On Monday, November 24, 2025, at approximately 0052 hours, I responded to a BOLO issued by Bartow County 911 regarding a reported road rage incident on Interstate 75 within the Cartersville city limits, involving a suspect who allegedly brandished a firearm at another driver. Dispatch remained in contact with the caller, later identified as the victim, who provided the suspect’s direction of travel.
Both vehicles exited the interstate at Exit 293 and continued north on Highway 411 near Richards Road. White PD Officer Bowes located the suspect vehicle, a gray 2013 Hyundai Elantra bearing Georgia plate xxxxx. A felony traffic stop was conducted with the assistance of Sergeant Foster and Lieutenant Logue. The driver, identified as Mr. Guy Kirby, was detained in handcuffs placed to the rear without incident. A search of the vehicle revealed no additional occupants.
I read Mr. Kirby his Miranda Rights, and he agreed to speak with officers. According to Mr. Kirby’s statement, he was merging onto the interstate at Exit 285 when the victim “ran up on me and stayed on me.” Mr. Kirby said he slowed down to allow the other driver to pass, but the driver did not do so. He stated that the victim continued to follow closely behind him. Mr. Kirby explained that he then pulled over to the shoulder, and Victim passed before exiting at Exit 293. When asked if he displayed a firearm during the incident, Mr. Kirby admitted, “Yes, I did.” Mr. Kirby further stated that victim pulled alongside him and rolled down his window, and that he did not know what to expect at that point. Mr. Kirby said he did not point the firearm, but acknowledged that he brandished it.
According to victim’s statement, he was traveling on Interstate 75 when Mr. Kirby merged onto the highway. Victim said Mr. Kirby then moved onto the shoulder and “pointed a gun at me, which was hanging out of the car.” Victim stated he rolled down his window and yelled, “You’re going to shoot, you’re going to kill me.” He described the firearm as a small, black, compact handgun.
A search of Mr. Kirby’s vehicle uncovered a black Ruger LC9s 9mm handgun, serial number xxxxxx, on the passenger seat. The firearm was not loaded and had no magazine or ammunition inserted. Additional firearms were located inside the vehicle, including a Smith & Wesson SD9 VE 9mm pistol, serial number xxxxx, accompanied by two loaded magazines, and a Ruger LCR revolver, serial number xxxxxx. Also found were three loaded magazines of 9mm ammunition and .38 caliber ammunition.
Mr. Kirby was searched incident to arrest, with no additional weapons or contraband located. He was secured in the rear of my issued patrol car, which was checked before and after transport, and no contraband was found. An inventory of Mr. Kirby’s vehicle was conducted, and no contraband was found. Mr. Kirby’s vehicle was towed from the scene by Matthew’s Garage.
Mr. Kirby was transported to the Bartow County Sheriff’s Office and released into the custody of Deputy Cline for housing. The on-call Criminal Investigations Division Inv. Gray was notified, but did not respond.
Warrants were obtained for Mr. Kirby for Aggravated Assault (CE-0177634) and Possession of a Firearm or Knife During the Commission or Attempt to Commit Certain Felonies (CE-0177635). The firearms were placed into evidence inside a secure locker at the Cartersville PD.
Victimwas issued a citation for following too closely (C1139250505) and reckless driving (C1139250506).
