On Tuesday, June 9th 2026 at approximately 0702 hours, I was dispatched to 100 Pine Grove Rd (Dellinger Park) in reference to an individual making threats.

Prior to my arrival, I was informed that the suspect was proceeding up the hill in the direction of the Dellinger Park swimming pool, upon my arrival I proceeded towards the pool in an attempt to locate the individual who was described as a Hispanic male wearing a gray t-shirt with the number 11 on the back. No contact was made at the pool, and I then proceeded towards the basketball courts as Bartow 911 informed me the subject had returned towards the Complainant, at which point I located the suspect. Immediately upon my arrival to the basketball courts, I identified the suspect as Mr. Henry Rios, with whom I had criminally trespassed from Dellinger park on 05/08/2026 (Case No. 2026-00013597)

Upon making contact with Mr. Rios, Officer R .Chapman 1161 and I instructed him to keep his hands where I could see them to which he responded by putting both hands into the air. Mr. Rios was then placed under arrest with both hands handcuffed behind his back, the handcuffs were checked for proper fit and double locked to ensure no further tightening. Mr. Rios was then searched incident to arrest which yielded no contraband, he was then placed in the rear seat of Officer R. Chapman’s patrol vehicle which is searched prior to and after transport yielding negative for contraband. Post arrest, Mr. Rios continued to make nonsensical statements while seated in Officer Chapman’s vehicle. Mr. Rios was subsequently transported to the Bartow County Jail by Officer R. Chapman 1161 where he was turned over to jail staff without incident.

After Mr. Rios was taken into custody and transported, I spoke with Complainant who stated Mr. Rios had threatened him by making hand gestures indicating a knife across his own throat, and stating that he would kill him. Complainant went on to state, Mr. Rios was acting very unpredictable and making repeated nonsensical statements, while adopting an aggressive stance with his fists clenched. Mr. Rios also stated he was going to burn an American flag that was located on the ground outside of the basketball court. Complainant went on to state he did not wish to pursue criminal charges against Mr. Rios as he did not want to have any further dealings with him due to the way Mr. Rios made him feel in fear for his safety and well being.

After the conclusion of my speaking with Complainant, I then spoke with Juvenile #1, and witness who stated they were running along the paved path at the park during a practice for their cross country team when Mr. Rios began running up to them, and abruptly cut in front of their path. Both Juvenile #1 and Witness then stated that Mr. Rios stated “I will kill you.” to Juvenile #1 while making a slashing gesture across his neck.

Contact was then made with the father of Juvenile #1 who stated that he wished to pursue charges against Mr. Rios for the threats made towards his son.

Due to the totality of the circumstances, to include repeated threats of death, Mr. Rios statement that he was going to burn a flag, and his criminal trespass at the park warrants were obtained for Terroristic Threats and Acts (Felony), Criminal Trespass after Notice, and Disorderly Conduct. (CE-0181588, CE-0181589, CE-0181590). A copy of these warrants as well as a copy of Mr. Rios CTW from the park is attached to this electronic case file.
