Officer’s Narrative:

On November 28, 2021, at 1842 hours, I responded code three to the area of Haymon Morris Road and Kendall Park Drive in reference to an accident involving two cars that were disabled in the roadway.

Upon arrival, I observed two vehicles in the roadway just past Kendall Park Drive. After I checked on the drivers and was sure there were no injuries, I spoke to a witness identified as [WITNESS #1]. [WITNESS #1] stated that she witnessed the accident. [WITNESS #1] stated that the driver of the Toyota Tundra passed the Toyota Highlander in the no-passing zone then cut him off. [WITNESS #1] stated that as soon as the driver cut the Highlander off, she slammed on the brakes causing the driver of the Highlander to hit her in the rear end.

I then made contact with the driver of the Highlander who was identified as [VICTIM #1]. [VICTIM #1] stated that the driver of the Tundra later identified as Tabitha Bornstein was tailgating him from the Publix Shopping center. [VICTIM #1] stated that he brushed his brakes to get the driver to back off. [VICTIM #1] stated that the driver of the Tundra passed him in the no-passing zone and almost hit him as she re-entered the lane. [VICTIM #1] stated that she then slammed on the brakes, and he was unable to avoid striking her in the rear of her vehicle.

I then spoke with Tabitha whose statement matched that of [VICTIM #1] and the witness’ however, she stated that [VICTIM #1] slammed on his brakes causing her to almost hit him. I advised Tabitha that due to the witness statement and her and [VICTIM #1]’s statements, I was placing her under arrest for reckless driving for operating a vehicle in a manner that placed her and other motorists in danger and passing in a no-passing zone for overtaking a vehicle on a double solid line. I secured her in double-locked handcuffs behind her back that were checked for proper fit. I searched Tabitha in front of my patrol vehicle’s camera and found no contraband. I then placed her in the back seat of my patrol car.

I allowed Tabitha to have someone take possession of her truck and a K9 that she had with her. Tabitha provided me with her mother’s phone number and name ([REDACTED]). I called [REDACTED] and she responded to the scene and took possession of Tabitha’s truck and dog.

Due to the accident requiring a tow truck, the next list wrecker was contacted. Once they arrived and completed their service, I transported Tabitha to the Barrow County Detention Center. There Tabitha was served with two citations OCGA 40-6-390 Reckless Driving and OCGA 40-6-46 (a) Passing in a no-passing zone. She was then turned over to the staff on duty. Prior to leaving, I searched the backseat of my patrol car for contraband, and nothing was found.
