On Saturday, September 12, 2026, at approximately 2214 hours, I responded to the area of Old Mill and Etowah Dr in reference to a BOLO issued by Bartow County Dispatch for a female operating a motor vehicle that is possibly under the influence of alcohol (Case # 2026-00021284). Complainant had called in the BOLO to Bartow County dispatch and advised the female was operating a red in color Tesla bearing GA tag.
SGT. A. Cooney observed the red in color, 2023 Tesla Model Y (GA) on Old Mill Rd at the intersection of Victoria Village and conducted a traffic stop on the vehicle. The final stop was at [10 BLOCK] Greenway Ln. See SGT. A Cooney’s case supplemental for further information regarding the traffic stop and Ms. and Mr. [REDACTED]’s statement.
I arrived at [10 BLOCK] Greenway Ln, where the traffic stop was conducted and identified the driver as Ms. Gaelle Fotio. Ms. Fotio was asked where she was coming from tonight and Ms. Fotio stated “I go to pick up my car from over there and park it” while pointing toward Old Mill Rd at Etowah Dr. I asked Ms. Fotio what had happened in Emerson, Ga (where the call originated) and Ms. Fotio stated nothing happened. Ms. Fotio stated she did not remember where she had come from due to her not knowing the business name or city.
During the interaction with Ms. Fotio, I observed her with bloodshot watery eyes, consistent with signs of impairment of alcohol. I asked Ms. Fotio if she had anything to drink tonight, referring to an alcoholic beverage. Ms. Fotio stated she did not drink but later admitting to having “one chardonnay.”
I asked Ms. Fotio if she would be willing to conduct Standardized Field Sobriety Testing to determine the extent of her impairment, which she agreed. I advised Ms. Fotio that we are going to conduct the walk-and-turn portion of the test and Ms. Fotio was instructed to place her left foot on an imaginary line about the width of his foot with her right foot in front in a heel-to-toe fashion and was given the instructions. Ms. Fotio, while in the starting position, stopped and stood normally and did not follow instructions. After Ms. Fotio asked multiple times to redemonstrate the instructions, Ms. Fotio stated she understood and began. While Ms. Fotio was conducting the test, I observed that Ms. Fotio could not balance during instructions, starts too soon, stopped while walking, misses heel-to-toe, then stopped while walking and not completing the test, ultimately taking 5 steps. During this test 5 out of 8 clues were observed.
Finally, we moved on to the one-leg stand portion of the test where I demonstrated the one-leg stand to Ms. Fotio. After the block of instruction was demonstrated to Ms. Fotio, I asked if she understood which she stated she did. Prior to advising Ms. Fotio she may begin the test, Ms. Fotio stated her feet are broken as well as her arms. Ms. Fotio advised she would be willing to do the test but began to argue, ultimately refusing to conduct the one-leg stand.
Officer Foster performed Horizontal Gaze Nystagmus (HGN) on Ms. Fotio. Officer Foster advised me that he observed 6 out of 6 clues during the investigation. (See case supplemental for further information)
After the investigation concluded, it was determined that Ms. Fotio was driving under the influence to the extent it was less safe for her to drive. I advised Ms. Fotio she is under arrest for Driving Under the Influence, Ms. Fotio was handcuffed behind her back, double locked, and checked for proper fit. Ms. Fotio was searched incident to arrest, in which no contraband was located. I escorted Ms. Fotio to the rear seat of my department issued, marked patrol car where she was placed inside. Ms. Fotio was read implied consent verbatim from my green laminated card, and she agreed to a blood draw.
Due to Ms. Fotio’s red in color, 2023 Tesla Model Y (GA) being parked in front of her house, where the final stop was for the traffic stop SGT. Cooney conduct, the vehicle was left there.
Ms. Fotio was transported to the Cartersville Police Department (195 Cassville Rd), where she was booked in and fingerprinted for DUI- Less Safe. After completing the book in process, Officer Foster stayed with Ms. Fotio while I was able to obtain a search warrant for Ms. Fotio’s blood, to determine the extent of her impairment of alcohol (search warrant # 26-SW-000284).
After having the search warrant in hand for Ms. Fotio’s blood, Ms. Fotio was transported to the Cartersville Piedmont Hospital (960 Joe Frank Harris Pkwy) to execute the search warrant. After arriving at the hospital, and walking through the main entrance, Ms. Fotio asked why we were at the hospital and not the jail. I advised Ms. Fotio that we are going to execute the search warrant for her blood (let it be noted that I explained this to Ms. Fotio multiple times prior to arriving to the hospital).
Ms. Fotio stated she did not want to go, and I asked Ms. Fotio if she is refusing the search warrant for her blood. Ms. Fotio stated yes and that she did not want to go. Ultimately refusing to conduct the search warrant for her blood.
Ms. Fotio was then transported to the Bartow County Jail, where she was turned over to the jail staff without incident. Due to Ms. Fotio refusing to submit to the designated state administered chemical test of blood, Ms. Fotio’s driver’s license was forfeited and a GA Department of Driver Services form 1205 was completed and submitted to the GA DDS. My patrol car was searched before and after each transport, with no contraband located.
Ms. Fotio was charged with DUI- Less Safe (WN- CE-0183440) and Willful Obstruction of Law Enforcement Officers-(M) Obstructing investigation (WN- CE-0183441). The return search warrant was completed and sign. Let it be noted on the return search warrant, the date it was returned was on 9/13/26 at 0513 hours. At the time, I was unable to change the date and time.
