned to service.
