On April 24, 2023, at 1519 hours, I, Ofc. Anderson (W139), was dispatched to the Oak Pointe Memory Center (208 Memory Ln Winder GA, 30680) for an abuse call. I responded code 1 (No emergency lights or sirens activated) in my marked patrol vehicle #400.

Upon arrival I walked into room [REDACTED] of the Oak Pointe Memory Center and immediately observed an elderly female, identified as [REDACTED BY AGENCY], with a “scabbed” over swollen upper lip. I also observed several individuals sitting inside of room [REDACTED]. The first individual I spoke with was a supervisor of the Oak Pointe Memory Center, identified as [WITNESS #1].

[WITNESS #1] stated she ([WITNESS #1]) had come into the Oak Pointe Memory Center at 0600 hours on 04/24/[2023] for work. [WITNESS #1] stated she began checking rooms and following her standard routine for the day, without noticing anything unusual. [WITNESS #1] stated at 0800 hours, [REDACTED BY AGENCY] great niece, identified as [REDACTED BY AGENCY], arrived at the Oak Pointe Memory Center to assist in care taking for [REDACTED BY AGENCY].

[WITNESS #1] stated [REDACTED BY AGENCY] noticed [REDACTED BY AGENCY] had an injured upper lip. I spoke with [REDACTED BY AGENCY] who stated when she entered [REDACTED BY AGENCY] room (room [REDACTED]), she observed [REDACTED BY AGENCY] to have a swollen and bloodied upper lip. [REDACTED BY AGENCY] stated she asked [REDACTED BY AGENCY] what had occurred, and [REDACTED BY AGENCY] stated “the big fat black lady” had “socked” her. [REDACTED BY AGENCY] stated she told [WITNESS #1] about [REDACTED BY AGENCY] injury. I asked [WITNESS #1] why it took her so long to report [REDACTED BY AGENCY] injury to law enforcement and [WITNESS #1] stated she had called her supervisors to inform them of the situation.

[REDACTED BY AGENCY] stated she helps take care of [REDACTED BY AGENCY] on Monday’s and Tuesdays from 0800 hours to 1500 hours. I asked [WITNESS #1] who [REDACTED BY AGENCY] may have been referring to when she stated the “big fat black lady”. [WITNESS #1] stated there are two employee’s from a temporary staffing agency (Unique Staffing) which [REDACTED BY AGENCY] may have been referring to.

[WITNESS #1] stated a black female identified as Tesia Johnson and a black female known as [REDACTED BY AGENCY] were the two female employees [REDACTED BY AGENCY] may have been referring to. [WITNESS #1] stated Tesia and [REDACTED BY AGENCY] are black females with “weight” on them. [WITNESS #1] stated both females look somewhat similar. [WITNESS #1] stated she is unsure which female may have been responsible for hurting [REDACTED BY AGENCY].

I asked [REDACTED BY AGENCY] to explain to me what happened. I observed [REDACTED BY AGENCY] to be hard of hearing and to speak slowly. [REDACTED BY AGENCY] stated the “fat black lady” employee slapped and punched [REDACTED BY AGENCY], possibly on the night of 04/23/2023 or 04/24/2023, around 0300 or 0400 hours. I asked [REDACTED BY AGENCY] on which side of her face she was slapped. [REDACTED BY AGENCY] stated she was slapped on the right side of her face.

[REDACTED BY AGENCY] appeared to have difficulty recalling the details on how she was slapped. [REDACTED BY AGENCY] stated she was slapped while she was lying on her bed. I asked [REDACTED BY AGENCY] why she was slapped and “socked”. [REDACTED BY AGENCY] stated she was slapped and socked because she was calling out loud/yelling for her husband [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated the female who struck her told her to “shut up”.

[REDACTED BY AGENCY] stated she was well aware that [REDACTED BY AGENCY] had already left [REDACTED BY AGENCY] room for the day, however, she felt the need to still yell out for [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated [REDACTED BY AGENCY] makes her feel better.

I asked [REDACTED BY AGENCY] when she was “socked”. [REDACTED BY AGENCY] stated she was socked after she was slapped, while she was sitting in an upright position on her bed. [REDACTED BY AGENCY] stated the “fat black lady” had left the room after slapping [REDACTED BY AGENCY] to go get another female employee, who was taller than the female employee who slapped [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated when both black female employees were standing inside of room [REDACTED], one of the black females “socked” [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated the other black female did not do anything after [REDACTED BY AGENCY] observing being punched.

[REDACTED BY AGENCY] stated a black female employee “ripped” her [REDACTED BY AGENCY] clothes off of her and changed her. [REDACTED BY AGENCY] and [REDACTED BY AGENCY] stated [REDACTED BY AGENCY] clothes were removed because her clothes were being changed. [REDACTED BY AGENCY] stated she had urinated on herself and on the bed. I asked [REDACTED BY AGENCY] if the employee removed her clothes for sexual reasons. [REDACTED BY AGENCY] stated no, her clothes were removed because her clothing needed to be changed.

