DUI-Driving Under the Influence

On Sunday, July 12, 2026, at approximately 0449 hours, I was dispatched to [10 BLOCK] Barrett Lane in reference to a missing person report. Before making contact with the complainant, Ms. Connie Smith, I located the missing person at the intersection of Porter Street and Gilmer Street. The Missing Person was relocated to 300 North Dixie Avenue (Waffle House). Contact was made with Ms. Connie Smith via phone call.

Ms. Smith was advised that her missing husband had been located and was escorted to the Waffle House to get food. Ms. Smith stated she would be en route to pick up her husband and disconnected the phone call. Shortly after speaking to Ms. Smith, she arrived on scene at 300 North Dixie Avenue (Waffle House). Officers observed Ms. Smith’s Lexus Rx350, blue in color, bearing Georgia tag, with the driver’s side front and rear tires missing from her vehicle. When asked about the tires, Ms. Smith stated she struck a mailbox in her neighborhood and left the scene to come get her husband. Ms. Smith showed a wide range of emotions while on scene speaking with officers. Ms. Smith was also having a hard time keeping her balance when she exited the driver’s side and walked to the opposite side of the vehicle to sit in the passenger seat. Contact was made with Ms. Smith’s son.

Ms. Smith’s son stated that his mother, Ms. Connie Smith, did have issues with consuming large amounts of alcoholic beverages. He stated his mother was more than likely intoxicated while driving.

Ms. Smith was asked if any alcoholic beverages were consumed before driving her vehicle. Ms. Smith stated she had a large glass of an alcoholic beverage, and when asked what her drink of choice was, she replied with liquor. Ms. Smith agreed to Field sobriety tests. Sergeant Blackstock performed all of the evaluations on Ms. Smith, which also indicated that Ms. Smith was under the influence of alcoholic beverages.

Ms. Smith was read the Implied Consent, to which Ms. Smith refused.

Ms. Smith was placed in handcuffs in front of her body, which were double locked for safety and checked for proper fit. Ms. Smith was searched incident to arrest, and the search yielded negative results for contraband. Ms. Smith was placed into the back seat of my marked patrol vehicle. Ms. Smith was transported to the Cartersville Police Department, and a search warrant was obtained for Ms. Smith’s blood. Ms. Smith was transported to Piedmont Cartersville Hospital, and a successful blood draw was performed. Ms. Smith was transported to the Bartow County Jail and turned over to jail staff without incident.

Ms. Smith’s vehicle was towed by Steele’s Towing, and a copy of the tow sheet is attached to this electronic case file.

Ms. Smith’s blood test kit was placed into evidence at the Cartersville Police Department. A DOFS form was completed for the kit, also.

A warrant for DUI Alcohol was obtained, and a copy of the warrant is attached to this electronic case file.
