On 07/19/2026 I, Officer Blackmon while employed with the Adairsville Police Department Uniformed Patrol Division, was dispatched to the area of Manning Mill Road and Highway 41 in reference to a BOLO vehicle. Bartow County 911 advised they had received a call about a silver Chevrolet Malibu, displaying the tag [REDACTED], that was traveling on Manning Mill Road, and the driver was possibly under the influence. Bartow County 911 advised that the caller stated the driver was all over the road, and had also ran multiple stop signs. At this time I went to the area of Manning Mill and Highway 41.
As I arrived in the area I turned onto Manning Mill Road, and observed a silver Chevrolet Malibu parked behind Camille’s Corner Mart facing Manning Mill Road. As I entered the parking the vehicle immediately turned out onto Manning Mill Road. As the vehicle turned out onto Manning Mill it crossed over the double yellow line into the on coming lane. The vehicle then crossed over Highway 41, and continued onto Manning Mill Road towards Old Highway 41. As the vehicle traveled on Manning it crossed over the double yellow line into the oncoming lane, and continued to drive over the double yellow line until it approached the stop sign. At the stop sign was noticed that the vehicle’s tag matched the one given for the BOLO vehicle. The vehicle then made a left hand turn onto Old Highway 41. At this time I initiated my emergency equipment to conduct a traffic stop.
The vehicle then came to a stop at the entrance to Adairsville High School. I then approached the vehicle, and made contact with the driver, Billy Floyd. Mr. Floyd stated he knew why he was being stopped, and it was because when I ran his tag it came back that his license was suspended. I then advised Mr. Floyd that the reason for the stop was failure to maintain a lane. Mr. Floyd also stated that he had a limited permit, but did not have it on him at the time of stop. Mr. Floyd stated he had lost it, and had applied for a new one but had not received it yet.
While speaking with Mr. Floyd I noticed the odor of an alcoholic beverage coming from his person, and I also smelled the odor of Marijuana coming from his vehicle. While speaking with Mr. Floyd I noticed that his speech was slow and slurred. I asked Mr. Floyd if he had any alcohol today, and he stated no. At this time I asked Mr. Floyd to exit the vehicle.
Once at the rear of the vehicle I asked Mr. Floyd if he had any weapons or anything illegal on his person, and he stated no. I then asked Mr. Floyd if I could check his pockets, and he gave consent. While searching Mr. Floyd’s person I located a green Liquid Diamonds THC vape pen in his left pants pocket. I then completed the search with no further findings. While speaking with Mr. Floyd I again noticed the odor of an alcoholic beverage coming from his person, and again asked Mr. Floyd how much he had drank. Mr. Floyd replied that he had not drank any alcohol, and would take any test he needed to. Mr. Floyd then submitted his breath to a portable breath test that showed his breath was positive for alcohol. I then asked Mr. Floyd if he would submit to Standardized Field Sobriety Testing, and he agreed to take all test.
At this time I gave Mr. Floyd instructions for the Horizontal Gaze Nystagmus(HGN). Mr. Floyd stated he understood the instructions, and at that time I administered the test. During HGN Mr. Floyd showed Lack of smooth pursuit in both eyes, distinct and sustained Nystagmus at Maximum Deviation in both eyes, and distinct and sustained Nystagmus prior to 45 degrees in both eyes. Mr. Floyd showed 6/6 possible clues during this test. I then gave Mr. Floyd instructions on how to the Walk and Turn test. During the test Mr. Floyd used his arms to balance, stepped off of the line multiple times, missed heel to toe on multiple steps, and took the wrong number of steps.
Mr. Floyd also made an improper turn, and took the wrong number of steps. Mr. Floyd had to catch his balance multiple times during the test, and also stopped after making the turn to ask what the instructions were again. Mr. Floyd did not count his steps out loud going down, and leaned during the entire test. Mr. Floyd demonstrated 6/8 possible clues during this test. I then gave Mr. Floyd instructions on the One Leg Stand test. During this test Mr. Floyd swayed, used his arms to balance, hopped, and put his foot down. Mr. Floyd also did not keep his hands by his side, or look down at his toe while doing the test after being instructed to do so. Mr. Floyd also counted improperly during this test demonstrating 4/4 possible clues.
After all testing was finished it was determined that Mr. Floyd was under the influence of alcohol, and was placed under arrest. I then read Mr. Floyd Implied Consent of Suspects 21YOA or Older, which he consented to testing of his blood. I then placed Mr. Floyd in the back of my patrol car. Mr. Floyd’s vehicle was then inventoried, and the next list wrecker service was contacted. During the inventory I located two open Vodka bottles. One under the driver’s seat, and the other in the passenger seat. Stacy’s Towing arrived on scene, and removed the vehicle. All evidence located was collected, and I then transported Mr. Floyd to Station 10 for blood draw. Once on scene Mr. Floyd refused the Implied Consent blood draw. I then transported Mr. Floyd to the Bartow County Jail without incident.
