[NARRATIVE #1 on March 26, 2025]

On Wednesday, March 26th, 2025, I, M.D. Mercado, employed by the Adairsville Police Department patrol division, was dispatched to a criminal trespass at approximately 1324 hours at 938 Hwy 140 Nw, Adairsville, GA 30103.

I arrived on scene and met with Det. J. Nesbitt and Det. D. Desai who had a male subject detained, hands cuffed behind his back. His cuffs were checked for fit and double locked. The male subject was later identified as (Joshua Rice Rogus), who was then searched and placed in the back seat of my patrol vehicle.

Det. J. Nesbitt and Det. D. Desai advised me that Mr. Rogus had fallen through the ceiling of the restroom while a female subject [VICTIM #1] was actively using the restroom. Det. J. Nesbitt showed me the photos taken of the damages in the restroom where Mr. Rogus fell through the ceiling.

I received a written victim statement from Ms. [VICTIM #1] which contained the following: “I was using the bathroom and as I was sitting there I heard a loud noise over my head and it scared me so I got up washed my hands and the noise got louder so I walked to the door and he fell by the toilet. I was so scared I ran up the hall and got Ms [REDACTED]. He told me he watched me pee”

I received a written witness statement from [WITNESS #1] which contained the following:
“Heard [VICTIM #1] scream, heard stuff falling from the ceiling. Walked around to front office and seen a man getting up off floor inside the bathroom dusting himself off. [VICTIM #1] was in the bathroom asking the man where he came from. We called the police. And police came + arrested man.”

The business owner [VICTIM #2] of “Discount Towing” stated she does not have a current estimated price for the items that were damaged during this crime. She did advise that she will get an invoice on fixing the damages to submit at a later date to the Adairsville Police Department.

Mr. Rogus’ vitals were checked by (BCFD) Bartow County Fire Department. Mr. Rogus signed a refusal for care form with the BCFD.

Mr. Rogus was transported to the Bartow County Sheriff’s Office. Custody of Mr. Rogus was transferred over to Bartow County Jail without incident.

Warrants were taken out for Joshua Rice Rogus.

[NARRATIVE #2 on March 26, 2025]

On 03/26/25 at approximately 1320 hours I, Detective J.Nesbitt heard a call for service over dispatch. I was aware that the patrol officers that were on duty were out on another call at this time. Due to the nature of the call I responded quickly to Discount Towing at 950 US HWY 140 in reference to a subject that had fallen through the ceiling of the business and was possibly watching employees using the restroom from the ceiling.

While I made my way through the building I observed a restroom that had the door open and inside the restroom I could see what appeared to be significant damage where someone had fallen from directly above the toilet. I located the suspect, later identified as Mr. Joshua Rice Rogus. Mr. Rogus was lying on the floor in a hallway nearby the restroom. I placed Mr. Rogus in handcuffs behind his back and then searched him for any possible weapons on his person. I observed that several female employees of Discount Towing were visibly distraught over Mr. Rogus presence in the building.

I immediately relocated Mr. Rogus outisde of the building and placed him into the rear seat of Deputy Mercado’s patrol vehicle. I then went back inside the building and gathered witness statements and photographs of the damage to the property.

An employee at the front desk advised me that Mr. Rogus had walked into the business and asked if they could work on his vehicle. She advised him that they could not work on his vehicle and then she was under the impression that he left the business. A short time later the employees said they heard something in the ceiling and then the suspect fell through the ceiling shortly after.

The owner of Discount Towing Ms. [VICTIM #2] advised me that she would get an estimate for repairing of the damages and get it to me. From my observations on scene I estimated that the cost to repair the ceiling would be in excess of $500.00.

Mr. Rogus vehicle was parked in front “Vicko’s Tacos and Tequila”, a nearby restaurant. Other Officers on scene had the vehicle towed by way of list wrecker service through Bartow County E911. Animal Control was contacted and removed a dog from the vehicle before it was towed. I was made aware that Mr. Rogus had not paid for a meal that he had at the restaurant before he went to Discount Towing. I was also made aware that the restaurant did not want to press any charges on Mr. Rogus.
