On February 25th, 2026, around 2050 hours, Officer Hawley was dispatched to a hit and run accident on Peeples Valley Rd near Highway 411. The caller advised she was struck by an older model Chevrolet S10. Officer Hawley arrived on scene and met with the caller to conduct his investigation for the hit and run. Later, a Bartow County Sheriff’s Deputy advised he believed he was out with the Chevrolet S10. Officer Hawley went to the area where the truck was located.
Once Officer Hawley arrived on scene at Grassdale Rd and Shallowood Pl, he asked if I could come to the scene. Officer Hawley believed the male was under the influence of alcohol. Due to my certification in field sobriety testing, I drove to the scene. I arrived on scene and then met with the male who was operating the Chevrolet S10. The male was identified as Barry Harkey.
I began my investigation with Mr. Hawkey by introducing myself. I asked Mr. Harkey if he had anything to drink before being involved in the accident. He stated he had, he stated he only drank two Budlight’s, which were from a can. I asked how long it had been since the accident. He stated it had been around two hours. I asked Mr. Harkey medical questions before asking if he would submit to field sobriety testing. During the medical questions, Mr. Harkey advised that he had back issues that would prevent him from walking on a straight line or standing on a leg for balance.
I then asked if he would be willing for me to check his eyes for field sobriety testing. I stated to Mr. Hawkey that the evaluations were completely voluntary. He stated I could check his eyes. I had him sit on his truck’s front bumper. I then asked him to look at the tip of my pin and follow the pin with his eyes, and eyes only. I asked if he understood. He advised that he did.
I then began my evaluation of the horizontal gaze nystagmus.
I then had Mr. Hawkey blow into a field breathalyzer. Mr. Hawkey blew into the tube, and I was able to get a reading. The test was positive for alcohol (.201). I stated to Mr. Hawkey that he was under arrest and placed his hands behind his back. He was handcuffed, which were double locked and checked for equal spacing. I walked him to my patrol car, where he was searched and then placed in the rear of my patrol car.
I read Mr. Hawkey the Georgia implied consent card for ages 21 and over (green card). Once I had read the card to completion, I then asked Mr. Hawkey if he would be willing to submit to testing of his blood. He stated he did not want me to take his blood. I then transported Mr. Hawkey to the Cartersville Police Department. Once there, I was able to secure a search warrant for a blood drawing. A Bartow County Judge granted the warrant for me to get blood from Mr. Hawkey. Officer Pace from Euharlee Police Department was able to draw the blood from Mr. Hawkey.
The blood was placed into evidence at the Cartersville Police Department. Once the evidence was secured, I took Mr. Hawkey to the Bartow County Jail. Once at the jail, he was handed over to intake personnel without incident. Mr. Hawkey was issued citations for his charges. He was charged with D.U.I, reckless driving, hit and run, and following too closely.
