Officer’s Narrative:

On October 1, 2021, I was dispatched to [200 BLOCK] Nunnally Road in reference to a stolen auto. Dispatch advised that the complainant was an employee with Hertz Rental Cars and that he was out with a vehicle they reported stolen in Athens/Clarke County, case number 2021-09300105.
Dispatch advised that the vehicle was parked at the above address with a white male sitting in the vehicle. Dispatch provided the vehicle description, 2021 Dodge Charger white in color bearing Georgia tag [REDACTED]. Dispatch also checked the tag, and it was returning stolen out of Athens/Clarke County.
Upon my arrival, I noticed that the vehicle was parked in the driveway sideways. I noticed that the occupant was an older white male who was not moving. I activated my blue lights and exited my patrol vehicle. As I approached, I noticed that the driver was still not moving, at this point I was not sure if he was breathing. I checked the vehicle tag quickly to make sure it was the right vehicle.
I then opened the driver-side door, and the occupant opened his eye and looked at me. I then ordered the occupant out of the vehicle using felony stop procedures. The occupant was taken into custody without incident. He was identified as Mr. Stacey Head.
Mr. Head was placed in double-locked handcuffs which were checked for proper fit. Mr. Head was then searched, incident to arrest, and I located a small piece of tin foil in his front left pocket. Inside the tin foil, I located a clear crystal substance believed to be Methamphetamine.
Mr. Head was then placed into the back seat of my patrol vehicle. I then read Mr. head his Miranda Warning, Mr. head stated that he understood his rights and stated that he would speak to me.
I asked Mr. Head about the vehicle, and he stated that it was a rental vehicle that he rented. I advised Mr. Head that the vehicle was reported stolen. Mr. Head stated that it was not stolen, he again stated that he rented it.
I then spoke with Mr. [WITNESS #1], the complainant. Mr. [WITNESS #1] stated that the vehicle was rented by Mr. Head. Mr. [WITNESS #1] stated that Mr. head did not return the vehicle when he was supposed to. Mr. [WITNESS #1] stated that a demand letter was sent via registered mail, there was a notice for a certified letter for Mr. head in the vehicle. Mr. [WITNESS #1] stated after the appropriate time had passed, they contacted Athens Clarke County and filed the stolen auto report.
I then had dispatch confirm the vehicle was stolen via GCIC/NCIC which they did. The vehicle was then released to Mr. [WITNESS #1]. The property of Mr. Head was released to Mr. [REDACTED], the resident of [200 BLOCK] Nunnally Road, per Mr. Head’s request.
I then transported Mr. Head to the Barrow County jail where he was turned over to on-duty jail staff. I obtained warrants for OCGA 16-8-7, Theft by Receiving Motor Vehicle, and for OCGA 16-13-30 (a), Possession of Methamphetamine. I checked my patrol vehicle for contraband prior to placing Mr. Head into it and prior to leaving the jail.
The suspected Methamphetamine was weighed, .3 grams with the tin foil, and placed into the Barrow County After Hours Evidence Lockers.