I asked [REDACTED BY AGENCY] to explain to me what had occurred again (how she obtained her injured upper lip). [REDACTED BY AGENCY] stated she was “socked” by a black female employee. I asked [REDACTED BY AGENCY] how many times she was touched/struck/hit by the employee and she stated just once. I asked [REDACTED BY AGENCY] if she was also slapped. [REDACTED BY AGENCY] stated she was slapped and socked by the black female employee.

I observed [REDACTED BY AGENCY] to have some difficulty in recalling the exact series of events concerning her injury. I asked [REDACTED BY AGENCY] if she had urinated herself before or after being struck by the black female employee. I observed [REDACTED BY AGENCY] to have difficulty in recalling when she had urinated on herself.

[WITNESS #1] walked outside of the room in order to obtain the dates of birth for both Tesia and [REDACTED BY AGENCY]. [WITNESS #1] informed me that Unique Staffing provided her with Tesia’s date of birth [REDACTED BY AGENCY]/1988) and [REDACTED BY AGENCY] date of birth [REDACTED BY AGENCY]. [WITNESS #1] stated she had spoken with Tesia on the phone earlier in regards to [REDACTED BY AGENCY] injury. [WITNESS #1] stated Tesia told her that [REDACTED BY AGENCY] had hit her face on the bed railing bar nearest the wall. [WITNESS #1] stated Tesia’s story did not make sense because there was not a railing bar near the wall.

I observed a railing bar on [REDACTED BY AGENCY] bed, which was near a wall. I observed on the wall nearest to the railing bar, two stream’s of dried blood on the wall. I observed in the trash can inside of [REDACTED BY AGENCY] room, several pieces of bloodied napkins used to wipe the blood from [REDACTED BY AGENCY] upper lip. [WITNESS #1] stated the trash can was originally located near the wall where the blood streams were.

I asked [WITNESS #1], [REDACTED BY AGENCY], and [REDACTED BY AGENCY] if [REDACTED BY AGENCY] ever had any hallucinations or mental impairments which may cause her to provide inaccurate information. All parties stated [REDACTED BY AGENCY] was of sound mind. I asked [REDACTED BY AGENCY] what occurred after the black female had struck her in the face. [REDACTED BY AGENCY] stated the black female provided her a pain pill, in which, [REDACTED BY AGENCY] did not take because she was afraid. [REDACTED BY AGENCY] stated she went to sleep after that. I asked [REDACTED BY AGENCY] if [REDACTED BY AGENCY] usually takes medication, in which, he responded no.

I observed [REDACTED BY AGENCY] appeared to be of sound mind and speech, therefore, I provided him with a case card containing case number 2023-00013332. I asked [REDACTED BY AGENCY] if she knew the name of the black female who caused her injury. [REDACTED BY AGENCY] stated she did not know the name of the female who caused her injury. [REDACTED BY AGENCY] stated she had never seen the female before.

I walked outside of room [REDACTED] and into the front desk area to speak with [WITNESS #1] one last time. [WITNESS #1] informed me [REDACTED BY AGENCY] has made false accusations against people in the past. [WITNESS #1] stated [REDACTED BY AGENCY] suffers from [REDACTED BY AGENCY] and that [REDACTED BY AGENCY] believes [WITNESS #1] (the supervisor at the Oak Pointe Memory Center) is having sex with [REDACTED BY AGENCY] husband [REDACTED BY AGENCY].

[WITNESS #1] stated [REDACTED BY AGENCY] has told [WITNESS #1] that she does not like “black people” in the past. I asked [WITNESS #1] if she knew the name of the black female who may have caused [REDACTED BY AGENCY] injuries. [WITNESS #1] stated the employee who harmed [REDACTED BY AGENCY] was either Tesia or [REDACTED BY AGENCY], however, [WITNESS #1] was not sure which one exactly.

I provided [WITNESS #1] with a case card containing case number 2023-00013332. I was unable to identify “[REDACTED BY AGENCY]” during my investigation. Tesia and [REDACTED BY AGENCY] were not on scene during my investigation, therefore, I did not make contact with them. I was also unable to develop probable cause that [REDACTED BY AGENCY] was intentionally injured by Tesia or [REDACTED BY AGENCY], therefore, no warrants have been taken at this time.

I observed a prior existing bruise and “scabbed” cut on [REDACTED BY AGENCY] arm during my investigation as well. [REDACTED BY AGENCY] and [REDACTED BY AGENCY] stated the bruise and scabbed cut on [REDACTED BY AGENCY] arm were unrelated to the injury on [REDACTED BY AGENCY] upper lip. [REDACTED BY AGENCY] declined medical evaluation while I was on scene because she had already be medically evaluated by someone prior to my arrival on scene. [WITNESS #1] informed me Tesia and [REDACTED BY AGENCY] would not be returning back to work at the Oak Pointe Memory Center. I went back into service at 1645 hours.
