[NARRATIVE #1 on December 01, 2025]

On December 1, 2025, at approximately 0007 hours, I, Officer Jacob Harris, was dispatched to a Hit and Run at the Waffle House (213 Exchange Blvd, Bethlehem, GA, 30620). Dispatch advised that a white Chevrolet SUV left the scene heading North on Loganville Hwy. I responded CODE 1 (no lights and sirens) in my marked patrol unit to the location.

While en route to the location, Officer Perry spotted a 2007 Chevrolet Trailblazer (GATAG# [REDACTED]) matching the description of the vehicle that had left the Waffle House. Officer Perry conducted a traffic stop on the vehicle at the Chevron (113 S Broad St., Winder, GA, 30680). Officer Perry detained Mr. Brown and placed Mr. Brown’s wrist into two pairs of handcuffs, double-locked them, and checked them for proper fit. At approximately 0011, Officer Perry read Mr. Brown his Miranda rights, and Mr. Brown agreed to talk to us, for further information about the traffic stop. Upon arrival, I met with the caller, [VICTIM #1]. I asked Mr. [VICTIM #1] what had happened. Mr. [VICTIM #1] stated that he was sitting in his vehicle when an elderly white man, later identified as Terry Brown, got into his vehicle. Mr. [VICTIM #1] stated that Mr. Brown started backing straight up and ran into his front bumper. I observe the damage to the front bumper; it has a dent and a crack in the front grill. Mr. [VICTIM #1] stated that Mr. Brown got out of his vehicle, handed him a business card, and told him to call him in the morning. Mr. [VICTIM #1] stated that Mr. Brown returned to his vehicle and left the scene. I took pictures of the damage to the vehicle, which will be attached to this report. I gave Mr. Brown a case card with a case number on it. I advised Mr. Brown on how to obtain a copy of the report.

I left the scene and was en route to where Officer Perry was to talk to Mr. Brown. Upon arrival, Officer Perry stated that Mr. Brown is suspended, and he could smell a strong odor of alcoholic beverage coming from Mr. Brown’s breath and person, and he is sitting in the rear of the patrol car. Officer Pierce filled out a Winder Police Department Vehicle Inventory form, which will be attached to this report. Patrick Wrecker to the procession of Mr. Brown’s vehicle.

I approached the passenger side back door and opened it to talk to Mr. Brown. I could smell a strong odor of alcoholic beverage coming from Mr. Brown’s breath and person. While talking to Mr. Brown, he had slurred speech, bloodshot watery eyes, and a strong odor of alcoholic beverage coming from his person and breath. I asked Mr. Brown how much he had to drink. Mr. Brown stated that he was not drunk. I advised Mr. Brown due to him slurring his speech and bloodshot watery eyes, and I can smell a strong odor of alcoholic beverage coming from his breath and person. I asked Mr. Brown if he would be willing to undergo standardized field sobriety tests to ensure his safety while operating a motor vehicle. Mr. Brown stated that he was old and did not agree to do the Standardized Field Sobriety Test. I am trained in standardized field sobriety tests.

Mr. Brown stated that he backed into the vehicle, but he didn’t see any damage. Mr. Brown stated that he gave Mr. [VICTIM #1] his business card and informed him that he will make it right, just call him. Mr. Brown stated that Mr. [VICTIM #1] confirmed that his phone number was right. Mr. Brown stated that he didn’t know that Mr. [VICTIM #1] was calling the police.

At approximately 0036 hours, I read Mr. Brown the implied consent notice for suspects age 21 or over. Mr. Brown agreed to implied consent for blood.

I advised Mr. Brown to turn around and place his hands behind his back. Mr. Brown complied with my commands. I informed Mr. Brown that he was under arrest for D.U.I, Hit and Run, and driving on a suspended license. I placed Mr. Brown’s wrist into two pairs of handcuffs, double-locked them, and checked them for proper fit. I searched Mr. Brown incident to arrest for weapons, contraband, and any means of escape. Mr. Brown didn’t have any contraband on his person. I walked Mr. Brown to my marked patrol vehicle. I checked my back seat for contraband before placing Mr. Brown inside and properly securing him with a seatbelt. I placed Mr. Brown’s belongings on the front passenger seat of my marked patrol unit.

At approximately 0040, I transported Mr. Brown to the NEGA Medical Center in Barrow for a blood draw. The vials of Mr. Brown’s blood were placed into an evidence box and sealed by the Phlebotomist and turned over to me.

I then left the NEGA Medical Center in Barrow and was en route to the Barrow County Jail. I arrived at the Barrow County Detention Center and released Mr. Brown and his belongings to the staff without incident. After transport, I checked the rear of my patrol vehicle for contraband, but no contraband was found.

I issued Mr. Brown three citations as follows.

I placed the Georgia Bureau of Investigation Blood Alcohol/Toxicology kit containing two scaled vials of blood retrieved from Mr. Brown. I filled out a Winder Police Department Receipt for Property# A-31114, a Quick Property receipt, and a GBI test form, and put the evidence into locker# 018A.

[NARRATIVE #2 on December 01, 2025]

On Sunday, December 1st, 2025, at approximately 0008 hours, I, Ofc. Perry #149 initiated a traffic stop by activating my emergency blue lights and sirens on a 2007 white Chevrolet Trailblazer, GA TAG# [REDACTED], associated with a hit-and-run that occurred at 213 Exchange Blvd, Bethlehem, Ga 30620 (Waffle House), that Ofc. Harris #121 was working. The driver of the vehicle pulled into 113 South Broad Street, Winder, Ga 30680 (Chevron).

Upon initial approach, Mr. Terry Brown attempted to exit his vehicle, and I advised him to remain inside. As I approached the driver’s side door, I instructed Terry to keep his hands on the steering wheel. Because I knew the tag number, I knew Terry was driving on a suspended driver’s license. I asked why he left the Waffle House and how much alcohol he had consumed, and he told me that he thought he was settled with the other driver, and he had not had any alcohol.

Terry’s words were incredibly slurred, but I could not smell the odor of an alcoholic beverage at this time due to the amount of cigarette smoke coming from the vehicle. I asked Terry to step outside the car and place his hands behind his back. I placed Terry in properly fitted double-lock handcuffs and advised him that he was being detained. I patted Terry down for any weapons, and none were found.

I read Terry Miranda, to which he agreed, and I asked him again how much alcohol he had consumed, and he informed me that he had not had anything to drink. Terry did tell me that he knew that he was driving on a suspended license, though. As I was walking Terry to the back seat of my patrol vehicle, he was stumbling and required significant assistance from me to walk. I advised Terry that at this time he would be placed under arrest for Driving on a Suspended license and Hit and Run.

I searched Terry for any drugs, weapons, or means of escape, and none were found. Terry was then placed in the backseat of my patrol vehicle, and I waited for Ofc. Harris #121 to arrive on scene. When I got inside my patrol vehicle to gather a bag for Terry’s belongings, I could then smell the strong odor of an alcoholic beverage emitting from his person. Custody of Terry and his belongings was relinquished to Ofc. Harris #121 upon his arrival at the scene. I then returned to service with no further issues.
