On 05/31/2026 at 0112hrs, Officers were dispatched to [200 BLOCK] Brookfield Drive in reference to a welfare check. Dispatched advised that the caller later identified as [REDACTED] wanted us to check on the welfare of her children due to one of them calling her upset and wanting to leave.
Sergeant Evans and I arrived on scene and spoke with the dad identified as Wilfredo Fontanez. Fontanez was very intoxicated upon our arrival and we were advised also by dispatch of his intoxication also that he was not fond of law enforcement with weapons within his residence.
I advised him that we were there for a welfare check on the children due to Mrs. [REDACTED] being concerned. Mr. Fontanez advised that him and his ex-wife separated and that they have a court order of visitation rights and when he can keep the children. Mr. Fontanez advised that nothing was wrong and that the children were safe. While speaking with Mr. Fontanez he began to get very aggressive and agitated while speaking with us.
He advised that nothing was wrong and that he didn’t put his hands on the children. I could smell an odor of an alcoholic beverage emitting from him when he spoke. Corporal Reynolds and Officer Beasley arrived on scene. One of the children identified as [REDACTED BY AGENCY] stated that he wanted to speak with me. [REDACTED BY AGENCY] advised that he called his mom because he had heard his dad and his stepdad arguing.
[REDACTED BY AGENCY] stated that it hurt him really bad the way his dad was talking to his stepdad. [REDACTED BY AGENCY] advised that his dad was drunk and that he wanted to go to his mom’s house. I asked [REDACTED BY AGENCY] if anything ever got physical in which he stated no. While waiting for Mrs. [REDACTED] to arrive we asked Mr. Fontanez who has custody of the children in which he stated he does. Mrs. [REDACTED] and the stepdad arrived on scene.
Mrs. [REDACTED] advised that she wanted to take the children home. I asked Mrs. [REDACTED] if she has any documentation to show that she is primary custodian of the children. Mrs. [REDACTED] provided me with documentation stating that she is the primary physical custodian of the children. I returned back to speak with Mr. Fontanez and advised him that due to Mrs. [REDACTED] being the primary custodian and of his level of intoxication that she could take the children.
Mr. Fontanez got agitated with what I advised him and began yelling at Mrs. [REDACTED] and the stepdad. He kept on yelling “fu*k you” multiple times and using vulgar language. We gave him multiple commands to stop yelling and using vulgar language or he would be placed under arrest for Disorderly Conduct. Mr. Fontanez kept yelling at them using vulgar language in which he would still not comply with our commands. Mr. Fontanez was then placed under arrest for Disorderly Conduct.
He was handcuffed behind his back, checked for fit and double locked for safety. Mr. Fontanez was searched incident to arrest, and nothing was located on person and placed in the rear of my patrol unit. I transported Mr. Fontanez to the Barrow County Jail without incident. Starting and ending mileage was given to dispatch. Mrs. Fontanez was turned over to the Barrow County Deputies on duty. Booking forms were completed and turned over to the deputies on duty as well as his property.
