On the above mentioned date and time, I Officer Booth was conduction traffic enforcement on University Parkway/316 eastbound beetween Wall Rd and McCaity Rd when I observed a white Chevrolet Suburban traveling at what I estimated speed of 70 MPH in a 55 MPH with workers present. I used my department issued Lidar a DragonEye Speed Lidar (SN21076) to obtain the actual speed. When I activated the Lidar device it returned a speed of 73 MPH.
I pulled in behind the Suburban and conducted a traffic stop by activating my emergency equipment. The Suburban pulled over between Bethlehem Rd and McCarty Rd eastbound. I approached the Suburban and introduced myself fo the driver, identified as Vanessa Kerrethers (DOB [REDACTED BY AGENCY] OLD [REDACTED BY AGENCY]) explained the reason for the stop and asked her for her driver’s license. While Vanessa was retrieving her driver’s license and we were speaking I smelt the odor of marijuana. I asked Vanessa if there was any marijuana in the vehicle and she advised me no, that she smoked a while ago. When I asked Vanessa what a while ago is, she advised it was 30 minutes ago. I asked for another unit to ask as a traffic buffer.
I asked Vanessa to step out of the vehicle. I spoke with Vanessa and I observed that she had bloodshot eyes, I could smell the odor of marijuana coming from her person and breath. I asked Vanessa to participate in field sobriety evaluations to determine if she was safe to operate a motor vehicle, she advised she would.
I medically qualified her for standardized field sobriety. I started conducting standardized field sobriety testing on Vanessa. I began with horizontal gaze nystagmus, I ended this evaluation due to Vanessa not keeping to attention in the stimulus multiple times by losing focus and not following the stimulus. However lack of convergence was present.
I moved Vanessa to a level surface on the shoulder of the road which gave enough space to conduct the evaluations. I then gave instructions for the walk and turn evaluation, I asked Vanessa if she understood the instructions, she advised me yes, I asked her if she had any questions about the instructions, she advised no. Vanessa did remove her flip flops I instructed Vanessa to begin. Vanessa missed heel to toe contact on each step, took an improper amount of steps, and did an improper turn on her first stage. She missed heel to toe on each step and took an improper amount of steps on her second stage. Vanessa put her flip flops back on.
I then gave instructions for the one leg stand. I was not finished with the instructions, and Vanessa started the evaluation without being told to do so. I stopped the field sobriety evaluations due to Vanessa was not able to follow instructions due to consumption of marijuana. Her exhibited divided attention impairment as well as her admission of using marijuana in the last 30 mins, her unsafe act of speeding in a construction I believe she was not safe to drive. I decided to arrest Vanessa for driving under the influence of drugs and speeding for her safety and the safety of the public.
I placed Vanessa in handcuffs, checked for fit and double locked for safety. I placed her in the back seat of my patrol car. While seating in my patrol car I read her Georgia Implied Consent Notice for Suspects age 21 or Older. I asked Vanessa to submit to a chemical test of her blood, she advised she did not understand, that I went to fast and wanted me to read it again. I again read Georgia Implied Consent Notice for Suspects age 21 or Older. Vanessa agreed to the state administered test of blood.
Vanessa’s daughter came to pickup the vehicle. I then transported Vanessa to Northeast Georgia Medical Center Borrow for the state administered blood test. Medical staff at the hospital conducted the blood draw without incident. The sample was placed into a GBI approved vendor’s kit, and sealed by medical staff. I placed Vanessa in two sets of handcuffs behind her back, checked for fit and double locked for safety. I transported her to the Barrow County Jail, where she was turned over to the on-duty deputies without incident.
Vanessa was issued two uniform traffic citations; one for speeding and one for driving under the influence of drugs.
